Subject: Amend Code - Chapter 18 - Acceptance of Donations
Purpose of Item:
An ordinance amending Chapter 18, Article III, Section 18-115 entitled Acceptance of
Donations to strike the phrase "goods and services" from the language of the section.
Background of Item:
Currently, the City Manager is allowed to accept donations of goods and services up to
$25,000. This amendment would allow the City Manager to also accept monetary
donations up to the same amount.

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 18,
ARTICLE III, SECTION 18-115 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED "FINANCE/CITY OF MIAMI PROCUREMENT
ORDINANCE/ACCEPTANCE OF DONATIONS," TO STRIKE THE PHRASE "GOODS
AND SERVICES" FROM THE LANGUAGE OF THE SECTION; CONTAINING A
SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, it is the intent of the City of Miami ("City") to amend Chapter 18/Article
III/Section 18-115 of the Code of the City of Miami, Florida, as amended ("City Code"), entitled
"Finance/City of Miami Procurement Ordinance/Acceptance of Donations" to remove the phrase
"goods and services" from the language of the section; and
WHEREAS, the City Commission after careful consideration of this matter, deems it
advisable and in the best interest of the general welfare to the City and its residents to amend
the City Code as set forth herein;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 18, Article III, Section 18-115 of the City Code is amended in the
following particulars:1
"CHAPTER 18
FINANCE
ARTICLE III. CITY OF MIAMI PROCUREMENT ORDINANCE

Sec. 18-115. - Acceptance of donations.
The city manager is authorized to accept the donations of goods and ccrvicct) up to an
estimated value of $25,000.00 on behalf of the city.

Section 4. If any section, part of a section, paragraph, clause, phrase or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty (30) days after final reading and
adoption thereof.2
APPROVED AS TO FORM AND CORRECTNESS:
2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
