The Property is currently being platted pursuant to the Hissar Grove T-Plat #1863 — C (the "T-Plat"), which is in the process of being reviewed. A copy of the T-Plat is enclosed as Exhibit "A". On behalf of the Applicant, we respectfully submit the enclosed Vacation and Closure Application for the 30' utility easement and access way plat restriction located along the northern boundary of the T-Plat (the "Closure Request"). History The Property was originally developed in accordance with the Plat of Hissar (the "Original Plat") as recorded on July 1, 1968 in Plat Book 85 at Page of the Public Records of Miami -Dade County (the "County"). The Original Plat dedicated Lot 10 as a private access way and utility easement (the "Easement"). The dedication language regarding the Easement on the Original Plat also mentions a covenant running with the land, recorded in the Public Records of the County in Official Records Book ("ORB") 6329 at Page 619, further restricting and describing the use and maintenance of the Easement (the "1968 Covenant"). Below in Image 2 and Image 3 is a portion of the Original Plat showing the Alley and the dedication language. A copy of the Original Plat and the 1968 Covenant is attached as Exhibit "B" and Exhibit "C". Two (2) other utility easements were also recorded following the recordation of the Original Plat (the "Utility Easements"). Image 3 1 On December 22, 2017, the City was presented with a letter requesting confirmation that the Utility Easements had been released. A response was received from the City's Public Works Director via electronic correspondence on January 18, 2018 confirming that the Utility Easements had been released by instrument. A copy of the December 2017 letter and response is attached as Exhibit "E". MIA 186304211v2 GREENBERG TRAURIG, PA • ATTORNEYS AT LAW • WWW.GTLAW.COM Hissar Grove Easement Closure Page 3 Following the Original Plat, only two (2) utilities are present within the Easement: the County Water and Sewer Department ("WASD") mains and Florida Power & Light ("FPL"). Following a presentation to the City's Plat and Street Committee (the "Committee") requesting the Closure Request on November 2, 2017, the Committee voted in favor of the request by a vote of 6-0. In furtherance of the unanimous decision in favor of the Closure Request by the Committee, a memorandum from Public Works Professional Engineer III Abraham Bachtiar was presented to the Public Works Director confirming the vote (the "Memorandum"). A copy of Memorandum is included as Exhibit "F". Therefore, pursuant to City Code, the below analysis in favor of the Closure Request is being requested in connection with the T-Plat. II. Easement Closure Analysis The Committee determined that the application for Closure Request meets the criteria established in Section 55-15(c) of the City Code. I. Is it in the public interest, or would the general public benefit from the vacation of the right of way? The Easement is internal to the Property and currently does not provide any benefit to the general public. Facilities owned and operated by FPL and WASD will continue to exist within the Easement by instrument, and if relocations are needed, arrangements between the Applicant and the respective utility company(ies) will occur. The Committee noted on the Memorandum that there is "no effect on the general public." II. Is the general public no longer using the right of way, including public service vehicles, fire, or other emergency vehicles? The general public is not using the Easement. There is no impact to public service vehicles, fire, or other emergency vehicles by the Closure Request. Further, the Committee indicated on the Memorandum that there "is no use by emergency service vehicles." III. Would there be no adverse effect on the ability to provide police, fire, or emergency services? As noted above, public service vehicles are not utilizing the Easement; however, the Closure Request will be reviewed by police, fire, and emergency services for compliance with their requirements. As stated in the Memorandum, "there is no adverse effect because there is no use by the emergency vehicles." Would the vacation and closure of the right of way have a beneficial effect on pedestrian and vehicular circulation in the area? The Memorandum states that "there is no effect on pedestrian and vehicular circulation." The Easement is mostly unimproved and granting the Closure Request has no impact on pedestrian or vehicular circulation at the Property. The vacation and closure is beneficial since it permits the redevelopment of the site under Miami 21 and the current City Code. Any pedestrian and/or vehicular access will be accommodated as required by the City's existing requirements. For the reasons stated above, and in connection with the City Plat and Street Committee's recommendation of approval of the Closure Request, we submit the enclosed Vacation and Closure Application. The Plat of Hissar Plat (Plat Book 85 Page 4) describes a "private access way and utility easement" within Lot 10 as well as two 15 foot wide utility easements located outside of Lot 10. The plat notes further clarify that the 15 foot wide easements were created by instrument to the Department of Water and Sewers of City of Miami, and the instrument is recorded in the Public Records of Miami -Dade County in Official Records Book 6013, at Page 51. Based on our review, both of these easements were released by the City in 1969 (ORB 6519 PG 331) and in 1977 (ORB 9752 PG 66) (See Exhibits A and B). Accordingly, we would appreciate your verifying that the only utility easement that must be vacated as a condition the Hissar Grove tentative plat is the utility easement located within Lot 10 of the Plat of Hissar.
