A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A MAINTENANCE
MEMORANDUM OF AGREEMENT, IN SUBSTANTIALLY THE ATTACHED
FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND THE STATE OF
FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") FOR
BEAUTIFICATION IMPROVEMENTS TO STATE ROAD ("SR") 5/UNITED
STATES HIGHWAY 1 ("US-1")/SOUTH DIXIE HIGHWAY FROM SOUTHWEST
22ND AVENUE TO SR-9/INTERSTATE-95 ("I-95") ("PROJECT"), WHICH
PROJECT ENTAILS WORK ON THE STATE HIGHWAY SYSTEM, PROVIDING
FDOT GRANT FUNDS TO THE CITY'S DEPARTMENT OF PUBLIC WORKS IN
THE AMOUNT OF FIFTY ONE THOUSAND ONE HUNDRED ONE DOLLARS
($51,101.00) FROM FINANCIAL PROJECT NO. 442799-1-74-01, WITH THE
CITY'S MATCHING FUNDS OF SIXTY SEVEN THOUSAND FIVE HUNDRED
FIFTY FIVE DOLLARS ($67,555.00) TO BE USED FOR ITEMS ALLOWED BY
SECTION 339.2405(11), FLORIDA STATUTES; ALLOCATING FUNDS FROM
ACCOUNT NO. 13000.201100.534000.0000.00000.
WHEREAS, on September 19, 2017, the City Commission approved an application for
Grant Funding from the State of Florida Department of Transportation ("FDOT") for the
beautification to State Road ("SR") 5/United States Highway 1 ("US-1")/South Dixie Highway
from Southwest 22nd Avenue to SR-9/Interstate-95 ("I-95"); and
WHEREAS, on November21, 2017, FDOT selected the City of Miami ("City")
Department of Public Works ("Public Works") to receive grant funds through Financial Project
No. 442799-1-74-01 in the amount of fifty one thousand one hundred one dollars ($51,101.00)
with the City's matching funds of sixty seven thousand five hundred fifty five dollars
($67,555.00) to be used for items allowed by Section 339.2405(11), Florida Statues; and
WHEREAS, FDOT will install, in accordance with the design plans for Contract C9E09,
landscape, turf, integral colored sidewalks, pavers, aggregate textured sidewalks, lighting
conduit, and pull boxes and the City will install, under a future permit, a lighting system, bollards,
benches, trash receptacles, and signage as approved by FDOT ("Project"); and
WHEREAS, the Maintenance Memorandum of Agreement ("MMOA"), attached and
incorporated as Exhibit "A", establishes the terms, conditions, and responsibilities of FDOT and
the City for accomplishing the Project improvements on the City's streets; and
WHEREAS, the City agrees with the terms and conditions in the MMOA, in substantially
the attached form, for the Project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to execute the MMOA, in substantially the
attached form, with FDOT to accommodate the Project improvements on SR-5/US-1/South
Dixie Highway from Southwest 22nd Avenue to SR-9/I-9, providing FDOT grant funds of fifty
one thousand one hundred one dollars ($51,101.00) from Financial Project No. 442799-1-74-01
with the City's matching funds of sixty seven thousand five hundred fifty five dollars
($67,555.00) to be used for items allowed per Section 339.2405(11), Florida Statutes, and
subject to availability of funds and budgetary approval at the time of need.
Section 3. Funds are to be allocated from Account No.
13000.201100.534000.0000.00000.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
