GENERAL INFORMATION REQUEST: Pursuant to Chapter 54, Section 54-4(b), of the City Code of Ordinances, Bethany's Holdings at Hissar, LLC, Sam's Holdings at Hissar, LLC, Oliver's Holdings at Hissar, LLC (collectively, the "Applicant") request to vacate, close, abandon and discontinue the use of a platted utility and access way easement situated between 3983 SW 37 Avenue and 3979 SW 37 Avenue, and that portion which leads up to 3995 SW 37 Avenue and 3985 SW 37 Avenue (the "Platted Easement"). SUBJECT PROPERTY: The Platted Easement is approximately 220 feet long, and consists of approximately 7,200 square feet of land. A portion of Lot 10 of the existing Plat of Hissar, the Platted Easement is in a Sub -Urban -Restricted ("T3-R") Transect Zone, and in the Neighborhood Conservation District (NCD-3) of Coconut Grove. At this time, the Platted Easement provides access to two developed, waterfront properties to the east, and vacant Tots to the north and south. The Platted Easement is highlighted in red in the aerial view shown as Figure 1 below. Figure 1: Aerial View of Platted Easement (highlighted in Red) Consistent with the Applicant's Letter of Intent, the "Unanimous Written Consent of all of the Members of and the Sole Manager Bethany's Holdings at Hissar, LLC, Oliver's Holdings at Hissar, LLC. and Sam's Holdings at Hissar, LLC." document, and documents recorded with the Dade County Clerk's Office, the Applicants request approval to vacate, close, abandon and discontinue the use of a platted utility and access way easement that abuts their lands, and as more specifically described in Attachment No. 2. B. BACKGROUND The request to close the Platted Easement is in conjunction with tentative plat application #1863-D for "Hissar Grove" (the "T-Plat"). More specifically, there are currently building restrictions on the land which prevent the Applicant from making full use of the property. The Platted Easement is currently identified as the easternmost portion of Lot 10 in the original Plat of Hissar (the "Plat"). The Plat was approved by the City Commission on July 25, 1968 via resolution No. 39895, and is included in this Staff Analysis as Attachment No. 3. In its entirety, Lot 10 is a platted easement, 30 feet wide and approximately 1,100 feet long, for use as a private access way and utilities. The Plat further notes that Lot 10 may not be used as a building site unless replatted. The closure request is for only a portion of the 10. In accordance with the recorded documents that run with this land, the Platted Easement may be vacated, closed, abandoned and discontinued by :1) replatting; and 2) a partial release of the recorded covenant, easement agreement, and supplemental covenant (the "Partial Release") which are currently in effect. On March 1, 2018, the Plat and Street Committee (the "Committee") approved with conditions T-Plat #1863-D of Hissar Grove, for the technical requirements of Chapter 55. The Committee also gave a favorable recommendation for the requested closure of the Platted Easement pursuant to Section 55- 15 of the City Code of Ordinances. The Applicant has also submitted a request for a Special Appearance before the City Commission for the Partial Release which is tentatively scheduled to be heard at the earliest City Commission Meeting. The unapproved draft of the Partial Release is provided as Attachment No. 4 of this document. C. ANALYSIS The favorable recommendation by the Plat and Street Committee for the closure was made pursuant to the four criteria listed in Section 55-15 (c). The complete list of Findings is provided as Attachment No. 1, and summarized below: Criteria 1: Plat and Street Committee Finding: Criteria 2: Is the request in the public interest, or would the general public benefit from the vacation of the rights -of -ways or Easements? "There is no impact to the general public. All lots will still have access to SW 37 Ave through the new easement created by this plat." Is the general public no longer using the right-of-way or Easement, including public service vehicles such as trash and garbage truck, police, fire or other emergency vehicles? City services, including Fire and Police, will continue to have access to the road. Solid Waste collects garbage from SW 37 Ave." As previously discussed, the final Hisser Grove Plat will include a 15-foot wide access easement and a six-foot wide utility easement. The segment of the road, known at Tract A, which connects to Lots 7 and 9 is reserved for the exclusive use of the lots on the T-Plat. Per the Department of Public Works, this condition may be addressed at the time of final Plat. Would there be no adverse effect on the ability to provide police, fire or emergency services? There is no adverse effect for emergency service vehicles. They will continue to operate the same way as the current operations. The T-Plat includes an access easement, and the conditions on Tract A may be addressed at Final Plat. Would the vacation and closure of the rights -of -way or Easements have a beneficial effect on pedestrian and vehicular circulation in the area? There is no effect on the pedestrian and vehicular circulation. The Plat and Street Committee members voted 5 (five) in favor and 0 (zero) in denial of the favorable recommendation of the easement closure request. D. CONCLUSION The Platted Easement closure will allow the property owner to build on the portion of land that may not currently be used as a building site. Per the findings by the Department of Public Works for this request, the new access easement proposed on the T-Plat will maintain access to the all lots affected by this closure. The closure is consistent with the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan ("MCNP"), as it allows the site to be improved. Per findings by the Plat and Street Committee, as well as Planning Staff, the request to close the Platted Easement satisfies the minimum requirements of Section 55-15 of the City Code. E. RECOMMENDATION Pursuant to Chapter 55, Section 55-15, of the City of Miami Code of Ordinances, the Findings Letter by the Department of Public Works, and the analysis by staff, the Planning Department recommends approval of the request to close, vacate, abandon and discontinue from public use the Platted Easement of the Hissar Grove T-Plat #1863, subject to the following conditions: 1. An approval of the vacation and closure of the subject Easement will become effective only upon the approval of the accompanying "Partial Release of Covenant, Easement Agreement and Supplemental Covenant," by the City Commission, and the execution of the same by the Hissar Property Owners Association, Inc., the Florida International University Board of Trustees, the National Tropical Botanical Garden, the Bethanhy's Holdings at Hissar, LLC, Oliver's Holdings at Hissar, LLC, Sam's Holdings at Hissar, LLC, and the City of Miami. The Applicant, owner, or their successor must meet all applicable development standards identified in Ordinance No. 13114, as amended, the Zoning Ordinance of the City of Miami, Florida as well as all other applicable local, county, state, and federal regulations. 3. A building permit, including phased permits, will not be issued on the property being platted until the final plat is recorded or as authorized by the Section 55-10(i) of the code of the City of Miami, Florida, as amended. 4. A Certificate of Occupancy, Temporary Certificate of Occupancy, Certificate of Use, or Temporary Certificate of Use shall only be issued after all the required subdivision improvements have been completed. 5. The Applicant, owner, or their successor shall comply with the conditions of approval stated for the Hissar Grove T-Plat #1863 in a letter dated March 20, 2018 issued by the Department of Public Works. 6. Provide a site plan and/or unity of title for the single family home proposed for construction on what is currently known as Lot 6 to Lot 9. 7. Approval of this closure request shall not supersede the provisions of Chapter 704 of the Florida Statutes. 8. The approval should be valid for a period of four years. This is the first of two public hearings for the closure request. Plat and Street Committee considerations are with respect to the four items below in making their recommendations to the Planning. The streets are internal to the property that is bound on the west side by railroad. The proposed unified development enabled by the closure will provide tax revenue to the City. 2. There is currently no eiustiug improvement on the site. The streets simply serve the site with Ito through access. Currently. there is no public access. City services do net use the streets. 3. New proposed project is developed in accordance with current regulations. It will provide internal and Through circulations for both residents and all city services. 4. Existing site is abandoned site. There is no pedestrian use on the site. The new development will enhance pedestrian and vehicular circulations for the area.
