Williamson Director, Office of Capital improvements s & Recreation April 2, 2018 DATE : FILE : SUBJECT : REFERENCES: ENCLOSURES: Request to Waive Competitive Sealed Bidding Procedures and Qualifications Process Pursuant to FS 287,055, 3(A)i Revised Exhibit "A - The Ile Office of Capital Improvements ("OCI") respectfully requests the waiver of the competitive sealed bidding procedures and qualifications process pursuant to F.S. 287.055, known as the Consultants' Competitive Negotiations Act ("CCNA"), Section 3(a)1, entitled "Public Announcement and Qualifications Procedures." On December 14, 2017, through Resolution No. 17-0618, the Nlianli City Commission by a four -fifths (4/5) affirmative vote, approved and confirmed the City Manager's emergency finding, as agency head, that Hurricane Irma ("Irma") has caused a valid public emergency to City facilities outlined in Exhibit "A" of the City Manager's finding, and that it is most advantageous for the City to waive the competitive sealed procurement procedures and qualifications process pursuant to Section 287.055(3)(a)(1), Florida Statutes. Exhibit "A" only listed properties managed by DREAM and did not include parks and other City properties extensively damaged by Irma. These additional facilities received extensive damage and now require immediate repair. It will be most advantageous for the City to utilize Architectural & Fn<uinecring, ("A&E") consultants that are currently under contract with the City, for each of these repairs of the additional City facilities listed in Revised Exhibit "A". The destruction caused by Hurricane Irma constitutes as a valid public emergency to be certified by the City Manager, pursuant to F.S. 287.055, Section 3(a)1. It is not feasible for the City to proceed with the procurement process outlined in F.S. 287.055. CCNA, as the process can take approximately six (6) to nine (9) months. The lengthy process will delay the vital repairs to the various facilities whose damage pose a public safety issue, and in many cases a loss of revenue to the City. Accordingly, OCI respectfully requests your approval to waive the competitive procurement process for the provision of A&E services to repair the various damaged City facilities.
