WHEREAS, the City of Miami ("City") is the owner of approximately 10.5103 acres more or less, together with all riparian rights, of certain tract of land, some of which is submerged as a deep water slip, located adjacent to Bicentennial Park in the City ("Property"); and WHEREAS, on March 24, 1994, the City Commission adopted Resolution 94-204, which authorized the Bayfront Park Management Trust to proceed with the steps necessary to assume control and take responsibility for the operation and maintenance of Bicentennial Park; and WHEREAS, on September 25, 2006, the Bayfront Park Management Trust adopted Resolution 06- 033.5, which authorized the Bayfront Park Management Trust to proceed with the steps necessary to assume temporary control and take responsibility for the operation and maintenance of the Property; and WHEREAS, the City wishes to transfer temporary control of the Property to the Bayfront Park Management Trust but reserves the right to rescind control of the Property at any time during or after the development of Bicentennial Park; NOW, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Bayfront Park Management Trust is authorized {1 } to proceed with the steps necessary to assume temporary control and take responsibility for the operation and maintenance of the Property, as more particularly describe in Exhibit "A," attached and incorporated. Section 3.
