Dear Mr. Garcia,
The undersigned represents the owners of the properties located at 2109 SW 8 St., 2124
SW 7 St, 2126 SW 7 St., 2130 SW 7 Street, Miami in connection with the land use change
from Medium Density MF Residential to Restricted Commercial and a Zoning Change from
T4-L to T5-O, but a preference to rezone to T6-8 0, a more compatible transect.
This request meets the criteria for Amendments to the Miami 21 Zoning maps.
Specifically, "no rezoning of land shall be considered which involves less than forty thousand
(40,000) square feet of land area or two hundred (200) feet of street Frontage on one (1) street."
Enclosed in support of the request is a boundary survey of the properties, which
collectively total 45,795 square feet, of which +32,240 sq. ft. are requested for land use and
zoning change and include 234 linear feet of frontage along S.W. 7 Street. The Owners formally
requests a change from T4-L to T5-0, consistent with the successional zoning requirements of
Section 7.1.2.8 of the Code and a land use plan amendment from Medium Density MF
Residential to Restricted Commercial. While Medium Density Restricted Commercial
designation may seem like the companion designation for the T5-O zoning, a close examination
of this block of S.W. 8 and S.W 7th Street support a Restricted Commercial designation.
Restricted Commercial designation is the logical and consistent designation, providing continuity
to the east and west of the corridor. In light with this,it is the Applicant's hope that in the course
of reviewing the request, the surrounding properties and the trend of development of the area, the
Planning Department will recommend that the application properties be rezoned to T6-8 0, the

Analysis of Future Land Use Map Amendment
FROM: Medium Density MF Residential
TO: Restricted Commercial
The application by 8th and 22 Corporation and 2126 Corp requests an amendment to the Future
Land Use Map ("FLUM") designation of properties located on the south side of SW 7th Street,
west of SW SW 21st Avenue, comprising approximately 32,240 square feet from Medium Density
MF Residential to Restricted Commercial. The properties are located at 2109 SW 8th Street (rear),
2124, 2126, and 2130 SW 7th Street. The request is appropriate and consistent with the Goals,
Objective and Policies of the Miami Comprehensive Neighborhood Plan. Set forth below is our
analysis of the Goals, Objectives and Policies that support the Applicant's FLUM Amendment.
COMPATIBILITY
The requested FLUM designation is consistent with the Neighborhood Comprehensive Plan and
compatible and supportive of the Goals and policies of the plan. One of the lots that comprise the
application property is currently the parking area for a one story commercial building on SW 8th
Street that is designated Restricted Commercial and zoned T6-8 O. All the properties on the south
side of SW 7th Street, east of SW 17 Avenue are presently designated Restricted Commercial;
several parcels west of SW 22 Avenue and located mid -block, are designated Restricted
Commercial. Please refer to the maps and graphs accompanying this analysis.
LAND USE GOALS
Goal LU-1: Maintain a land use pattern that (1) protects and enhances the quality of life in the
City's neighborhoods; (2) fosters redevelopment and revitalization of blighted or declining areas;
(3) promotes and facilitates economic development and the growth ofjob opportunities in the city;
(4) fosters the growth and development of downtown as a regional center of domestic and
international commerce, culture and entertainment; (5) promotes the efficient use of land and
minimizes land use conflicts while protecting and preserving residential sections within
neighborhoods; (6) protects and conserves the city's significant natural and coastal resources;
and (7) protects the integrity and quality of the City's existing neighborhoods by insuring public
notice, input and appellant rights regarding changes in existing zoning and land use regulations.
The existing land use patterns along the SW 7th Street corridor west of SW 27 Avenue are simply
a reflection of the existing land uses, most of which pre -date the adoption of Miami 21. This is
poor, haphazard planning that does not promote efficient uses of land along a major arterial road,
with existing public transportation and which, along its south side, does not serve to buffer any
residential areas. The requested land use change to Restricted Commercial is consistent with long
term planning for this corridor as well as consistent with other random parcels of land along the
south side of SW 7th Street to the east and to the west, that are designated Restricted Commercial.
Objective LU-1.1: Ensure that land and development regulations are consistent with
fostering a high quality of life in all areas, including the timely provision ofpublic facilities
that meet or exceed the minimum level of service (LOS) standards adopted in the Capital
Improvements Element (CIE) of the Miami Comprehensive Neighborhood Plan.
Policy L U-1.1.3: The City's zoning ordinance provides for protection of all areas
of the city from: (1) the encroachment of incompatible land uses; (2) the adverse
impacts offuture land uses in adjacent areas that disrupt or degrade public health
and safety, or natural or man-made amenities; (3) transportation policies that
divide or fragment established neighborhoods; and (4) degradation of public open
space, environment, and ecology. Strategies to further protect existing
neighborhoods through the development of appropriate transition standards and
buffering requirements will be incorporated into the City's land development
regulations.
The proposed Restricted Commercial Future Land Use designation promotes
Policy LU-1.1.3 by allowing commercial and higher density residential
development abutting SW 8th Street, which is designated Restricted Commercial.
The south side of SW 7th Street, west of SW 27 Avenue (State Road 41) is
compatible and appropriate for Restricted Commercial designation and companion
zoning designation because it does not create an encroachment on established
residential areas. In fact, small, random properties along this corridor are
designated Restricted Commercial in a haphazard fashion, It is appropriate to re-
designate this entire corridor to Restricted Commercial and to promote and
encourage the redevelopment of the SW 7th Street corridor with a mix of higher
residential density and commercial uses in this area. As reiterated throughout this
analysis, SW 8th Street and SW 7 Street are one of the areas in the City of Miami
that have historically been pedestrian oriented, in large measure because the
demographics of the area include a population that walks and that rides public
transportation. Inclusion of more commercial services along this area is not only
appropriate but much needed.
Policy L U-1.3.15: The City will continue to encourage a development pattern that
enhances existing neighborhoods by developing a balanced mix of uses including
areas for employment, shopping, housing, and recreation in close proximity to each
other.
The proposed Future Land Use Designation of Restricted Commercial will promote
and encourage the development of shopping, employment, recreation and housing

