Board's Decision to Historically Designate Property at 240 SE 14th Street
Dear Ms. Zamora:
On behalf of our client, Babylon International, Inc., (the "Property Owner") the owner of
property located at 240 SE 14th Street, (the "Property"), this letter constitutes a notice of appeal
of the Historic and Environmental Preservation Board's decision (the "HEP Board") at its hearing
held on July 5, 2016, Item Number 4, referenced as 16-00883, to designate the Property as a
historic resource.
The HEP Board designated the Property in violation of several legal principals. This
appeal is based on the following grounds, including but not limited to:
(1) The HEP Board violated due process when the same person simultaneously served
as the applicant for the Property's designation and as a voting member of the HEP
Board;
(2) The HEP Board violated due process at its April 3, 2016 meeting when it formally
voted to direct the Preservation Officer to prepare a pre -designation report on the
Property without 1) the matter being on the agenda, 2) notice to the Property Owner, or
3) the opportunity for the Property Owner to be heard;
(3) The HEP Board violated Section 23-4 of the City of Miami Code ("Code") by
designating the Property without compliance with the standards specifically delineated
for designation of properties less than 50 years old and without regard for national
standards for historic preservation;
(4) The Property does not fit the necessary criteria required for historic preservation;
(5) The HEP Board failed to follow the standards of law prescribed to quasi-judicial
boards pursuant to Chapters 23 and 62 of the Code.

(6) The HEP Board went beyond its jurisdiction by designating the Property in
contravention to a City of Miami Unsafe Structure Panel Order, dated October 28, 2015
and authorized by Chapter 10 of the Code, requiring demolition of the Property;
(7) The HEP Board designated the Property under an inaccurate premise. The
designation report presented to the HEP Board at the July 5, 2016 hearing described the
Property based on a 1979 version of plans, but that version of the Property was never
built. The Property that was actually built, and was granted a Certificate of Occupancy in
1982, was based on a significantly different set of plans;
(8) The HEP Board's decision to designate the Property promotes and supports the
concept of historic preservation as an anti -development tool.
Accordingly, we respectfully appeal the HEP Board's decision to historically designate
the Property and request that the City Commission reverse. Please schedule this appeal on the
September or November agenda at the Miami City Commission, as the undersigned will be out
of the Country during the scheduled October meeting.
Enclosed, please find a check for the filing fee of $525 and a separate check for the
notice fee of $140 ($3.50 x 40 notices). Thank you for your attention to this matter.
