Background of Item: In continuance of the City of Miami's commitment to assisting homeless persons within the jurisdictional boundaries of the City, and its desire to comply with the Pottinger Settlement Agreement, wishes to procure and make available shelter beds to homeless persons in the City's homeless population that are Pottinger Candidates. Camillus House, Inc., has the capacity to accommodate seventy-five (75) beds in the Camillus House Norwegian Cruise Line Campus Emergency Shelter and to provide associated services, and thus has the ability to implement the Shelter Program for the City. WHEREAS, the City of Miami ("City"), in furtherance of its continuing commitment to assist homeless persons within the jurisdictional boundaries of the City and pursuant to the City's desire to comply with the Pottinger Settlement Agreement ("Pottinger Agreement"), wishes to procure and make available additional shelter beds to homeless persons in the City's homeless population that are observed violating a "Life sustaining conduct" misdemeanor as described in the Pottinger Agreement; and WHEREAS, the Pottinger Agreement provides that any such homeless person can only be offered an "Available Shelter" described as "a shelter for a period of at least 24 hours, with a bed or a mat, at least three (3) inches thick, at no cost to the homeless person, within the territorial boundaries of the City or within one (1) mile thereof, or if agreed to by the homeless person, within Miami -Dade County, that treats homeless persons with dignity and respect, imposes no religious requirements, and, unless agreed to by the homeless person, does not impose substance abuse treatment as a condition for shelter" ("Shelter Program"); and WHEREAS, the Camillus House, Inc., a Florida not for profit corporation ("Camillus House"), has the capacity to accommodate seventy-five (75) beds in the Camillus House Norwegian Cruise Line Campus Emergency Shelter ("Shelter") and to provide associated services, and thus has the ability to implement the Shelter Program for the City; and WHEREAS, funds for the Shelter Program in an amount not to exceed $460,000.00 will be available to fund the Shelter Program as its obligations become due by the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute an Agreement between the City and Camillus House to establish the City's Shelter Program including the provision of seventy-five (75) beds in the Shelter for the nightly use of homeless individuals with ten (10) beds being set aside as overnight (twenty-four [24] hour stay) beds, along with other associated and accompanying homeless services, for a period of one (1) year, subject to said beds being exclusively designated for the City's homeless who are observed violating a "Life sustaining conduct" misdemeanor as described in the Pottinger Agreement at the total cost of $460,000.00, payable in twelve (12) monthly installments by the City. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
