WHEREAS, Northwest 7th Place, Miami, Florida, between Northwest 32nd Street and Northwest 34th Street ("Northwest 7th Place) runs between Mater Academy of International Studies ("Mater Academy") and the Corpus Christi Catholic Church ("Corpus Christi"); and WHEREAS, a portion of Northwest 7th Place abuts Mater Academy and the Corpus Christi sports field; and WHEREAS, Corpus Christi requested that vehicular access to the portion of Northwest 7th Place abutting Mater Academy and the Corpus Christi sports field be prohibited to ensure the safety of the children during the following days and times: 1. Monday through Friday from 7:00 a.m. to 6:00 p.m.; and 2. Saturday from 7:00 a.m. to 2:00 p.m.; and WHEREAS, it furthers the health, safety, welfare, and quality of life of the residents of the City of Miami ("City") to allow children and families to safely access and play at Mater Academy and Corpus Christi's sports field; and WHEREAS, the City Commission believes that it is in the best interest of the public to prohibit vehicular access to the portion of Northwest 7th Place, abutting Mater Academy and Corpus Christi's sports field during the days and times specified herein; and WHEREAS, Section 54-16 of the Code of the City of Miami, Florida ("City Code"), provides a procedure for the prohibition of vehicular access to a public street; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission directs the City Manager to initiate the process under Section 54-16 of the City Code to prohibit vehicular access to the portion of Northwest 7th Place, abutting Mater Academy and the Corpus Christi sports field Monday through Friday from 7:00 a.m. to 6:00 p.m. and Saturdays from 7:00 a.m. to 2:00 p.m., subject to final approval by Miami -Dade County ("County"). Section 3. Upon initiating the process pursuant to Section 54-16 of the City Code, the City's Police, Fire -Rescue, and Solid Waste Departments shall review the proposed prohibited vehicular access and provide recommendations to the City Commission at a properly advertised public hearing to be scheduled for a later date and time. Section 4. The prohibition of vehicular access shall be subject to any requirements or conditions that may be imposed by the City's Public Works, Police, Fire -Rescue, and Solid Waste Departments. Section 5. The City Manager is further directed to designate the portion of Northwest 7th Place, abutting Mater Academy and the Corpus Christi sports field Monday through Friday from 7:00 a.m. to 6:00 p.m. and Saturdays from 7:00 a.m. to 2:00 p.m. a Play Street pursuant to Section 35-5 of the City Code until such time as the process pursuant to Section 54-16 of the City Code is completed and receives final approval from the County. Section 6. The City Clerk is directed to transmit a copy of this Resolution to the City Manager, and to the City's Public Works, Police, Fire -Rescue, and Solid Waste Departments. Section 7. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'
