A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS
(4/5) AFFIRMATIVE VOTE, RATIFYING, RETROACTIVELY APPROVING, AND
CONFIRMING THE CITY MANAGER'S EMERGENCY FINDING, ATTACHED
AND INCORPORATED AS ATTACHMENT "A," THAT IT IS MOST
ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY") TO WAIVE THE
COMPETITIVE SEALED BIDDING PROCEDURES PURSUANT TO SECTION
18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED;
RETROACTIVELY AUTHORIZING THE SELECTION OF KEARNS
CONSTRUCTION COMPANY FOR EMERGENCY DERELICT VESSEL
REMOVAL SERVICES FOR THE DEPARTMENT OF REAL ESTATE AND
ASSET MANAGEMENT, IN THE OF $160,468.00; FURTHER DIRECTING THE
CITY MANAGER TO SEEK REIMBURSEMENT FOR THIS EXIGENCY AND
EMERGENCY DERELICT VESSEL REMOVAL FROM THE FEDERAL
EMERGENCY MANAGEMENT AGENCY AS APPLICABLE AND AS
AVAILABLE.
WHEREAS, the City of Miami's Department of Real Estates and Asset Management
("DREAM") required emergency removal services for derelict vessels due to Hurricane Irma;
and
WHEREAS, the Director of DREAM has submitted to the Chief Procurement Officer and
the City Manager in writing a full explanation of the emergency, and the reasons for selection of
Kearns Construction Company, and a certification of fund availability from the Director of the
Office of Management and Budget; and
WHEREAS, the City Administration will seek reimbursement for this exigency or
emergency derelict vessel removal from the Federal Emergency Management Agency ("FEMA")
as applicable and as available; and
WHEREAS, the City Manager, pursuant to Section 18-90 of the Code of the City of
Miami, Florida, as amended ("City Code"), approved an emergency finding, attached and
incorporated as Attachment "A," waiving competitively sealed bidding procedures to provide for
the derelict vessel removal services; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths), affirmative vote, pursuant to Section 18-90 of the City
Code, the City Manager's emergency finding, attached and incorporated as Attachment "A," is

ratified, retroactively approved and confirmed, the requirements for competitive sealed bidding
procedures are waived, and the emergency procurement of the derelict vessel removal services
from Kearns Construction Company for DREAM, in the amount of $160,468.00, is authorized.'
Section 3. The City Administration is directed to seek reimbursement for this exigency
and emergency derelict vessel removal from FEMA as applicable and as available.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
elf the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
