Purpose of Item:
A Resolution of the Miami City Commission, with attachments(s), to establish a new
Special Revenue Project entitled: "FY 17 Sexual Assault Forensic Evidence -Inventory,
Tracking and Reporting Program" consisting of a grant from the U.S. Department of
Justice, Office of Justice Programs, in the amount of $264,263; authorizing the City
Manager to enter into an agreement, in substantially the attached form, to accept said
grant award and to execute the necessary documents, in a form acceptable to the City
Attorney, to implement the acceptance and administration of said grant. This award
does not require any local match.
Background of Item:
This funding will allow the Miami Police Department (MPD) to replace the outdated 12-
year old database with an advanced Automated Information Technology (AIT) system;
to include installation, data transfer and training for the management of sexual assault
kits. MPD is committed to performing its due diligence to bring justice to the victims of
sexual assault. The acquisition of the state of the art equipment and technology will
give the department the tools to implement a system that will improve the organization
of our inventory, and enhance tracking and reporting processes; thereby significantly
augmenting MPD's efforts to decrease and/or eliminate the backlog of sexual assault
kits.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ESTABLISHING A NEW SPECIAL REVENUE PROJECT ENTITLED, "FY 17 SEXUAL
ASSAULT FORENSIC EVIDENCE - INVENTORY, TRACKING AND REPORTING
PROGRAM;" APPROPRIATING FUNDS CONSISTING OF A GRANT AWARD FROM
THE UNITED STATES DEPARTMENT OF JUSTICE, OFFICE OF JUSTICE
PROGRAMS, FOR THE MIAMI POLICE DEPARTMENT IN THE AMOUNT OF
$264,263.00 TO PROVIDE FUNDING FOR AN AUTOMATED INFORMATION
SYSTEM FOR THE MANAGEMENT OF SEXUAL ASSAULT KITS; FURTHER
AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT AND EXECUTE
THE NECESSARY DOCUMENTS, IN SUBSTANTIALLY THE ATTACHED FORM, TO
IMPLEMENT ACCEPTANCE AND ADMINISTRATION OF SAID GRANT.
WHEREAS, the City of Miami ("City") has a strong interest in providing support to the
victims of sexual assault and ensuring that the Miami Police Department ("MPD") has all the tools
necessary to investigate and assist in the prosecution of sexual assault offenders; and
WHEREAS, without definitive forensic analysis on a sexual offense evidence kit that may
remain inactive in a police department's property room, the filing of criminal charges cannot occur,
evidence brought against the accused may be inadequate, or prosecution could be unreasonably
delayed, ultimately causing the victim's case to remain unresolved; and
WHEREAS, Section 943.326, Florida Statutes, requires MPD to submit a sexual offense
evidence kit, or other DNA evidence, to a criminal analysis laboratory system for forensic testing
within thirty (30) days after a triggering event; and
WHEREAS, MPD's Property Unit is dedicated to improving the processes that will
increase its ability to track and manage forensic evidence collected through sexual offense
evidence kits; and
WHEREAS, the City has been awarded a grant in the amount of two -hundred sixty-four
thousand two hundred sixty-three dollars ($264,263.00) from the United States Department of
Justice, Office of Justice Programs to be utilized by MPD for the acquisition of an updated
automated information system for the management of sexual assault kits; and
WHEREAS, the acquisition of updated equipment and technology will give MPD the tools
to implement a system that will improve the organization of inventory, enhance tracking and
reporting processes, and significantly augment MPD's efforts to eliminate any backlog in the
processing of sexual assault kits or other DNA evidence; and
WHEREAS, this award does not require any local match; and
WHEREAS, said grant program is for the period of January 1, 2018 through December 31,
2020;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The following new Special Revenue Project is established and resources are
appropriated as described below:
FUND TITLE: FY 17 Sexual Assault Forensic Evidence —
Inventory, Tracking, and Reporting
RESOURCES: U.S. Department of Justice,
Office of Justice Programs $264,263.00
APPROPRIATIONS: $264,263.00
Section 3. The City Manager is authorized to execute an agreement, in substantially the
attached form, and any and all necessary documents, in a form acceptable to the City Attorney, to
implement the acceptance and administration of said grant.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2
APPROVED AS TO FORM AND CORRECTNESS:
1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
