WHEREAS, the City of Miami ("City") wishes to construct a floating dock at Morningside Park ("Project") in connection with submitting an application proposal in connection with potentially available from the Florida Inland Navigation District ("FIND") Waterways Assistance Program ("Program") for this Project, pursuant to FIND Rule 66B-2, Florida Administration Code ("F.A.C."); and WHEREAS, the City, from time to time, also wishes to submit grant application proposals for funding from FIND under the Program and for other future grant application proposals involving the construction, reconstruction, repairs, and improvements to floating docks at City parks and marinas (collectively, "Floating Dock Projects"); and WHEREAS, the Miami City Commission, in accordance with the municipal exemptions regarding the regulation of the use of polystyrene on public property, has previously adopted Ordinance No. 13681 on May 25, 2017 to prohibit expanded polystyrene products in City parks and recreation facilities, including beaches therein; and WHEREAS, the City owns, operates, manages, and strives to preserve positive environmental qualities of its numerous parks and recreation facilities, beaches, and public marina facilities which are important to the public health, safety, welfare, and economy of the City and the surrounding communities; and WHEREAS, the City Commission has directed for the City Manager, in connection with all current and future FIND grant application proposals and other grant application proposals for Floating Dock Projects, to include provisions and budgeting for design, construction, reconstruction, installation, repairs, and improvements to enclose any polystyrene products and construction materials to be used in such Floating Dock Projects to protect the environment at City -owned public facilities from construction debris and deteriorating materials; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is directed and authorized', in connection with all current and future grant application proposals for reimbursement grant funding from the FIND Program and any other future grant application proposals involving the design, construction, reconstruction, installation, repairs, and improvements to Floating Dock Projects, to include provisions, in a form acceptable to the City Attorney, for design, budgeting, materials, and processes to enclose any polystyrene products and construction materials to be used in such Floating Dock Projects in order to protect the environment at City -owned public facilities from construction debris and deteriorating materials. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. 2 APPROVED AS TO FORM AND CORRECTNESS: ndez, ity Attor ey 4/17/2018 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
