Subject: Joint Participation Agreement - Federal Highway Roadway Improvement Project
Purpose of Item:
To authorize the City Manager to execute a Joint Participation Agreement ("JPA")
between the City of Miami ("City") and Miami -Dade County ("County") for the NE 42
Street from NE 4th Avenue to Federal Highway Roadway Improvement, Project 40-
B173901 ("Project"). The JPA provides that the County will contribute an amount not -
to -exceed $1,401,000 to the City for the construction of the Project.
Background of Item:
The improvements are a result of the coordination efforts between the Florida
Department of Transportation, County and the City with regards to the arrival of the
Brightline passenger train in the City and County in 2018. Therefore, the City and
County wish to facilitate the construction of a roadway improvement project located
within the municipal limits of the City. The scope of the Project consists of building a
new roadway across the existing railroad crossing to allow for vehicular traffic. Other
roadway enhancements will include traffic signals, street lighting, sidewalks, ADA
ramps, curb and gutter, drainage improvements, and modification to the existing on -
street parking. The County wishes to utilize the resources of the City to construct the
Project. The City will be responsible for the construction, management and
administration of the Project.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A JOINT PARTICIPATION
AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH MIAMI-
DADE COUNTY ("COUNTY") FOR ROADWAY IMPROVEMENTS ALONG
NORTHEAST 42ND STREET BETWEEN NORTHEAST 4TH AVENUE AND FEDERAL
HIGHWAY, OFFICE OF CAPITAL IMPROVEMENTS PROJECT NO. 40-B173901;
PROVIDING FOR THE ACCEPTANCE OF FUNDS IN THE AMOUNT OF ONE
MILLION FOUR HUNDRED ONE THOUSAND DOLLARS ($1,401,000.00) FROM THE
COUNTY FOR THE CONSTRUCTION OF A NEW ROADWAY ACROSS THE
EXISTING RAILROAD CROSSING TO ALLOW FOR VEHICULAR TRAFFIC AND
OTHER ROADWAY ENHANCEMENTS, INCLUDING TRAFFIC SIGNALS, STREET
LIGHTING, SIDEWALKS, RAMPS, CURB AND GUTTER, DRAINAGE
IMPROVEMENTS, AND MODIFICATION TO THE EXISTING ON -STREET PARKING,
WITH FUNDS TO BE APPROPRIATED BY SEPARATE RESOLUTION.
WHEREAS, the City of Miami ("City") and Miami -Dade County ("County") wish to
facilitate the construction of a roadway improvement project along Northeast 42nd Street
between Northeast 4th Avenue and Federal Highway, Miami, Florida, Office of Capital
Improvements ("OCI") Project No. 40-B173901 ("Project"); and
WHEREAS, the scope of the Project consists of building a new roadway across the
existing railroad crossing to allow for vehicular traffic along with other roadway enhancements
such as traffic signals, street lighting, sidewalks, ramps, curb and gutter, drainage
improvements, and modification to the existing on -street parking; and
WHEREAS, the City will be responsible for the construction, management, and
administration of the Project; and
WHEREAS, the County agrees to contribute funds in an amount not -to -exceed one
million four hundred one thousand dollars ($1,401,000.00) ("Contributed Funds") towards the
construction of the Project; and
WHEREAS, the County and the City desire to execute a Joint Participation Agreement
("JPA") to distribute and accept the contributed funds to complete the Project; and
WHEREAS, the funds are to be appropriated by separate Resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to execute a JPA, in a form acceptable to the
City Attorney, with the County for the Project.
Section 3. The City Manager is authorized to accept funds form the County in an amount
not -to -exceed one million four hundred one thousand dollars ($1,401,000.00) to be used for the
construction of the Project.
Section 4. Funds are to be appropriated by separate Resolution.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
