("Kiewit"), the sole responsive and responsible Bidder, pursuant to Invitation to Bid ("ITB") No. 17-18-008 for the Miami Woman's Club Baywalk Project — D2 — Project No. B-30731, in the amount of $638,864.00 plus a ten percent (10%) contingency for a total amount not -to -exceed $702,750.40, allocating funds from Capital Improvement Project No. B-30731. Background of Item: On March 7, 2018, the Department of Procurement ("Procurement") issued ITB No. 17- 18-008 — Miami Woman's Club Baywalk Project — D2 — Project No. B-30731 (the "Project") under full and open competition to obtain construction services. On April 10, 2018, the ITB closing date, one (1) bid was received in response to the ITB. Kiewit is the sole responsive and responsible Bidder for the Project following the guidelines in the ITB. On May 10, 2018, Procurement, OCI, and Kiewit had negotiations regarding Kiewit's original submitted bid. After successful negotiations, Kiewit submitted a revised bid of $638,864.00. Procurement and OCI determined that Kiewit's bid was acceptable. Procurement hereby recommends award of the contract to Kiewit, whose total bid amount is $638,864.00, plus a ten percent (10%) owner contingency for a total Contract amount not -to -exceed $702,750.40. WHEREAS, on March 7, 2018, the City of Miami's ("City") Department of Procurement ("Procurement") issued Invitation to Bid ("ITB") No. 17-18-008 for construction services for the Miami Woman's Club Baywalk Project — D2 — Project No. B-30731 ("Project"); and WHEREAS, on April 10, 2018, the Office of the City Clerk received one (1) bid from Kiewit Infrastructure South Co., a Delaware profit corporation registered with Florida ("Kiewit"); and WHEREAS, Procurement has determined Kiewit to be the sole responsive and responsible Bidder; and WHEREAS, the City Manager requests authorization to execute an Agreement with Kiewit in the amount of Six Hundred Thirty Eight Thousand Eight Hundred Sixty Four Dollars ($638,864.00), plus a ten percent (10%) Owner's Contingency Allowance in the amount of Sixty Three Thousand Eight Hundred Eighty Six Dollars and Forty Cents ($63,886.40), for a total not- to -exceed award amount of Seven Hundred Two Thousand Seven Hundred Fifty Dollars and Forty Cents ($702,750.40); and WHEREAS, funds in the total not -to -exceed award amount of $702,750.40 are to be allocated from the Office of Capital Improvements ("OCI") Project No. B-30731; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The bid received April 10, 2018, pursuant to ITB No. 17-18-008, from Kiewit, the sole responsive and responsible Bidder, for the provision of construction services for the Project in the amount of $638,864.00 for the scope of work, plus the 10% Owner's Contingency Allowance of $63,886.40, for a total not to exceed award amount of $702,750.40, allocating funds from OCI Project No. B-30731, is accepted. Section 3. The City Manager is authorized' to execute the negotiated Agreement with Kiewit, in substantially the attached form, consisting of the ITB documents and attachments. Section 4. The City Manager is further authorized to negotiate and execute all other documents, including any amendments, renewals, and extensions, subject to allocations, appropriations and budgetary approval having been previously made, and in compliance with applicable provisions of the City Code including, the City's Procurement Ordinance, Anti - Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations, as may be necessary for said purpose. Section 5. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
