LLC (the "Applicant"),1 we submit to your attention this updated application package for a rezoning and companion future land use amendment for the properties located at 30 NW 44 Street, 29 NW 42 Street, and 4202-4308 North Miami Avenue (the "Property").2 The parcels located at 30 NW 44 Street and 29 NW 42 Street ("Western Parcels") are currently zoned T3-L, and the parcels located at 4202-4308 North Miami Avenue (the "Eastern Parcels") are currently zoned T4-L. The future land use designation of the Western Parcels is presently Duplex Residential and the future land use designation of the Eastern Parcels is presently Low Density Restricted Commercial. Applicant is proposing to rezone the entire Property to Civic Institutional ("CI") and to amend the future land use designation of the Property to Major Institutional, Public Facilities, Transportation and Utilities ("Major Institutional") (the "Updated Application"). 1 Oak Plaza Associates (Del.) LLC is the successor by merger to Paved Paradise LLC, the original applicant, by virtue of consolidation through Certificate of Merger. 2 Note that the previous version included the parcels located at 4310 N Miami Ave (Folio: 01-3124-020-1250) and 4330 N Miami Ave (Folio: 01-3124-020-1240), which have since been removed from the application. akerman.com 42744792;1 August 31, 2017 Page 2 Compliance with Application Requirements under Miami 21 As set forth in Miami 21, Article 7, Section 7.1.2.8.a.3., the proposed rezoning of the Property, of the Western Parcels from T3-L to CI, and of the Eastern Parcels from T4-L to CI, meets the successional zoning requirements. Further, the proposed rezoning meets the technical threshold requirements of 7.1.2.8.c.1 since the overall area of the Property is approximately 46,996 square feet, which exceeds the 40,000 square foot minimum requirement. The proposed rezoning also meets the criteria listed in 7.1.2.8.f.2 because the zoning change maintains the goals of Miami 21 to provide transitions and preserve neighborhoods. The design district neighborhood is a large assemblage of properties, including retail, restaurant, and cultural destinations. The area to the west of the Property is a residential neighborhood and the area immediately south of the Property along North Miami Avenue consists of commercial establishments. CI is defined as "a zone with uses primarily dedicated to functioning for community purposes such as cultural, educational, environmental, governmental, public transit, public parking and religious facilities." Because the Property abuts both residential and commercial uses, CI would be a suitable transition between the two areas as a zone that is dedicated to functioning for community purposes. Specifically, there is a community need for a parking garage and the Property is a suitable location to fulfill this need and one of the only parcels that can satisfy the demand for parking in the area — to prevent inappropriate overflow parking on neighborhood streets. The rezoning will assist in preserving the quality of the neighborhood and serving as a transition from the residential to retail areas; and will improve the relationship between the residential neighborhoods and adjacent commercial corridor (see Article 2.1.2.). Therefore, the zoning change is appropriate particularly in relation to the neighboring properties. Compliance with Application Requirements under the City's Comprehensive Plan The proposed companion Comprehensive Plan Amendment would amend the future land use designation of the Property to "Major Institutional," which is consistent with the proposed CI zoning designation. The proposed land use is compatible with and furthers the objectives and policies of the comprehensive plan (see Section 62-8(c) of the city code). Goal LU-1 of the comprehensive plan promotes several objectives, including the maintenance of land patterns that protect and enhance the quality of life in the city's neighborhoods, and promotion and facilitation of economic development and growth of job opportunities in the city. Here, a change to "Major Institution" — which allows for government, health, recreational cultural facilities, as well as transportation facilities and public utilities — will enhance the neighborhood by providing the opportunity for the development of a public parking garage along with ground floor retail on a property that is uniquely situated between a residential neighborhood and active commercial corridor, which is a key multi -modal transportation corridor in the County. Further, the change to "Major Institutional" will facilitate the economic development and growth opportunities at a scale that is beneficial to the neighborhood, and specifically to growth opportunities along North Miami Avenue. Here, Applicant is proposing to provide a garage as a 42744792;1 August 31, 2017 Page 3 public facility and ground floor neighborhood -oriented businesses, which will benefit the area and further the objectives of the comprehensive plan. Justification and Neighborhood Compatibility The ultimate goal of the Applicant is to develop structured parking on the Property in order to serve and accommodate uses and activities associated with the ongoing growth and development within the Design District and to protect the residential neighborhoods to the north and west from overflow parking by providing a centrally located garage along North Miami Avenue. In order to function as a meaningful development site and allow for such a use, the Property must be rezoned (and the future land use designation amended) and future development approved through an Exception. This proposed Application and such a project would be beneficial to the adjacent residential neighborhood, as it will discourage visitors to the Design District from parking on local, residential streets, and can be accompanied by appropriate ground floor commercial services and businesses that are oriented to serving the daily needs of nearby residents. Further, Applicant intends to proffer a covenant which limits the height of the proposed project to 46 feet to keep the scale of the development in line with other commercial uses along North Miami Avenue.
