REZONING PROCEDURE The City's growth and evolution over time will inevitably require changes to the boundaries of certain Transect Zones. These changes shall occur successionally in which the rezoning may be made only to a lesser Transect Zone; within the same Transect Zone to a greater or lesser intensity; or to the next -higher Transect Zone; or through a Special Area Plan, as specified in Article 7 of Miami 21. Except where the request is for an extension of an existing Transect boundary, no rezoning of land will be considered when the proposal is for a property is less than 40,000 square feet of land area or 200 feet of street frontage on one street. The public hearing process for a Rezoning will require appearing before the Planning, Zoning and Appeals Board (PZAB) and the City Commission. Applications for Rezoning will be considered by the City Commission two times per year. The dates are April and October. Pre -Application Phase 1. Applicant may consult with the Zoning (4`" Floor), Planning (3`d Floor) and Hearing Boards (3rd Floor) for informal guidance at anytime. 2. The Planning and Zoning Department will schedule a date for the pre -application meeting with representatives from the department to obtain information and guidance related to the proposed application; the pre -application meeting shall take place no later than 15 days prior to submittal of application. 3. At the pre -application meeting, staff will validate the survey prepared within six months from date of application. The applicant will be provided with a zoning referral and application materials. Technical Review Phase 4. The Planning and Zoning Department will review the preliminary application and supporting materials for completeness. Application Phase 5. Applicant meets with the Hearing Boards to review application package prior to acceptance. (See attached instructions and application.) 6. In order to be scheduled for the PZAB, the prospective applicant shall submit the application and supporting documents for review and verification of completeness, and Hearing Boards will issue an invoice for payment of the required fees for public hearing. 7. Goal TR-I: Mainlai►r an effective and cost efficient traffic circulation network within the City of Manzi that provides transportation for alt persons and facilitates commercial activity, and which is consistent with, and furthers, neighborhood plans, supports economic development, conserves energy, and protects and enhances the natural environment. Twenty Three's application advances Goal 1 of the Comp. Plan's Transportation Element through the execution of a Project that addresses the following related Objectives and Policies: Objective TR-1.5: The City of Miami's continued development requires the provision of effective public transit and paratransit services that serve existing and future land uses, ... the appropriate coordination of public transit with existing and future land uses... Therefore, the City of Miami will support Miami -Dade County in the provision of these essential public transit services. (See Natural Resource Conservation Policy NR-3.2.2.) Policy TR-1.5.8: The City will ensure a stronger interface between development or redevelopment of neighborhood activity centers and the public transportation system...The City shall require all new development and redevelopment in existing and planned transit corridors to be planned and designed promote pedestrianism and transit usage through the following: E. Redevelopment of property within one-half mile of existing and planned transit stations and bus routes shall not cause an increase in walking distances from nearby areas to the transit services and shall, wherever practical, be done in a manner that reduces walking distances and is comfortable and attractive to pedestrians. G. Immediately abutting the Assemblage to its East is the Shamrock at Coral Gables — a 7-story, 80 unit condominium building with a zoning designation of Urban Core Transect Zone Open (T6-8-O). Further East is a two-story commercial property that shares the same designation as the Shamrock. Pictures of both properties can be found in Exhibit "B". Of the aforementioned parcels, the only new development has occurred on the parcels with the most intense zoning designation. Immediately to the West of the Property within 300' are approximately twelve (12) parcels each with a zoning transect designation of Sub -Urban Transect Zone Open (T3-0). Photos of the Western properties can be found in Exhibit "C". The housing typology ranges from single-family structures to small, single -story multiplex structures. Immediately South of the Property within 300' are commercial (Renaissance in the Gables) and residential properties with designations of Sub -Urban Transect Zone Open (T3-O), General Urban Transect Zone Limited (T,1-L), and Urban Core Transect Zone Open (T6-8-0). Pictures of this portion of the Project Area are attached in Exhibit "D". Finally, within 300' of the Property to the North are a mix of single-family, duplex, mid -rise multi- family residential and commercial uses. Immediately abutting the properties to the north are a series of single-family/duplex structures with a transect designation of Sub -Urban Transect Zone Open (T3-0). On the North side of SW 22nd Court is the Gables Marquis Condominium — an approximately 20-story, 185 unit building with commercial uses oriented towards Coral Way and three-story residential units transitioning towards SW 22' Terrace. Photos of the northern properties can be found in Exhibit "E." Given the Property's close proximity to SW 32' Avenue and the Coral Way corridor, the requested FLUM and rezoning request is appropriate. The three-story, residential structures that could be developed under the proposed change would provide a meaningful transition from the more intense and dense commercial uses located on NW 32 Avenue — which include a banquet facility (immediately to the South), a nightclub (Azucar, located at the SE corner of SW 32nd Avenue & SW 23rd Street), a 7-story condominium building, and 13,000 sq. ft. commercial center. ("Kimley-Horn" or "the Consultant") is pleased to submit this letter agreement (the "Agreement") to Twenty Three Project, LLC ("the Client") for providing transportation engineering services. Our project understanding, scope of services, schedule, and fee are below. PROJECT UNDERSTANDING It is our understanding that the Client desires to change the land use and zoning category for the parcel located at 3245 SW 23rd Street in Miami, Florida. The land use plan amendment (LUPA) will require a trip generation letter for submittal to the City of Miami. SCOPE OF SERVICES Task 1 — Trip Generation Letter The Consultant will document the trip generation calculations for the existing and proposed development land uses. The calculations will consist of A.M. and P.M. peak hour trip generation estimates. The Consultant will compare the estimates to determine the net trip generation change associated with the proposed rezoning. Trip generation calculations will be based upon the Institute of Transportation Engineers' (ITE) Trip Generation Manual, 9th Edition and ITE's Trip Generation Handbook, 3rd Edition. The analysis will be summarized in a technical letter for submittal to the City of Miami. Additional Services Any services not specifically provided for in the above scope will be considered additional services and can be performed at our then current hourly rates.
