Request to Waive Competitive Sealed
Bidding Procedures
The Department of Procurement ("Procurement"), on behalf of the City of Miami ("City"), respectfully
requests your approval and action of the Miami City Commission by a 4i5ths affirmative vote, after an
advertised public hearing ratifying, approving, and confirming the Chief Procurement Officer's
recommendation, and finding that competitive negotiation methods are not practicable or advantageous
to the City of Miami ("City"), pursuant to Section 18-85(a) of the Code of the City of Miami; waiving
the requirements for said procedures; authorizing the City Manager to enter into a memorandum of
understanding ("MOU"), in substantially the attached form, with the MPA and Skate Free, Inc., a Florida
not for profit corporation ("Skate Free").
Procurement respectfully requests such recommendations, finding and authorization in order to proceed
with executing the MOU between the MPA, the City and Skate Free to fund a portion of the Skate Plaza
project in an amount not to exceed Six Hundred Thousand Dollars ($600,000.00), to be utilized in
accordance with the terms of the MOU.
Skate Free is a not -for -profit entity that has demonstrated a tenacious commitment to improve our
communities and neighborhoods for the betterment of the City through: a) advocating for the development
of the parking lot area into diverse -use skate park facility and green space for public use and enjoyment,
and b) matching the City's contribution of six hundred thousand dollars ($600,000.00), plus cover any
additional expenses necessary for the realization of the Skate Plaza project.
For reasons stated above, as required by Section 18-85(a) of the Code of the City of Miami, Procurement:
a) recommends the execution of the MOU with Skate Free for the use and development of a skateboarding
park facility and green space, and (b) finds that competitive sealed bidding is not practicable or
advantageous to the City for the aforementioned Skate PIaza project.
