HomeMy WebLinkAboutPre-publication Submittals - Petition in Oppositionchange.org Recipient: Letter: Buena Vista Neighborhood Commissioners of the City of Miami Greetings, Dear Honorable Commissioners: Re: 15-000531u and 15-00053zc (often referred to as the Design District Garage), on the Commission Agenda for February 22, 2018. Facts: The majority of the parcel is residential: 19,900 sq ft zoned for mixed use (T4-L) on North Miami Avenue; 28,800 sq ft zoned for single family (T3-L) within the Buena Vista Heights neighborhood. None of this land is within the Design District SAP. The Design District SAP stipulates 4,000+ parking spaces within its boundaries... not the nearby residential area. According to code, a 3-story garage could be built on the North Miami Avenue portion with zone -appropriate setbacks and an approved Warrant of ground floor stores. The Applicant seeks to build a 5-story commercial garage, encroaching into a well established residential neighborhood via a Civic Institution rezone. Attached please find 473 paper and online petition signatures and numerous impassioned comments opposing the rezone. We oppose: - the zoning workaround that this private, for -profit garage is a civic institution and then setting a precedent for encroachment via the use of CI; - that this garage will be a neighborhood benefit (e.g. jobs from an automated garage, protection from overflow parking when the neighborhood has residential decals, hurricane shelter when five large garages exist in the area); - the need for an 800-car commercial garage when another 800-car garage for the Design District (i.e. Museum Garage) exists ONE BLOCK AWAY on 41 st Street; - slashing middle-class homeowners' property values -- and quality of life -- for the benefit of millionaires and billionaires. We support: - smart development in our neighborhood as defined by the zoning code of Miami 21. For three years, the neighbors will have attended five City Commission hearings, seven PZAB hearings (where we prevailed 7-3), and countless community meetings. This includes ten deferrals and continuances granted to the Applicant. How many times must a neighborhood say, "no?" Where do we, as a community, draw the line when it comes to giving influential developers special breaks that harm everyday people? We hope that line starts with you.