opportunities for the area within walking distance of the population it will serve
and with no impact on neighboring residential areas. See also, discussion of Policy
LU-1.3, above.
Goal LU-3: Encourage urban redevelopment in identified Urban Infill Areas and Urban
Redevelopment Areas.
Objective L U-3-1: Promptly review and act on petitions for land use plan amendments and
rezoning of property in Urban Infill Areas or Urban Redevelopment Areas to facilitate
redevelopment.
Policy LU-3.1.1: Continue review of existing zoning regulations to determine if
they provide adequate flexibility to promote redevelopment with a mix of uses in
Urban Infill Areas or Urban Redevelopment Areas and, if not, revise said existing
zoning regulations or adopt new zoning regulations to promote redevelopment.
The Future Land Use Map amendment to Restricted Commercial is consistent with
and promotes urban infill. The Property is uniquely located on a major multi -modal
transportation area that is serviced by public transportation, and existing transit
corridor (State Road 41), connectivity to Metro Rail and an established pedestrian
area. The Property's designation to Restricted Commercial is appropriate because
locating higher density commercial and residential areas along major traffic
corridor will provide commercial services to the area residents within walking
distance and within existing public transportation to an existing population that is
presently dependent on public transportation and facilities within walking distance.
TRANSPORTATION GOALS
Goal TR-1: Maintain an effective and cost efficient traffic circulation network within the City of
Miami that provides transportation for all persons and facilitates commercial activity, and which
is consistent with, and furthers, neighborhood plans, supports economic development, conserves
energy, and protects and enhances the natural environment.
Policy TR-1.1.1: The City hereby adopts designation of the City, excluding Virginia
Key, Watson Island and the uninhabited islands of Biscayne Bay that have a land
use and zoning classification of Conservation, as an Urban Infill Area pursuant to
Miami -Dade County's designation of an Urban Infill Area lying generally east of
the Palmetto Expressway and including all of the City of Miami. Within this area,
the concentration and intensification of development around centers of activity
shall be emphasized with the goals of enhancing the livability of residential
neighborhoods and the viability of commercial areas. Priority will be given to infill
development on vacant parcels, adaptive reuse of underutilized land and structures,
the redevelopment of substandard sites, downtown revitalization and the
development of projects that promote public transportation. Maintenance of
transportation levels of service within this designated Urban Infill Transportation
Concurrency Exception Area shall be in accordance with the adopted

