Bidding Procedures
Pursuant to FS 255.20 (1)(c)(1)

ENCLOSURES:
The Office of Capital Improvements ("OCT") and the Department of Real Estate and Asset Management
("DREAM") respectfully request the waiver of the competitive sealed bidding procedures pursuant to F.S.
255.20 entitled "Local bids and contracts for public construction works; specification of state -produced
lumber", specifically sub -section (1)(c)(1).
We offer the following as background information. On September 9'h and 10th, 2017, Hurricane Irma's
("Irma") destructive winds and rain made landfall in Miami, leaving a path of destruction throughout the
City of Miami ("City") to include various City facilities as outlined in the attached Exhibit "A". These
facilities received extensive damage and now require immediate repair. It will be most advantageous for
the City to utilize construction contractors that are responsible, can meet minimum qualifications, can
provide bonding and meet the City's insurance requirements, and who are capable of high quality
performance under exigent emergency circumstances, and have performed and successfully completed,
City or other governmental construction projects, for each of these repairs of the City facilities listed in
Exhibit "A".
The destruction caused by Irma constitutes as a valid public emergency to be certified by the City Manager.
Pursuant to the City Manager's emergency finding, which finds that Irma has caused a valid public
emergency to City facilities listed in Exhibit "A", it is most advantageous for the City to waive the
competitive sealed bidding procedures pursuant to F.S. 255.20(1)(c)(1), as the extensive damage caused by
Irma to the City facilities in Exhibit "A", constitute an immediate danger to the public health or safety.
It is not feasible for the City to proceed with the procurement process outlined in F.S. 255.20, as the process
can take approximately six (6) months. The lengthy process will delay the vital repairs to the various
facilities whose damage pose a public safety issue, and in many cases a loss of revenue to the City.
Accordingly, OCI and DREAM respectfully request your approval to waive the competitive sealed bidding
process for the provision of construction services to repair the various damaged City facilities.
