Subject: Authorize Maintenance MOA - Coral Way Beautification Improvements
Purpose of Item:
A Resolution of the Miami City Commission authorizing the City Manager to execute a
Maintenance Memorandum of Agreement (MMOA) with the Florida Department of
Transportation (FDOT) for beautification improvements on State Road (972) (SW 22nd
Street) (Coral Way) from SW 37th Avenue (Douglas Road) to SW 12th Avenue (SR-
933).
Background of Item:
On September 19, 2017, the City Commission approved an application for Grant
Funding from the Florida Department of Transportation for the beautification of Coral
Way/ SR 972 and on November 21, 2017, the Florida Department of Transportation
selected the Department of Public Works to receive the grant (Financial Project Number
442797-1-74-01) in the amount of $72,500, with the City of Miami's $72,500 match to be
used for items allowed by Section 339.2405(11), Florida Statues.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A LANDSCAPE MAINTENANCE
MEMORANDUM OF AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM,
BETWEEN THE CITY OF MIAMI ("CITY") AND THE STATE OF FLORIDA
DEPARTMENT OF TRANSPORTATION ("FDOT") FOR BEAUTIFICATION
IMPROVEMENTS MADE TO STATE ROAD ("SR") 972, ALSO KNOWN AS
SOUTHWEST 22ND STREET OR CORAL WAY, FROM SOUTHWEST 37TH
AVENUE, ALSO KNOWN AS DOUGLAS ROAD, TO SOUTHWEST 12TH AVENUE,
ALSO KNOWN AS SR-933, ("PROJECT"), WHICH PROJECT ENTAILS WORK ON
THE STATE HIGHWAY SYSTEM, PROVIDING FDOT GRANT FUNDS TO THE
CITY'S DEPARTMENT OF PUBLIC WORKS IN THE AMOUNT OF SEVENTY TWO
THOUSAND FIVE HUNDRED DOLLARS ($72,500.00) FROM FINANCIAL PROJECT
NO. 442797-1-74-01 WITH THE CITY'S MATCHING FUNDS FOR THE SAME
AMOUNT TO BE USED FOR ITEMS ALLOWED BY SECTION 339.2405(11),
FLORIDA STATUTES; ALLOCATING FUNDS FROM ACCOUNT NO.
13000.201000.534000.0000.00000.
WHEREAS, on September 19, 2017, the City Commission approved an application for
grant funding from the State of Florida Department of Transportation ("FDOT") for the
beautification improvements made to State Road ("SR") 972, also known as Southwest 22nd
Street or Coral Way, from Southwest 37th Avenue, also known as Douglas Road, to Southwest
12th Avenue, also known as SR-933; and
WHEREAS, on November21, 2017, FDOT selected the City of Miami's ("City")
Department of Public Works ("Public Works") to receive grant funds through Financial Project
No. 442797-1-74-01 in the amount of Seventy Two Thousand Five Hundred Dollars
($72,500.00) with the City's matching funds for the same amount to be used for items allowed
by Section 339.2405(11), Florida Statues; and
WHEREAS, Public Works will install landscape in accordance with the design plans as
approved by FDOT; and
WHEREAS, the Landscape Maintenance Memorandum of Agreement ("MMOA")
between FDOT and the City, attached and incorporated as Exhibit "A", establishes the terms,
conditions, and responsibilities of FDOT and the City for accomplishing the improvements on
the State Roads; and
WHEREAS, the City agrees with the terms and conditions in the MMOA;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the MMOA, in substantially the
attached form, with FDOT to accommodate the improvements by the City on SR-972, also
known as Southwest 22nd Street or Coral Way, from Southwest 37th Avenue, also known as
Douglas Road, to Southwest 12th Avenue, also known as SR-933, providing FDOT grant funds
to Public Works in the amount of Seventy Two Thousand Five Hundred Dollars ($72,500.00)
with the City's matching funds for the same amount to be used for items allowed by Section
339.2405(11), Florida Statues and further subject availability of funds and budgetary approval at
the time of need.
Section 3. Funds are to be allocated from Account No.
13000.201000.534000.0000.00000.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
