A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD,
WITH ATTACHMENTS, RECOMMENDING DENIAL OF AN ORDINANCE OF THE
MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 10544, AS AMENDED,
THE FUTURE LAND USE MAP OF THE MIAMI COMPREHENSIVE
NEIGHBORHOOD PLAN, PURSUANT TO SMALL SCALE AMENDMENT
PROCEDURES SUBJECT TO §163.3187, FLORIDA STATUTES, BY CHANGING
THE FUTURE LAND USE DESIGNATION FROM "SINGLE-FAMILY RESIDENTIAL"
TO "LOW DENSITY MULTIFAMILY RESIDENTIAL" OF THE ACREAGE DESCRIBED
HEREIN OF REAL PROPERTIES AT APPROXIMATELY 1515, 1529, AND 1543
NORTHWEST SOUTH RIVER DRIVE, MIAMI, FLORIDA, AS MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A"; MAKING FINDINGS; CONTAINING A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the properties located at approximately 1515, 1529, and 1543
Northwest South River Drive, Miami, Florida, as more particularly described in Exhibit
"A", attached and incorporated, have a current future land use designation of "Single -
Family Residential"; and
WHEREAS, 1515 Miami River, LLC ("Applicant") has submitted a request to
change the future land use designation to "Low Density Multifamily Residential"; and
WHEREAS, the submitted request would increase the allowed density from nine
(9) dwelling units per acre to 36 dwelling units per acre, located partially within the
Coastal High Hazard Area, which the Miami Comprehensive Neighborhood Plan
("MCNP") explicitly states should not be done; and
WHEREAS, the submitted request would create an isolated area of "Low Density
Multifamily Residential" among a neighborhood of "Single -Family Residential"; and
WHEREAS, the Applicant submitted a companion application to rezone the same
properties from "T3-L" (Sub -urban — Limited) to °`T4-R" (General -Urban — Restricted);
and
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") has considered
the goals, objectives, and policies of the MCNP; Ordinance No. 13114, as amended, the
Zoning Ordinance of the City of Miami, Florida ("Miami 21 Code"); and all other City of
Miami ("City") regulations; and

WHEREAS, PZAB has considered the need and justification for the submitted
request including changing and changed conditions;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND
APPEALS BOARD THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Resolution are adopted by reference and incorporated as fully set forth in this Section.
Section 2. Ordinance No. 10544, as amended, the Future Land Use Map of
the MCNP, pursuant to small scale amendment procedures subject to §163.3187,
Florida Statutes, should not be amended by changing the Future Land Use designation
of approximately 1.77 acres of real properties at approximately 1515, 1529, and 1543
Northwest South River Drive, Miami, Florida from "Single -Family Residential" to "Low
Density Multifamily Residential", as more particularly described in "Exhibit A", attached
and incorporated.
Section 3. This Resolution shall become effective immediately upon its
adoption.
