HomeMy WebLinkAboutR-18-0113City of Miami Resolution R-18-0113 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 3633 Final Action Date: 3/8/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING THE PROPOSAL RECEIVED AUGUST 2, 2017 PURSUANT TO REQUEST FOR QUALIFICATIONS ("RFQ") NO. 16-17-049 FROM LOCAL OFFICE LANDSCAPE AND URBAN DESIGN, LLC, A FOREIGN LIMITED LIABILITY CORPORATION ("LOCAL OFFICE"), THE HIGHEST RANKED RESPONSIVE AND RESPONSIBLE FIRM FOR THE URBAN DESIGN AND LANDSCAPE ARCHITECT/ENGINEERING SERVICES FOR THE DEVELOPMENT OF THE WYNWWOD NORTHWEST 3RD AVENUE WOONERF ("PROJECT"), ACCEPTING THE NEGOTIATED HOURLY STAFF RATES AND THE FULL PRICE PROPOSAL FOR COMPLETION OF THE PROJECT IN AN AMOUNT OF $392,900.00, WHICH SHALL SERVE AS A GUARANTEED MAXIMUM PRICE; ALLOCATING FUNDS FROM THE WYNWOOD BUSINESS IMPROVEMENT DISTRICT IN THE AMOUNT OF $50,000.00 AND FROM THE FLORIDA EAST COAST CORRIDOR IMPROVEMENT TRUST FUND ACCOUNT NO. 32-110145 IN THE AMOUNT OF $342,900.00; AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT ("PSA"), IN SUBSTANTIALLY THE ATTACHED FORM; AUTHORIZING THE CITY MANAGER TO NEGOTIATE THE COST OF AND EXECUTE ANY AND ALL AMENDMENTS TO THE PSA, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, REQUIRED TO COMPLETE ANY SUBSEQUENT PROJECT TASKS; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER DOCUMENTS, INCLUDING WORK ORDERS, AMENDMENTS, EXTENSIONS, AND MODIFICATIONS TO THE PSA, INCLUDING WITHOUT LIMITATION, INCREASES IN CAPACITY AND INCREASES TO THE CONTRACT FUNDING, WHICH MAY BE ADMINISTRATIVELY APPROVED BY THE CITY MANAGER SUBJECT TO ALLOCATIONS, APPROPRIATIONS, AND BUDGETARY APPROVAL HAVING BEEN PREVIOUSLY MADE AND IN COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE REGULATIONS, AS MAY BE NECESSARY FOR SAID PURPOSE. WHEREAS, the Procurement Department ("Procurement"), on behalf of the Department of Planning ("Planning"), issued Request for Qualifications ("RFQ") No. 16-17-049 for Urban Design and Landscape Architect/Engineering Services for the Wynwood 3rd Avenue Woonerf ("Project"); and WHEREAS, the Project includes design documents for the implementation of a Woonerf, which has been officially defined as a living street as originally implemented in the Netherlands City of Miami Page 1 of 3 File ID: 3633 (Revision:) Printed On: 3/31/2025 File ID: 3633 Enactment Number: R-18-0113 and in Flanders and which includes shared space inclusive of bicycles, traffic calming devices, and low speed limits; and WHEREAS, on August 2, 2017, eight (8) proposals were received by the Office of the City Clerk in response to the RFQ; and WHEREAS, the duly appointed Evaluation Committee convened on September 29, 2017, to evaluate and rank the respondent firms and determined that Local Office Landscape and Urban Design, LLC, a foreign limited liability corporation ("Local Office"), is the highest ranked and most qualified firm to complete the services required by RFQ No. 16-17-049; and WHEREAS, the City Manager authorized Procurement and Planning to negotiate with Local Office the hourly staff billing rates and price proposal for completion of the Project; and WHEREAS, the City Manager requests authorization to execute the Professional Service Agreement ("PSA") with Local Office in the amount of $392,900.00, which shall serve as the Guaranteed Maximum Price for all fees charged under the PSA for completion of the Project; and WHEREAS, the City Manager requests further authorization to negotiate the cost of and execute any and all other documents including any work orders, amendments, extensions, and modifications to the PSA required to complete any subsequent Project tasks after consultation with the City Attorney; and WHEREAS, funds in the total amount of $392,900.00 for the completion of the Project are to be allocated from the Wynwood Business Improvement District in the amount of $50,000.00 and from the Florida East Coast ("FEC") Corridor Improvement Trust Fund Account No. 32-110145 in the amount of $342,900.00; and WHEREAS, pursuant to Section 62-324 of the Code of the City of Miami, Florida, as amended ("City Code"), all disbursals of the FEC Corridor Improvement Trust Fund shall be made by the City Commission after due consideration is given to the written recommendations of the City Manager and the Directors of Zoning, Building, Public Works, Capital Improvement Program ("CIP"), Transportation, and Planning; and WHEREAS, the overall goal of the Project is to develop a blueprint for a Woonerf (i.e. a Dutch version of a pedestrian -primary, bicycle friendly "shared" street) consisting of street trees, landscaping, street furniture, sculptures, artistic wayfinding, and other streetscape enhancements; and WHEREAS, the Project will encompass the entire publicly owned right-of-way along Northwest 3rd Avenue from Northwest 25th Street to Northwest 29th Street, Miami, Florida; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The proposal received August 2, 2017, pursuant to RFQ No. 16-17-049 from Local Office, the highest ranked responsive and responsible firm, for the Project and the City of Miami Page 2 of 3 File ID: 3633 (Revision:) Printed on: 3/31/2025 File ID: 3633 Enactment Number: R-18-0113 negotiated staff billing rates and price proposal for completion of the Project in the amount of $392,900.00 are accepted. Section 3. Funds in the total amount of $392,900.00 are to be allocated from the Wynwood Business Improvement District in the amount of $50,000.00 and from the FEC Corridor Improvement Trust Fund in the amount of $342,900.00. Section 4. The City Manager is authorized to execute a PSA with Local Office, in substantially the attached form. Section 5. The City Manager is authorized' to negotiate the cost of and execute any and all amendments to the PSA, in a form acceptable to the City Attorney, required to complete any subsequent project tasks. Section 6. The City Manager is further authorized to negotiate and execute any and all other documents, including work orders, amendments, extensions, and modifications to the PSA, including without limitation, increases in capacity and increases to the contract funding which may be administratively approved by the City Manager subject to allocations, appropriations, and budgetary approval having been previously made and in compliance with all applicable provisions of the City Code, in a form acceptable to the City Attorney, and in compliance with all applicable regulations as may be necessary for said purpose. Section 7. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
