The proposed rezoning would be appropriate and would further the Goals
and Objectives of the Property's present Comprehensive Neighborhood Plan
designations. In addition, the NW 7th Avenue corridor has become more
commercial in recent years and there is new demand for neighborhood serving
commercial uses in this part of Allapattah. Therefore, the change in land use and
the rezoning of the property will help to address this growing need.
Enclosed please find photographs of the properties within a 300 foot radius
of the application site.
The Property is approximately 73,143 square feet or 1.748 acres in size. The
Subject Property currently houses three (3) single-family homes with accessory
structures, which are generally regarded to be in a state of disrepair. The Property,
which has nearly 300 feet of frontage along the Miami River, is also currently
improved with several wood docks and active boat slips. The Applicant intends
to develop a mixed use multi -family development with ground floor commercial
areas along NW 7 Avenue and with multifamily residential units within the area
to be rezoned to T4-R.
The Property, which is currently zoned T3-L, is located on the south side of
the Miami River, fronting NW South River Drive to the south and NW 16th
Avenue and the Grove mini -park to the west. The Property is distinctively located
at the intersection of the Orange Bowl District, East Little Havana, Grove Park, and
the Health District (formerly known as Civic Center), areas, which continue to
experience redevelopment resulting in significant population growth and
business expansion. Due to its location, the Property has unparalleled access to a
variety of transportation options, including the Miami River to the north, the NW
17th Avenue Bridge to the east, and the S.R. 836 Expressway's on -ramp to the
south.
The Property is located within an area designated on the FLUM as Single
Family Residential that over the years has changed significantly due to highway
expansion. The Applicant requests the abovementioned land use amendment and
rezoning in order to enhance the residential character of the Property as it is
located along the Miami River, which has experienced significant redevelopment
and revitalization in recent years. The Applicant's request will better utilize the
already residentially designated area by permitting more compatible multi -family
residential development. Thus, approval of this application would promote the
redevelopment and revitalization of this blighted and threatened residential area,
which is consistent with Objective LU-1.2.

The Applicant's request will provide for a more appropriate transition
between the abutting T6-24A-O and T5-L transect zones across the Miami River
by permitting the Property to be zoned T4-R; thus, providing a more gradual
transition between those properties across the Miami River and the T3-R zoned
residential neighborhood. The rezoning will allow for enhanced buffering
between the adjacent residences and the commercial uses, which does not exist
today. Thus, approval of this application would mitigate potentially adverse
impacts of new development on existing neighborhoods through the development
of appropriate transition standards, consistent with Policy LU-1.6.9.

Dear Mr. Garcia:
This law firm represents 1515 Miami River, LLC (the "Applicant") in
regards to requests for a Miami Neighborhood Comprehensive Plan ("MNCP")
amendment and rezoning of the properties located at 1515, 1529, and 1543 NW
South River Drive in the City of Miami, Florida (collectively, the "Property").
See Exhibit A, Property Appraiser Summary Reports. The Applicant seeks an
MCNP amendment of the Property from Single Family Residential to Low Density
Multifamily Residence as well as a rezoning of the Property from T3-L to T4-R.
Please allow this letter to serve as the required Letter of intent in connection with a
pre -application request for an MCNP amendment and rezoning of the Property.
Property. The Property, which is currently zoned T3-L, is located on the
south side of the Miami River, fronting NW South River Drive to the south and
NW 16th Avenue and the Grove mini -park to the west. The Property is
distinctively located at the intersection of the Orange Bowl District, East Little
Havana, Grove Park, and the Health District (formerly known as Civic Center),
areas, which continue to experience redevelopment resulting in significant
population growth and business expansion. Due to its location, the Property has
unparalleled access to a variety of transportation options, including the Miami

The Property is approximately 73,143 square feet or 1.748 acres in size. The
Subject Property currently houses three (3) single-family homes with accessory
structures, which are generally regarded to be in a state of disrepair. The Property,
which has nearly 300 feet of frontage along the Miami River, is also currently
improved with several wood docks and active boat slips.
Request. The Applicant seeks to redevelop the Property into a pedestrian -
oriented residential community that is in conformance with the intent and goals
of Miami 21. The proposed T4-R designation will permit for a compatible
residential community along the Miami River within walking distance of some of
the City's most important employment and entertainment areas in a manner that
will remain respectful to the area's residential character. The Health District is in
great need of additional housing options to serve the thousands of individuals
who work in the area.
Criteria. Article 7, Section 7.1.2.8(c), Miami 21 states that a rezoning of land
will only be considered where the proposal involves an extension of an existing
transect boundary, unless the rezoning involves at least 40,000 square feet of land
area or 200 feet of street frontage on one street. The Property consists of
approximately 265.90 feet of street frontage along NW 16 Avenue as well as 292.64
feet along NW South River Drive, which satisfies the rezoning criteria set forth in
Article 7, Section 7.1.2.8.c. of Miami 21. In addition, the Property is comprised of
approximately 73,143 square feet of land area, which also satisfies the rezoning
criteria set forth in Article 7, Section 7.1.2.8.c of Miami 21. The Applicant's request
to rezone the Property from T3-L to T4-R, the next intensity Transect Zone, which
is also consistent with the successional zoning requirements of Article 7, Section
7.1.2.8 of Miami 21.
Article 7, Section 7.1.2.8.f. of Miami 21 provides the criteria for amendments
to Miami 21. The provision provides as follows "[fjor all amendments:
(a) The relationship of the proposed amendment to the goals, objectives and
policies of the Comprehensive Plan, with appropriate consideration as to
whether the proposed change will further the goals, objectives and policies
of the Comprehensive Plan; the Miami 21 Code; and other city regulations.
(b) The need and justification for the proposed change, including changed or
changing conditions that make the passage of the proposed change
necessary.

