Lego Tel 305.579.0578 Fax 305.961.5348 lagoc@gtlaw.com Submittal for Request for Special Appearance 3977, 3979, 3983, 3985, and 3995 SW 37 Avenue, Miami, Florida Folio Nos.: 01-4128-028-0100, 01-4128-025-0060, 01-4128-028-0080, 01-4128- 028-0090,, and 01-4128-028-0070 (collectively, the "Property") Dear Mr. Garcia: We represent Bethany's Holdings at Hissar, LLC, Sam's Holdings at Hissar, LLC, and Oliver's Holdings at Hissar, LLC (collectively, the "Applicant") with respect to land use and zoning matters in connection with the redevelopment of the Property. A portion of the Property is currently being replatted pursuant to the Hissar Grove T-Plat #1863—C (the "T-Plat"), which is in the process of being reviewed. A copy of the T-Plat is enclosed as Exhibit "A". The T-Plat requests the vacation and closure of a 30' utility easement and access way plat restriction within that certain portion of Lot l 0 located along the northern boundary of the T-Plat (the "Vacation and Closure"). The Vacation and Closure is currently being reviewed by the City. Additionally, Lot 10 is encumbered by that certain Covenant Running with the Land, attached hereto as Exhibit "B", which places certain restrictions on the development of Lot 10 as further discussed herein. As such, on behalf of the Applicant, we respectfully submit this application for Special Appearance to be considered as a companion item to the Vacation and Closure. I. History The Property was originally developed in accordance with the Plat of Hissar (the "Original Plat") as recorded on July 1, 1968 in Plat Book 85 at Page 4 of the Public Records of Miami -Dade County (the "County"). The Original Plat dedicated Lot 10 as an unbuildable site and private access way and utility easement (the "Easement"). The dedication language regarding the Easement on the Original Plat also mentions a covenant running with the land, recorded in the Public Records of the County in Official Records Book ("ORB") 6329 at Page MIA 186424914v3 GREENBERG TRAURIG, P.A. • ATTORNEYS AT LAW • WWW.GTLAW COM 333 S.E. 2nd Avenue w Suite 4400 • Miami, FL 33131-3238 r Tel 305.579.0500 • Fax 305.579.0717 Hissar Special Appearance March 27, 2018 Page 2 619, further restricting and describing the use and maintenance of the Easement (the "1968 Covenant"). A copy of the 1968 Covenant and the Original Plat are attached as Exhibit "B" and Exhibit "C", respectively. The 1968 Covenant is between and among the parties to the Original Plat and was required as a condition to a variance approval at the City relating to street frontage, as well as a condition to a variance approval from subdivision regulations of the County. It also established a property owners' association, composed of the property owners of the Original Plat. Said association, among other responsibilities, held title to and became responsible for the general management of Lot 10. Additionally, the 1968 Covenant granted to the City a "perpetual right of access in, over and under and across Lot 10" and "for all proper public purposes, including but not limited to, fire and police protection, trash and garbage collection, installation of and maintenance of storm drainage, water, sewer, electric, telephone and other utilities." Further, Lot 10 was restricted as an unbuildable lot unless replatted as provided in the Original Plat. The 1968 Covenant was subsequently supplemented by an Easement Agreement and Supplemental Covenant dated February 25, 1971 and recorded on April 16, 1971 in ORB 7187 at Page 803 (the "Easement and Supplemental Covenant"). The Easement and Supplemental Covenant provided a right of access to all the owners of the Original Plat and the association as well as a method for billing, paying and collecting proportionate share of the costs to maintain Lot 10. A copy of the Easement and Supplemental Covenant is attached as Exhibit "D". On January 27, 2015, a Release of Easement and Other Rights was executed by the owners of Lots 1-5 of the Original Plat regarding any and all documents establishing rights recorded in the Public Records of the County (the "Release"). The Release was conditioned upon 1) the approval and recordation of the T-Plat; 2) turnaround access as provided on the T-Plat or other like turnaround area; and 3) required that rights to access the turnaround to be granted in favor of the owners of Lots 1-5. As such, the rights established in the 1968 Covenant and the Easement and Supplemental Covenant have been wholly released by the owners of Lots 1-5. A copy of the Release is attached as Exhibit "E". Furthermore, the Easements and unbuildable lot restriction provided in the Original Plat are being vacated and extinguished for the portion of Lot 10 located at the Property by the proposed replat and Vacation and Closure. II. Special Appearance Request Through the T-Plat, the Applicant is requesting the vacation and closure of the Easement contained within that certain portion of Lot 10. Because Lot 10 is restricted by the 1968 Covenant and the Easement and Supplemental Covenant, the Applicant must seek a partial release to the 1968 Covenant and the Easement and Supplemental Covenant from the City and the County. A draft partial release is attached as Exhibit "F" (the "Partial Release"). The execution of the Partial Release will confirm the Owner's right to develop on that portion of Lot 10. It is important to note that notwithstanding the Release, all of the current property owners are also executing the Partial Release to acknowledge to the City that they agree to the terms of the Partial Release as it pertains specifically to the Easement. All other rights in favor of the City and limitations to the owners as the same may relate to Lot 10 remain in place. Based on the foregoing, we submit this request for a Special Appearance to effectuate the Partial Release by the City and further, request that said appearance occur as a companion item to the Vacation and Closure.
