Updated 11-22-2017 Spring Garden Point Park Project Overview: This is a construction project to replace the entire failing seawall along the Seybold Canal, and construct a kayak launch allowing non -motorized vessels only access to the Miami River. The seawall is in danger of falling into the Seybold Canal, with a new seawall to be built in its place. The kayak launch will be 60' long and 8' wide. Thirty feet from the Miami River shoreline to the upland will be under water at high tide. The dry upland 30' feet will protect the park from water intrusion since it will be higher than the riprap shoreline along the Miami River at its end point. Brief History and Recommendations: The current park site was scheduled to become 64 condominiums. The Trust for Public Land purchased the property from the developer to keep the site open space and a wanted it to be a future park. With the help of the State of Florida, The Trust for Public Land, and Miami Dade County entered into an agreement to transfer the land to the City of Miami as a public park in 1999. The City of Miami recommends if this is approved by the HEP Board to add two additional restrictions. 1. No commercial activities of any kind will be allowed in the park, seawall, or riprap areas. 2. In the event that the completed work deviates, in any manner, from the authorized work, the Permittee shall describe, on the Self - Certification Form, the deviations between the work authorized by the permit and the work as constructed. Please note that the description of any deviations on the Self - Certification Form does not constitute approval of any deviations by the Corps. 3. Assurance of Navigation and Maintenance: The Permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structures or work herein authorized, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the Permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to -3- the United States. No claim shall be made against the United States on account of any such removal or alteration. 4. Sea turtle and smalltooth sawfish conditions: The Permittee shall comply with National Marine Fisheries Service's "Sea Turtle and Smalltooth Sawfish Construction Conditions," dated March 23, 2006, attached to this permit. 5. Manatee Conditions: The Permittee shall abide by the enclosed standard construction conditions designed to protect the endangered West Indian manatee, 2011, attached to this permit. 6. Turbidity Barriers: a. Shall be used throughout construction to control erosion and siltation and ensure that turbidity levels within the project area do not exceed background conditions. b. Shall be made of material in which listed species cannot become entangled (i.e., reinforced impermeable polycarbonate vinyl fabric [PVC]), and shall be monitored to ensure listed species are not entangled or trapped in the project area. c. Shall be removed promptly when the work is complete and the water quality in the project area has returned to background conditions. d. Shall not block entry to or exit from designated critical habitat. 7. Posting of Permit: The Permittee shall have available and maintain for review a copy of this permit and approved plans at the construction site. 8. Agency Changes/Approvals: Should any other agency require and/or approve changes to the work authorized or obligated by this permit, the Permittee is advised a re -verification to this permit instrument is required prior to initiation of those changes. It is the Permittee's responsibility to request a re -verification of this permit from the Miami Permits Section. The Corps reserves the right to fully evaluate, amend, and approve or deny the request for re -verification of this permit. 9. Historic Properties: a. No structure or work shall adversely affect impact or disturb properties listed in the National Register of Historic Places (NRHP) or those eligible for inclusion in the NRHP. b. If during the ground disturbing activities and construction work within the permit area, there are archaeological/cultural materials encountered which were not the subject of a previous cultural resources assessment survey (and which shall include, but not be limited to: pottery,,modified shell, flora, fauna, human remains, ceramics, stone tools or metal implements, dugout canoes, evidence of structures or any other physical remains that could be associated with Native American cultures or early -4- colonial or American settlement), the Permittee shall immediately stop all work and ground -disturbing activities within a 100-meter diameter of the discovery and notify the Corps within the same business day (8 hours). The Corps shall then notify the Florida State Historic Preservation Officer (SHPO) and the appropriate Tribal Historic Preservation Officer(s) (THPO(s)) to assess the significance of the discovery and devise appropriate actions. c. Additional cultural resources assessments may be required of the permit area in the case of unanticipated discoveries as referenced in accordance