HomeMy WebLinkAbout(2680) - PZAB ResolutionCity of Miami PZAB Resolution Enactment Number: PZAB-R-17-055 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File ID: 2680 Final Action Date: 10/4/2017 A RESOLUTION OF THE MIAMI PLANNING, ZONING, AND APPEALS BOARD ("PZAB") NOTIFYING THE MIAMI CITY COMMISSION THAT THE PZAB HAS FAILED TO MAKE A RECOMMENDATION REGARDING AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 10544, AS AMENDED, THE FUTURE LAND USE MAP OF THE MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN PURSUANT TO SMALL SCALE AMENDMENT PROCEDURES SUBJECT TO §163.3187, FLORIDA STATUTES, BY CHANGING THE FUTURE LAND USE DESIGNATION FROM "LOW DENSITY RESTRICTED COMMERCIAL" TO "MEDIUM DENSITY RESTRICTED COMMERCIAL" OF THE ACREAGE DESCRIBED HEREIN OF REAL PROPERTIES AT APPROXIMATELY 2810, 2814, 2816, AND 2818 SW 37 AVENUE AND 3700 SW 28 STREET MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A"; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the properties located at 2810, 2814, 2816, and 2818 SW 37 Avenue and 3700 SW 28 Street, Miami, Florida ("Properties") have a current future land use designation of "Low Density Restricted Commercial"; and WHEREAS, the applicant has submitted a request to change the future land use designation of the Properties to "Medium Density Restricted Commercial"; and WHEREAS, this item was presented to the Planning, Zoning, and Appeals Board ("PZAB") on October 4, 2017; and WHEREAS, after careful consideration of this matter, four (4) members of the PZAB voted in favor of recommending approval of the FLUM change as stated herein and four (4) members of the PZAB voted in favor of recommending denial of the FLUM change as stated herein; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING, AND APPEALS BOARD OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted and incorporated as if fully set forth in this Section. Section 2. The PZAB has failed to make any findings or conclusions regarding this matter. Section 3. This Resolution shall become effective immediately upon its adoption.
