Background of Item: On October 12, 2006, the City Commission approved the plat for the southwest side of Watson Island, Resolution No. 06-0608 entitled "Watson Island Southwest". As part of the platting requirements, an easement must be provided for each of the utilities. Water and Sewer Department ("WASD") has requested the grant of approximately fifteen (15) foot wide strip by two hundred fifty (250) foot strip easement on City -owned property for the construction, operation and maintenance of water and sewer facilities in connection with the development on Watson Island. This easement will be used for the construction, operation, and maintenance of water and sewer facilities with the right to reconstruct, improve, and change and remove all or any of the facilities within the easement. This easement shall further contain a reverter provision that if the easement is abandoned or discontinued, the easement shall cease and revert back to the City. WHEREAS, the Miami -Dade County Water and Sewer Department ("WASD") has requested the grant of a perpetual, non-exclusive underground easement ("Easement") of an approximately fifteen (15) foot wide by two hundred fifty (250) foot long strip of City of Miami ("City") owned land located at Watson Island, Miami, Florida; and WHEREAS, the Easement will be used for the construction, operation, and maintenance of WASD facilities with the right to reconstruct, improve, change, and remove all or any of the facilities within the Easement and with the full right of ingress thereto and egress therefrom; and WHEREAS, the Easement shall further contain a reverter provision providing that if the Easement is abandoned or discontinued, the Easement shall cease and revert back to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is hereby authorized' to execute an Easement on City - owned property located on Watson Island, Miami, Florida, in substantially the attached form, to WASD, of an approximately fifteen (15) foot wide by two hundred fifty (250) foot long utility easement, as more particularly described in Exhibit "A" of the Easement, attached and incorporated, for a perpetual non-exclusive underground easement on the property, for the 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited, to those prescribed by applicable City Charter and City Code provisions construction, operation, and maintenance of underground utility facilities, with the right to reconstruct, improve, change, and remove all or any of the facilities within the Easement with the full right of ingress thereto and egress therefrom, and further containing a reverter provision providing that if the Easement is abandoned or discontinued, the Easement shall cease and revert back to the City.