with the above Special Condition; and if deemed necessary by the SHPO, THPO(s), or Corps, in accordance with 36 CFR 800 or 33 CFR 325, Appendix C (5). Based, on the circumstances of the discovery, equity to all parties, and considerations of the public interest, the Corps may modify, suspend or revoke the permit in accordance with 33 CFR Part 325.7. Such activity shall not resume on non-federal lands without written authorization from the SHPO for finds under his or her jurisdiction, and from the Corps. d. In the unlikely event that unmarked human remains are identified on non-federal lands, they will be treated in accordance with Section 872.05 Florida Statutes. All work and ground disturbing activities within a 100-meter diameter of the unmarked human remains shall immediately cease and the Permittee shall immediately notify the medical examiner, Corps, and State Archeologist within the same business day (8-hours). The Corps shall then notify the appropriate SHPO and THPO(s). Based, on the circumstances of the discovery, equity to all parties, and considerations of the public interest, the Corps may modify, suspend or revoke the permit in accordance with 33 CFR Part 325.7. Such activity shall not resume without written authorization from the State Archeologist and from the Corps. 10. The project must be completed in accordance with the enclosed construction drawings (pages 1-8), date -stamped June 15, 2017 by the U.S. Army Corps of Engineers (Corps), and the general and special conditions which are incorporated in, and made a part of, the permit. 11. Endangered Species: The permittee agrees to comply with all of the activity specific Project Design Criteria (PDCs) listed in the National Marine Fisheries Service's (NMFS) Statewide Programmatic Biological Opinion (SWPBO), dated December 4, 2015. Failure to comply with these conditions could result in enforcement action by the Corps and/or NMFS. 12. Right Whale Protection: It is illegal to approach within 500 yards of a right whale by vessel, aircraft, or any other means (50 CFR 224.103 (c). Any vessel finding itself within 500 yards of a right whale must depart immediately at a slow speed. -5- 13. Species reporting: Any collision(s) with and/or injuries to any sea turtle, sawfish, whale, or sturgeon occurring during the construction of a project, shall be reported immediately to NMFS's Protected Resources Division (PRD) at (727-824- 5312) or by email to takereport.nmfsser@noaa.gov and CESAJ- ComplyDocs@usace.army.mil. Sea turtle and marine mammal stranding/rescue organizations' contact information is available by region at http://www.nmfs.noaa.gov/pr/health/networks.htm. Smalltooth sawfish encounters shall be reported to http://www.flmnh.ufl.edu/fish/sharks/sawfish/sawfishencounters.html. *Failure to report take of a federally listed threatened or endangered species may lead to suspension, revocation, or modification of this authorization. (From Section 3(18) of the Federal Endangered Species Act: The term 'take' means to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect, or to attempt to engage in any such conduct.) 14. Marine Life Entrapment: Neither structure nor material or the method of construction shall pose more than minimal risk of entrapping fish, marine turtles, or marine mammals. In -water lines must be industrial grade metal or heavy cables that do not readily loop and tangle. All in -water lines (rope and cable) must be rigid and cannot have excess line in the water. Lines may be enclosed in a plastic or rubber sleeve/tube to add rigidity. 15. Noise Effects BMPs: All projects shall comply with the requirements of the attached "Noise Best Management Practices (BMPs) for Piling Installation" (see attachment) 16. Educational Signage: The permittee shall install Educational signs in a visible location on the structure(s) to alert the public of listed species in the area susceptible to vessel strikes or hook -and -line captures. The most current version of the signs are available at (http://sero.nmfs.noaa.gov/protected_resources/section_7/protected species_education al_signs/index.html). 17. Monofilament recycling bins: Monofilament recycling bins must be installed and maintained in accordance with the information provided http://mrrp.myfwc.com. 18. Manatee Signage: Within 30 days of completion of the dock installation, the permittee is required to install signs on the floating structures that will be clearly visible from the waterway that read "motorized vessel docking prohibited" and "manatee awareness signs". Signs should be constructed with reflective materials so that they are also clearly visible at night. Letters must be a minimum of 3 inches in height. The permittee agrees to replace the signs in the event the signs fade, become damaged or outdated, and maintain .these signs for the life of the facility. The Trust for Public Land is a national not -for -profit conservation organization with a mission of conserving land for people to enjoy as