HomeMy WebLinkAboutResolutionCity of Miami Resolution Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 3960 Final Action Date: 5/24/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO CONVEY, WITH PARCEL REVERTER PROVISIONS, THE CITY OF MIAMI ("CITY") OWNED PARCELS OF LAND LOCATED IN THE CITY OF NORTH MIAMI, KNOWN AS THE LIFE QUEST FACILITY PROPERTIES, TO EMPOWER "U," INC., A FLORIDA NOT FOR PROFIT CORPORATION ("EMPOWER U"), FOR THE REHABILITATION AND UTILIZATION OF RESIDENTIAL HOUSING UNITS IN ORDER TO PROVIDE SUPPORTIVE HOUSING PROGRAMS AS PART OF THE HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS ("HOPWA") PROGRAM; ALLOCATING FUNDS IN THE AMOUNT OF $700,000.00 FROM PRIOR YEARS' HOPWA PROGRAM FUNDS TO ASSIST WITH THE REHABILITATION OF THE LIFE QUEST FACILITY PROPERTIES; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, ANY AND ALL DOCUMENTS, INCLUDING AMENDMENTS, RENEWALS, EXTENSIONS, AND MODIFICATIONS, AS MAY BE NECESSARY FOR SAID PURPOSE(S), SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS. WHEREAS, Empower U, Inc., a Florida not for profit corporation ("Empower U"), is a community -based organization dedicated to the support of Miami -Dade County ("MDC") residents with AIDS and to the provision of health services to residents of the community; and WHEREAS, Empower U was founded in 1999 in order to establish a comprehensive program for housing and community development; and WHEREAS, Empower U is currently managing an affordable housing development within the City of Miami ("City") that was completed with Housing Opportunities for Persons with AIDS ("HOPWA") funds and is currently in good standing with the City; and WHEREAS, the properties to be conveyed were purchased with HOPWA funds in December 1993 and were transferred to Movers, Inc., in December 2003, but the properties reverted back to the City when Movers, Inc. was unable to rehab the properties; and WHEREAS, the addresses of the properties to be conveyed cannot be disclosed for confidentiality purposes, pursuant to 24 CFR 574.440; WHEREAS, the City retained an architect, who has prepared a rehabilitation plan that has been approved by the MDC Building Department, for the reconstruction of the properties; and WHEREAS, the Administration recommends the conveyance, with parcel reverter provisions, of the City -owned parcels of land to Empower U, for the rehabilitation and utilization City of Miami Page 1 of 2 File ID: 3960 (Revision:) Printed On: 2/10/2025 File ID: 3960 Enactment Number: of residential housing units for the purpose of providing supportive housing as part of the HOPWA program; and WHEREAS, the Administration also recommends that the conveyance of the properties be subject to the following restrictions: (i) the properties remain available for HOPWA residents for a minimum of ten (10) years; (ii) any mortgages on the properties obtained by the Developer must be subject to the approval of the City's Department of Community and Economic Development; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The conveyance, with parcel reverter provisions, of the City -owned parcels of land located in the City of North Miami, known as the Life Quest Facility Properties, to Empower U, for the rehabilitation and utilization of residential housing units in order to provide supportive housing programs as part of the HOPWA program, is authorized.1 Section 3. The allocation of $700,000.00 from prior years' HOPWA funds to assist with the rehabilitation of the Life Quest Facility Properties, is authorized.1 Section 4. The City Manager is further authorized' to negotiate and execute, in a form acceptable to the City Attorney, any and all documents, including amendments, renewals, extensions, and modifications, as may be necessary for said purpose(s), subject to all federal, state, and local laws that regulate the use of such funds. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