Transportation Corridors level of service standards and the City of Miami Person -
Trip Methodology as set forth in Policies TR-1.1.2 and TR-1.1.3 of the
Transportation Element of the MCNP. (See Land Use Policy LU-1.1.11.) Policy.
The Application Property is centrally located along a major commercial corridor
within the Urban Infill Area. The Proposed Land Use Change to Restricted
Commercial is consistent with Transportation Policy TR-1.1.1 because the Property
is a viable commercial area whose redevelopment to a more intense use should be
supported. The site is undesirable for low scale residential or commercial
redevelopment, but is desirable for general commercial uses because of its location
along a transportation corridor that is served by mass transit and that does not serve
to buffer a residential area.
TR-1.1.2: The City of Miami originated and continues to utilize a person -trip
methodology for measurement of local level of service (LOS) on a transportation
facility, which may be a roadway, mass transit service, pedestrian way, bikeway,
or any other transportation mode alone or in combination with others... .
The Application property is located along the SW 8th St./SW 7th Street corridor,
State Road 41, an east/west corridor served by public transportation. It is also a
historically intense pedestrian corridor. In fact, many of the businesses along S.W.
8th Street have little or no on -street parking since there is an established walkability
culture. The location of additional commercial uses along SW 7th Street is
consistent with the MCNP's transportation goals and policies. This site is within
less than 300 feet of Miami Dade Transit bus stations that connect east, west, north
and south and connect directly to the Vizcaya MetroRail Station in less than 30
minutes.

During our Pre -application meeting on June 8, 2016, the following requests were presented:
A Land Use change from "Medium Density Multifamily Residential" to "Medium Density Restricted
Commercial'; and
A Rezoning per Article 7, Section 7.1.2.8 (a) (3), to allow the successional rezoning of land. The
proposal is to change the zone the subject lots from to T4-L to T5-O.
Based on the request, staff has prepared the following comments. Please note, said comments are not
to be construed as a recommendation of approval or support of the proposal.
Staff's comments are as follows:
1. The deadline to submit a complete Rezoning and Land Use Change application is July 16, 2016.
Contact Ms. Lakisha Gray, Hearing Boards Coordinator via e-mail at: LGray@Miamigov.com or
by phone at 305-416-2036 for an appointment to submit the application.
a. Any restrictive covenant associated with the request, shall be submitted with the
application package.
2. Is there a proposed schedule of outreach meetings with the community? Have you contacted
the NET office with information regarding the requests?
3. Consider providing a massing study to show how the proposed zoning may affect the
neighborhood context.
4. Orient the boundary survey and location map in the same direction.

5. On the survey, clearly indicate the square footage and acreage to be changed. Identify those
Tots by hatching or shading.
6. School concurrency is required; please contact the Hearing Boards Department at 305-416-2030
with any question concerning the concurrency process.
7. A Unity of Title in recordable form is required for the proposed rezoning of the subject lots.
8. Provide a flash drive with all application materials.
9. A Traffic Study may be required upon further review of the submitted documents.
Be Advised: The Planning and Zoning Department reserves the right to make recommendations
pertaining to which Transect Zone will yield the most coherent zoning pattern in the context of the
immediate vicinity. Consequently, the City of Miami reserves the right to comment on the proposal as
more information is provided and may revise previous comments based on this supplementary
information.
The Department reviews proposals based on Miami 21 and the City Code. Furthermore, the proposed
Rezone and Land Use Change is subject to review and compliance with the requirements of all City
departments, as applicable.