parks, gardens, and other natural places, ensuring livable communities for generations to come. The Trust for Public Land was instrumental inthe planning for the Miami River Gneeow/ay a comprehensive effort to improve public access to the river, serve as an attractive destination for residents and visitors, help sustain the maritime industry, and improve the river's water quality by stabilizing the shoreline. Stierheim River County Manager STAFF RECOMMENDATION The attached Option Agreement for Sale and Purchase of a 1.1 acre parcel of land, known as the Spring Garden Point Park (The Point), has been prepared by the Florida Communities Trust, a non regulatory agency of the Department of Community Affairs (FCT). The Option Agreements for Sale and Purchase are standard documents which are required by the State when States funds are used to acquire property . MANAGER'S BACKGROUND TAX FOLIO NUMBER: 01-3135-027-1330 SELLER: The Trust For Public Land (TPL) SIZE: Approximately 1.1 acres LOCATION: 601 Northwest 7th Road, at the confluence of the Miami River and Seybold Canal PURCHASE PRICE: $550,000.00 (95% of the appraised value) JUSTIFICATION: The Spring Garden Point Park (The Point) is a 1.1 acre property located where the Seybold Canal meets the Miami River in the historic Spring Garden neighborhood. Once the site of Alligator Joe's Farm and Tropical Gardens, a Henry Flagler attraction, this park will provide valuable recreational opportunities to some of the most open space deficient areas of Miami - Dade County, including East Little Havana, Overtown and Spring Garden. The site has strong potential for hammock restoration, greenway connection and canoe/boat launching, and was identified by the Miami River Study Commission in its January 1998 State Legislative Report as an important acquisition for the restoration of the river. The Point meets all of the definitions of a neighborhood park as outlined in the Comprehensive Development Master Plan, and will be a City of Miami park. The acquisition will be funded from a combination of grants from the Florida Communities Trust and The Safe Neighborhood Parks Bond Challenge Grant Program. The park will be owned by the City of Miami, and operated by the Spring Garden Homeowners Association (SGHOA). Because of the financial difficulties experienced by the City at the time this project was initiated, the County stepped in to facilitate project funding and contract negotiations for acquisition. No County funding other than the Challenge Grant will be utilized for this project. Since the property will be a local park in the City of Miami, it is not eligible for county -wide or unincorporated area general fund revenues. The land is part of an estate for which settlement is pending until the sale of this property. The site had been slated for development as a 64-unit condominium complex. The Trust for Public Land (TPL), a national not -for -profit land conservation organization, recognized the need and urgency to preserve this important undeveloped site, and entered into a purchase option agreement with the estate of the property. This option will expire in July, 1999. City of Miami Resolution #98-389 authorized its City Manager to jointly apply with the County for state funding and to execute all necessary agreements for the purchase of this property. Upon the closing with TPL, title to the property will be conveyed to the City of Miami. The City is in the process of preparing an interagency agreement with the 30-year old Spring Garden Homeowners Association for the operation and maintenance of the park. The SGHOA has maintained this property while it was privately owned for the last ten years. Neither the City nor the County will incur any impacts to the operating budget. The SGHOA will also be responsible for the state mandated management plan for the ongoing natural resource restoration and management of the site MIAMI RIVER COMMISSION On April 27, 1999, by Resolution No. R-448-99, the Board instructed staff to request input from the Miami River Commission regarding all resolutions or ordinances that impact the Miami River. Attached is a letter from the Miami River Commission supporting the acquisition of "The Point" for use as a riverfront park. PRIOR BOARD ACTION: As directed by Resolution R-344-98, which was sponsored by Commissioner Barbara Carey- Shuler on March 31, 1998, the Miami -Dade County Park and Recreation Department prepared a joint Florida Communities Trust (FCT) agreement with the City of Miami for the acquisition of Spring Garden Point property. In May, 1998, the Citizens Oversight Committee for the Safe Neighborhood Parks Bond Program approved a Challenge Grant as a 50% match to the FCT funds. On December 1, 1998, the Board of County Commissioners approved Resolution R-1313-98 authorizing the County Manager to receive and expend a grant in an amount not to exceed $300,000 from the Florida Communities Trust (FCT) for the purchase of The Spring Garden Point Park on the Miami River.
