HomeMy WebLinkAboutR-18-0218City of Miami Resolution R-18-0218 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 4132 Final Action Date: 5/24/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING, ATTACHED AND INCORPORATED AS ATTACHMENT "A," THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY"), PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION OF GRANT FUNDS FROM THE DISTRICT 1 COMMISSIONER'S SHARE OF THE CITY'S ANTI -POVERTY INITIATIVE IN A TOTAL AMOUNT NOT TO EXCEED $92,702.00 TO LITTLE HAVANA ACTIVITIES NUTRITION CENTERS OF DADE COUNTY, INC., A FLORIDA NOT FOR PROFIT CORPORATION ("LHANC"), FOR ELDERLY MEALS ASSISTANCE AT THE ANTONIO MACEO PARK; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. SPONSOR(S): Commissioner Wifredo (Willy) Gort WHEREAS, the City Commission created the Anti -Poverty Initiative to assist low-income residents within the City of Miami ("City"); and WHEREAS, the City Commission approved the establishment of accounts for five (5) City Commission districts for the purpose of allocating Anti -Poverty Initiative Funds ("Funds") utilizing the proportionate percentage of poverty levels based on the five (5) year poverty rate determined by the American Community Survey, as adjusted annually; and WHEREAS, Little Havana Activities & Nutrition Centers of Dade County, Inc., a Florida not for profit corporation ("LHANC"), has served the community for more than thirty (30) years and provides food to low and moderate -income seniors; and WHEREAS, the District 1 Commissioner wishes to grant Funds from the District 1 share of the City's Anti -Poverty Initiative in an amount not to exceed $97,702.00 to LHANC ("Funds"); and WHEREAS, LHANC will utilize the Funds to provide meals to sixty (60) participants for a period of one (1) year at the Antonio Maceo Park; and WHEREAS, the City Manager has made a written finding, attached and incorporated as Attachment "A," pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), that competitive negotiation methods and procedures are not practicable or advantageous for the City; and City of Miami Page 1 of 2 File ID: 4132 (Revision:) Printed On: 3/31/2025 File ID: 4132 Enactment Number: R-18-0218 WHEREAS, the City Manager is requesting authority from the City Commission to negotiate and execute an agreement, in a form acceptable to the City Attorney, for the allocation of Funds for the purpose stated above; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's finding, attached and incorporated as Attachment "A," that competitive negotiation methods and procedures are not practicable or advantageous to the City pursuant to Section 18-85(a) of the City Code and waiving the requirements for said procedures is ratified, approved, and confirmed. Section 3. The City Manager is authorized' to allocate Funds from the District 1's share of the City's Anti -Poverty Initiative to LHANC to provide meals for a period of one (1) year to sixty (60) participants in an amount not to exceed $97,702.00. Section 4. The City Manager is authorized to execute any and all necessary documents, in a form acceptable to the City Attorney, for said purposes. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: end ety Nttor ey 5/15/2018 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
