Purpose of Item:
The nature of this item is to establish a resolution of the Miami City Commission, with
attachments, authorizing the procurement of ammunition from two (2) vendors, NPEE,
L.0 d/b/a National Police Ammunition ("NPEE") and Lawmen's and Shooters Supply,
Inc. ("Lawmen"), for the Department of Police ("Police"), pursuant to Section 18-111 of
the Code of the City of Miami, Florida as amended, utilizing the competitively solicited
and existing Village of Indian Creek, FL ("Indian Creek") Contract ITB No.2017.5.18AB
through May 23, 2020, subject to any amendments, extensions and/or replacement
contracts by Indian Creek; authorizing the City Manager to execute the Supplemental
Agreements in substantially the attached form, further authorizing the City Manager to
negotiate and execute all other documents, including any amendments, renewals, and
extensions, subject to allocations, appropriations and budgetary approval having been
previously made, and in compliance with applicable provisions of the Code of the City of
Miami, Florida, as amended, ("City Code"), including, the City of Miami's Procurement
Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in
Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in
compliance with applicable regulations, as may be necessary for said purpose.
Background of Item:
Police is seeking to establish an agreement for the purchase of ammunition (lead-free,
zinc and other ammunition) for its Special Weapons and Tactics Team ("SWAT") and
Training Unit. Accessing Indian Creek Contract's ITB No.2017.5.18AB will allow the City
to enter into an agreement with NPEE and Lawmen, for the purchase of these items.
This contract's initial term will expire on May 23, 2020. The contract includes two (2)
one (1) year optional renewal periods.

A RESOLUTION OF THE CITY OF MIAMI COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE PROCUREMENT OF LEAD FREE, ZINC AND OTHER
AMMUNITION FROM TWO (2) SUPPLIERS, NPEE L.C, A FLORIDA LIMITED
LIABILITY COMPANY, D/B/A NATIONAL POLICE AMMUNITION ("NPEE"), AND
LAWMEN'S AND SHOOTERS' SUPPLY, INC., A FLORIDA PROFIT CORPORATION
("LAWMEN"), FOR THE MIAMI POLICE DEPARTMENT ("POLICE"), PURSUANT TO
SECTION 18-111 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED
("CITY CODE"), UTILIZING THE COMPETITIVELY SOLICITED AND EXISTING
VILLAGE OF INDIAN CREEK, FLORIDA ("INDIAN CREEK") CONTRACT INVITATION
TO BID ("ITB") NO. 2017.5.18AB, EFFECTIVE THROUGH MAY 23, 2020, USING
FUNDS FROM POLICE GENERAL OPERATING ACCOUNTS NO.
00001.191501.667000 AND 00001.190101.667000; SUBJECT TO ANY RENEWALS,
EXTENSIONS AND/OR REPLACEMENT CONTRACTS BY INDIAN CREEK;
AUTHORIZING THE CITY MANAGER TO EXECUTE A SUPPLEMENTAL
AGREEMENT WITH EACH SUPPLIER, IN SUBSTANTIALLY THE ATTACHED FORM;
FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE
ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, AND
EXTENSIONS, SUBJECT TO PRIOR ALLOCATIONS, APPROPRIATIONS, AND
BUDGETARY APPROVALS HAVING BEEN MADE, AND IN COMPLIANCE WITH ALL
APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING, BUT NOT LIMITED
TO, THE CITY OF MIAMI'S PROCUREMENT ORDINANCE, THE ANTI -DEFICIENCY
ACT, AND THE FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN THE
CITY CODE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN
COMPLIANCE WITH ALL APPLICABLE RULES AND REGULATIONS, AS MAY BE
REQUIRED FOR SAID PURPOSE.
WHEREAS, the City of Miami ("City") Police Department ("Police") is seeking to
establish a contract for the purchase of lead free, zinc and other ammunition for use by its
Special Weapons and Tactics ("SWAT") Team and Training Unit; and
WHEREAS, the authority to use Village of Indian Creek, Florida ("Indian Creek")
Contract ITB No. 2017.5.18AB for Ammunition, effective through May 23, 2020 ("Contract") will
enable Police to enter into an agreement for this purchase with NPEE L.C, a Florida limited
liability company, d/b/a National Police Ammunition ("NPEE"), and Lawmen's and Shooters'
Supply, Inc., a Florida profit corporation ("Lawmen"); and
WHEREAS, pursuant to Section 18-111 of the Code of the City of Miami, Florida, as
amended ("City Code"), the Chief Procurement Officer determined that said Indian Creek
Contract was entered into pursuant to a competitive process in compliance with the City's laws,
policies and procedures;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The procurement of lead free, zinc and other ammunition from two (2)
suppliers, NPEE and Lawmen, for the Police, pursuant to Section 18-111 of the City Code,
utilizing the competitively solicited and existing Indian Creek Contract, using funds from Police
General Operating Accounts No. 00001.191501.667000 and 00001.190101.667000, subject to
any renewals, extensions and/or replacement contracts by Indian Creek, is approved.
Section 3. The City Manager is authorized' to execute a Supplemental Agreement with
each NPEE and Lawmen, in substantially the attached form.
Section 4. The City Manager is further authorized' to negotiate and execute all other
documents, including any amendments, renewals, and extensions, subject to prior allocations,
appropriations, and budgetary approval, having been made, and in compliance with all
applicable provisions of the City Code, including, but not limited to, the City's Procurement
Ordinance, the Anti -Deficiency Act, and the Financial Integrity Principles, all as set forth in the
City Code, in a form acceptable to the City Attorney, and in compliance with all applicable rules
and regulations, as may be required for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2
APPROVED AS TO FORM AND CORRECTNESS:
1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
