HomeMy WebLinkAboutR-18-0173City of Miami Resolution R-18-0173 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 4072 Final Action Date: 4/26/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY ADMINISTRATION TO AMEND THE PLANNING DIRECTOR'S INTERNAL PROCESS TO REQUIRE WARRANT APPLICATIONS BE SUBMITTED TO THE DISTRICT COMMISSIONER FOR THE DISTRICT UPON RECEIPT OF THE INITIAL APPLICATION BY THE CITY OF MIAMI'S PLANNING DEPARTMENT. SPONSOR(S): Commissioner Joe Carollo WHEREAS, pursuant to Article 7, Section 7.1.2.4 of Ordinance No. 13114, the Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code"), a Warrant is an administrative permit issued by the Planning Director for those specified uses in Article 4, Table 3 of the Miami 21 Code; and WHEREAS, Warrants can have negative effects on neighborhoods, residents, and businesses; and WHEREAS, in order to proactively address any negative effects, it is requested that all Warrant applications be submitted to the District Commissioner for the District in which the property is located, upon initial receipt of the Warrant applications by the City of Miami's Planning Department, for consideration and comment; and WHEREAS, pursuant to 2-33(e) of the Code of the City of Miami, the City Commission unanimously deems this Resolution to be of an emergency nature; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission directs the City Administration to amend the Planning Director's internal process to require that all applications for Warrants be submitted to the District Commissioner for the District in which the property, upon initial receipt of the Warrant applications by the City's Planning Department, for consideration and comment. Section 3. The City Commission further directs the City Manager to amend any and all other applicable regulations and policies to comport with the provisions of this Resolution, if any. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' 1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
