A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A PURCHASE AND SALE
AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM,
BETWEEN THE CITY OF MIAMI ("CITY") AND JOSE A. MUNOZ AND YEZMIN
C. MUNOZ ("SELLER") FOR THE ACQUISITION OF REAL PROPERTY
LOCATED AT 600 SOUTHWEST 63RD AVENUE AND 610 SOUTHWEST 63RD
AVENUE, MIAMI, FLORIDA ("PROPERTY") CONTAINING AN APPROXIMATE
TOTAL LOT AREA OF 13,500 SQUARE FEET FOR A TOTAL PURCHASE
PRICE OF SIX HUNDRED THOUSAND DOLLARS ($600,000.00); FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY
AND ALL NECESSARY DOCUMENTS, INCLUDING AMENDMENTS AND
MODIFICATIONS TO SAID AGREEMENT, IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, AS MAY BE NECESSARY TO EFFECTUATE SAID
ACQUISITION; ALLOCATING FUNDS FROM THE OFFICE OF CAPITAL
IMPROVEMENT ("OCI") PROJECT NO. 40-B40507, CITYWIDE PARK
EXPANSIONS AND LAND ACQUISITION, IN A TOTAL AMOUNT NOT TO
EXCEED SIX HUNDRED SIXTY THOUSAND DOLLARS ($660,000.00) TO
COVER THE COST OF SAID ACQUISITION INCLUSIVE OF THE COST OF
SURVEY, ENVIRONMENTAL REPORT, TITLE INSURANCE, DEMOLITION,
SECURING THE PROPERTY, PROJECT SIGNAGE, AND RELATED CLOSING
COSTS IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF THE
AGREEMENT.
WHEREAS, the City of Miami ("City") wishes to acquire two (2) adjacent parcels located
at 600 Southwest 63rd Avenue and 610 Southwest 63rd Avenue, Miami, Florida ("Properties");
and
WHEREAS, the City plans to assemble the Properties consisting of approximately
thirteen thousand five hundred (13,500) square feet with an abutting City -owned vacant land
consisting of twenty thousand seven hundred fifty-six (20,756) square feet located at 601
Southwest 63rd Court, Miami, Florida to construct a larger park consisting of approximately thirty
four thousand two hundred fifty-six (34,256) square feet to enhance the quality of life for area
residents; and
WHEREAS, Jose A. Munoz and Yezmin C. Munoz ("Seller") have agreed to enter into a
Purchase and Sale Agreement ("Agreement") with the City to convey the Properties to the City
for a total purchase price of six hundred thousand dollars ($600,000.00); and
WHEREAS, the City has obtained two (2) appraisals for the Properties from licensed
and State of Florida certified appraisers which reflect a combined appraised value of six
hundred thousand dollars ($600,000.00); and

WHEREAS, the City's estimated total cost for the acquisition of the Properties will not
exceed six hundred sixty thousand dollars ($660,000.00) to be allocated from Office of Capital
Improvement ("OCI") Project No. 40-B40507, Citywide Park Expansions and Land Acquisition;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the Agreement, in substantially
the attached form, between the City and the Seller for the acquisition of the Properties
containing an approximate total lot area of thirteen thousand five hundred (13,500) square feet
for a total purchase price of six hundred thousand dollars ($600,000.00).
Section 3. The City Manager is further authorized1 to negotiate and execute any and all
necessary documents, including amendments and modifications to said Agreement, in a form
acceptable to the City Attorney, as may be necessary to effectuate said acquisition.
Section 4. Funding for the acquisition is to be allocated from OCI Project No. 40-
B40507, Citywide Park Expansions and Land Acquisition, in a total amount not to exceed six
hundred sixty thousand dollars ($660,000.00) to cover the cost of said acquisition inclusive of
the cost of survey, environmental report, title insurance, demolition, securing the Properties,
project signage, and related closing costs in accordance with the terms and conditions of the
Agreement.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
