A. GENERAL INFORMATION:
APPLICANT: Peter Piper, Inc., an Arizona corporation.
REQUEST: The Applicant is requesting an Exception to allow for 25 amusement or games
or machines where four are allowed by right, for a total of 29 amusement games machines
within an existing family dining and entertainment space that will be known as Peter Piper
Pizza,
Per City of Miami Code of Ordinances, Section 12-12 (a) through (c), amusement games
or machines uses are allowed only by Exception requiring approval by the City Commission
by a fourth -fifths vote.
B. BACKGROUND:
The subject property is located within T6-8-O (Urban Core Open) Transect Zone, at
approximately 3749 NW 7 Street, Miami, Florida. The complete legal description is on file
with the Hearing Boards Section.
The subject site is located within a strip mall with other commercial uses. Additionally, this
portion of NW 7 Street is a major thoroughfare within the City.
The applicant will provide a total of 29 devices; however, not all of these devices would be
games. Some of them also would include counting prize tickets, bill changer to game tokens,
and kiddie ride. The proposed configuration would be similar to "Chuck E. Cheese"
restaurants.
The proposal provides for the following:
1 kiddie ride
19 skills
5 video games
2 bills changers
2 ticket counters
29 cabinet's total

C. MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN (MCNP):
The subject property is designated Restricted Commercial under the MCNP. The proposed
use supports the Restricted Commercial Land use designation as it is an activity that has
easy access to the public and is located along an arterial roadway.

The following is a review of the request pursuant to an Exception criteria of City of Miami
Code of Ordinance Section 12-12 (a) through (c). The `Background' section of this report
are hereby incorporated into the analysis and its corresponding criteria by reference.
The Applicant is requesting an Exception to allow for 25 amusement games or machines
where 4 are allowed by right, for a total of 29 amusement game machines within an existing
family dining and entertainment space that will be known as Peter Piper Pizza.
The purpose is to operate amusement games or machines within an existing family dining
and entertainment space that will be known as Peter Piper Pizza; providing for
entertainment similar to other similar franchises widely known in South Florida.
As part of the operation of the restaurant the proposed amusement or machines games will
be part of a restaurant use which may provide 20 to 30 new jobs within District 1. Finally,

as part of the operation all of the games will be located inside the restaurant, no games will
be located outside of the building. None of the game play credits/tokens or tickets will be
exchanged for money.
F. CONCLUSION:
The Planning Department recommends approval with conditions of the Applicant's
request to operate an amusement games and game machines use within T6-8-O Transect
Zone. The use will benefit the area by providing a service to the community for family fun
and by creating additional jobs along a major thoroughfare.
Staff finds the Exception request is consistent with the goals of the Miami 21 Code, and is
compatible with the surrounding neighborhood.
G. RECOMMENDATION:
Staff recommends approval of the request Exception to allow more than (4) four amusement
games or machines. In this case the Applicant will have approximately 29 types of
amusement games or machines (arcade machines) inside a family themed restaurant with
the following conditions:
1. The development shall be substantially in accordance with the plans entitled
Dimensioned Floor Plan "Peter Piper", prepared by Craig I. Cahen, Register Architect
(Sheet A1.0 on February 8, 2018).
2. If the Applicant, owner, or successor wishes to provide outdoor dining they shall apply
and secure through Warrant a permit for outdoor seating pursuant to Article 6, Section
6.3.2.1
3. At the time of license renewal, the Applicant, owner, or successor of the business, shall
provide the Office of Zoning a report containing the number and type of games or
machines installed pursuant to this Exception approval.
4. The Applicant, owner, or successor shall comply with the requirements of all applicable
departments/agencies as part of the City of Miami building permit submittal process.
5. Failure to comply with these conditions of approval may trigger the revocation of this
Exception approval.
