City Clerk Re: FILE ID 1124 and 1125 - Voluntary Withdrawal, Request from abut property owner Dear Ms. Zamora: In regards to the above -referenced -Voluntary Withdrawal letter- from the Law Firm representing the applicant, the following are my comments: 1. The applicant has failed for almost the last two years, to meet with the neighbors as required per Miami 21. The neighbors have requested in several occasions to meet with the applicant in an effort to find common ground. Not only the applicant ignored the neighbor's request, but further more, communications were sent via email, instructing one of our neighbors to stop any communications with the applicant. 2. The applicant has included several statements in his withdrawal letter, that the neighbors at this time are not entertaining to validate if these statements as a true reflection of the facts. 3. The neighbors have expressed a positive constructive intent to accommodate the applicant plans for development, having the applicant abandoned any intent for further negotiations. 4. The neighbors have demonstrated consistently over the years a strong opposition to: a. commercial intrusion into a stable residential community, b. an overdevelop project without appropriate traffic analysis impacting already congested traffic conditions, c. usage of private alleys dedicated to the exclusive use of the abut property owners, as two-way public roads included on his proposed building plans, d. up -zoning request without a valid justification of existing zoning to be inappropriate, e. endless deferral requests that have extended these files for about a decade. Considering the above -listed statements, we want to express our STRONG opposition to have the Commission, wave the existing applicable prohibition period on the refilling of future applications associated to 3801 Biscayne Boulevard and adjacent property over 38th Street. We respectfully request that the Commission enforces the applicable mandatory prohibition period for refilling future applications.