The proposed amendment is consistent with the goals, objectives and policies of
the MCNP. For instance, Objective LU-1.2 states as follows:
Promote, facilitate, and catalyze the redevelopment
and revitalization of blighted, declining or threatened
residential, commercial and industrial areas through a
variety of public, private, and public -private
redevelopment initiatives and revitalization programs
including, where appropriate, historic designations.
The Property is located within an area designated on the FLUM as Single Family
Residential that has been threatened and been somewhat regarded as blighted.
The Applicant requests the abovementioned land use amendment and rezoning in
order to enhance the residential character of the Property as it is located along the
Miami River, which has experienced significant redevelopment and revitalization
in recent years. The Applicant's request will better utilize the already residentially
designated area by permitting more compatible multi -family residential
development. Thus, approval of this application would promote the
redevelopment and revitalization of this blighted and threatened residential area,
which is consistent with Objective LU-1.2.
Objective LU-1.7 provides as follows: "Ensure that the [MCNP] is updated
as needed to meet changing conditions and, improve its effectiveness and
success." As mentioned above, the Property is located along the Miami River and
Health District, which has seen significant redevelopment and revitalization in
recent years. As such, approval of the Applicant's MCNP amendment request
would be consistent with Objective LU-1.7.
Policy LU-1.6.9 states, "[t]he City's land development regulations will
establish mechanisms to mitigate the potentially adverse impacts of new
development on existing neighborhoods through the development of appropriate
transition standards and buffering requirements." The Applicant's request will
provide for a more appropriate transition between the abutting T6-24A-O and T5-
L transect zones across the Miami River by permitting the Property to be zoned
T4-R; thus, providing a more gradual transition between those properties across
the Miami River and the T3-R zoned residential neighborhood. The rezoning will
allow for enhanced buffering between the adjacent residences and the commercial
uses, which does not exist today. Thus, approval of this application would
mitigate potentially adverse impacts of new development on existing

For rezoning, "[a] change may be made only to the next intensity Transect
Zone or by a Special Area Plan, and in a manner which maintains the goals of this
Miami 21 Code to preserve Neighborhoods and to provide transitions in intensity
and Building Height." See Article 7, Section 7.1.2.8f.2 of Miami 21. The Applicant
requests a change from T3-L to T4-R, which is consistent with successional
rezoning regulations provided in Article 7, Section 7.1.2.8.a.3 of Miami 21 as
mentioned above. Approval of the Applicant's request would allow for enhanced
utilization of the Property, which is located along the Miami 21. Therefore, the
Applicant's request maintains the goals of Miami 21 to preserve neighborhoods
and continue providing for transitions in intensity and building height.
Covenant. The Applicant presented the Application for a land use change
and rezoning to the Miami River Commission last month and the Commission
voted to support the application. The Applicant is proffering a covenant in relation
to the public access to the Miami River (See Exhibit B). If the application is
approved, the covenant requires that the Owner provide pedestrian waterfront
access for the public to the River from 6am to 10pm along a river walk to be
developed as part of the development of the Property.

REZONI.NG PROCEDURE
The City's growth and evolution over time will inevitably require changes to the boundaries of
certain Transect Zones. These changes shall occur successionally in which the rezoning may be
made only to a lesser Transect Zone; within the same Transect Zone to a greater or lesser
intensity; or to the next -higher Transect Zone; or through a Special Area Plan, as specified in
Article? of Miami 21.
Except where the request is for an extension of an existing Transect boundary, no rezoning of
land will be considered when the proposal is for a property is Tess than 40,000 square feet of land
area or 200 feet of street frontage on one street.
The public hearing process for a Rezoning will require appearing before the Planning, Zoning and
Appeals Board (PZAB) and the City Commission. Applications for Rezoning will be considered
by the City Commission two times per year. The dates are April and October.
Pre -Application Phase
1. Applicant may consult with the Zoning (4th Floor), Planning (3rd Floor) and Hearing Boards (3rd
Floor) for informal guidance at anytime.
2. The Planning and Zoning Department will schedule a date for the pre -application meeting with
representatives from the department to obtain information and guidance related to the
proposed application; the pre -application meeting shall take place no later than 15 days prior
to submittal of application.
3. At the pre -application meeting, staff will validate the survey prepared within six months from
date of application. The applicant will be provided with a zoning referral and application
materials.
Technical Review Phase
4. The Planning and Zoning Department will review the preliminary application and supporting
materials for completeness.
Application Phase
5. Applicant meets with the Hearing Boards to review application package prior to acceptance.
(See attached instructions and application.)
6. In order to be scheduled for the PZAB, the prospective applicant shall submit the application
and supporting documents for review and verification of completeness, and Hearing Boards
will issue an invoice for payment of the required fees for public hearing.
Hearing Boards accepts, time stamps and initials application and schedules item for an
upcoming PZAB hearing.

There is no deadline to submit this application as it is presented semi-annually to the Planning,
Zoning and Appeals Board and the City Commission. The application submittal date is the
date stamped by Hearing Boards' staff on this page. The responses to this application must
be typed and signed in black ink. All pertinent and accurate information/documentation; i.e.,
the plans, reports, exhibits, shall be presented at the time of filing, in addition to the paid receipt.
The applicant is responsible for the accuracy of the information contained in the application and
all supporting materials. Should you wish, you could bring the materials to our office for review
prior to submittal to ensure completeness.
You will be responsible, if needed, to bring an interpreter for the English language to any
presentation before city boards, committees and the city commission. A valid power of attorney
will be required if neither applicant or legal counsel representing the applicant execute the
application or desire to make a presentation before city boards, committees and the city
commission. All documents, reports, studies, exhibits (8Vx11 ") or other materials submitted
during this process will be kept as part of the record. Any documents offered to the Planning,
