Dear Mr. Garcia:
On behalf of Southeast Investments Group Corp. (the "Applicant"), please accept the
enclosed Applications for a Comprehensive Plan Amendment and Rezoning (the
"Applications") of the properties located at 2900 S. Miami Ave and 2890, 2900, 2920, 2940 &
2960 S. Federal Highway, Miami, Florida (collectively, the "Property"). The Property consists
of six (6) platted Lots: Lots 1 through 4 of the Ekmat Subdivision, as recorded in Official Plat
Book 69, Page 87, and Lots 20 and 21 of the Resubdivision of Blocks 61 & 62 of Flagler, as
recorded in Official Plat Book 42, at Page 73, of the Public Records of Miami -Dade County
Florida. The Property is approximately 1.3 acres in area and currently consists of 4 existing
single family homes and 2 vacant unimproved lots. The Applicant seeks to develop the Property
as an upscale townhome residential project with underground parking facilities and a single
access drive from S. Federal Highway.
This correspondence constitutes the Applicant's Letter of Intent and analysis pursuant to
Article 7.1.2.8(c) (2) (g) of Miami 21.

REQUESTS
Per Miami 21, the zoning for the Property is T3-R as located within the NCD-3 Coconut
Grove Neighborhood Conservation District. The Applicant now proposes and hereby submits
the enclosed application for approval of a zoning change for the Property from T3-R to T4-O
pursuant to the successional zoning requirements of Article 7.1.2.8 of Miami 21.
The City's Future Land Use Map designates the Property as Single Family Residential
("SFR"). The Applicant now proposes and hereby submits the enclosed application for an
amendment to the City's Future Land Use Map of the City's Comprehensive Neighborhood Plan
("Comprehensive Plan") from "SFR" to Low Density Multifamily Residential ("LDMR"). The
LMDR designation permits residential structures up to a maximum density of 36 dwelling units
per acre which is consistent with the allowable density under the T4 Transect Zone.
Accordingly, the Applicant's proposed townhome residential uses for the Property are permitted
under the LMDR designation of the City's Comprehensive Plan. Please see Exhibit A for the
Land Use Policies supporting the rezoning and comprehensive plan amendment.
PROPERTY INFORMATION
The single family homes currently located on the Property front onto S. Federal Highway
(US-1), and directly overlook the I-95 Expressway overpass. Both of these roadways are major
highways within the City with a high volume of traffic. The existing single family homes on the
Property are one of the only houses in the area that directly front onto these highways. The
Property serves to buffer the pocket of single family homes to the South from the visual and
noise pollution associated with these abutting highway systems.
ANALYSIS
The Applicant proposes an upscale townhome development for the Property in
accordance with the T4 regulations of Miami 21. The T4 regulations allow for rear vehicular
access, a minimum lot size of 1,400 SF, and a maximum height of 3 stories, which is only one
additional story than that permitted under the abutting T3 Transect Zone. The T4 Transect Zone
also requires a minimum rear setback of 20 feet. Applying these rear setbacks, along with
situating the parking below the townhomes and reducing the number of existing curb cuts to

provide for a single access drive will create a more suitable and compatible residential
development along US-1 while ensuring an appropriate buffer and transition to the single family
homes to the south. The Applicant will also be providing abundant landscaping along the rear
Property line to act as a buffer in order to further reduce any visual impact to the single family
homes to the rear. Accordingly, the townhome uses proposed at the Property will be compatible
with the surrounding uses and maintain the residential character of the neighborhood.
The current design of the existing single family homes on the Property requires the
residents to directly back out onto the highly congested and traveled US-1 highway. This
condition exists since the single family homes at the Property were constructed between 1959
and 1960, prior to the extension of I-95 into Miami in 1970. The proposed Comprehensive Plan
amendment and Rezoning will alleviate this incompatibility caused by the construction of I-95,
by permitting a more appropriate development at the Property with rear access.
Specifically, this existing condition will be cured by the Rezoning to T4-O which allows
the Applicant to accommodate the vehicular access lanes to the rear of the Property and away
from US-1. The rear access provided for under the proposed rezoning to T4-O will improve
overall traffic flow and safety and is therefore more appropriate based on the Property's
proximity to the highly traveled US-1 highway. Additionally, the proposed design which
provides for common access, underground parking facilities, and surplus parking spaces will
prevent the parking of any cars along the swale areas of the US-1 corridor and into the abutting
residential neighborhood. Accordingly, the townhome units proposed under the Comprehensive
Plan amendment to LDMR and Rezoning to T4-O are more appropriate along this particular
portion of US-1 than the existing single family homes on the Property.
The Property is also uniquely situated between the entrance of Coconut Grove to the
West and the entrance of the Brickell Avenue to the East. The uses located near or in the vicinity
of the Property include the Miami Science Museum to the West, the high density and intensity
hotel and residential uses along Brickell Avenue to the East, and the Baptist Medical Plaza and
other commercial uses along US-1 to the North. These areas within the vicinity of the Property
are respectively designated Major Public Facilities, High Density and Medium Density
Multifamily Residential, and Restricted Commercial under the City's Comprehensive Plan.
We believe the townhome uses proposed under the Comprehensive Plan amendment to
LDMR and Rezoning to T4-0 will serve as an appropriate transition between the institutional
uses to the west, the commercial and high density uses to the east, and the major highways and
expressways to the north. The proposed Comprehensive Plan amendment and Rezoning will
also create a buffer from the single family homes to the south and the noise, traffic and visual
pollution attributed to the abutting US-1 and I-95 expressways.
CONCLUSION
In light of the foregoing, the Comprehensive Plan amendment to LDMR and Rezoning to
T4-O is appropriate for the Property due to its location, is in scale with the surrounding area, and
is not compatible with the established land use pattern in the area. Please note that pursuant to
Article 7.1.2.8(c) (2) (g) of Miami 21, attached hereto as Exhibit "A", we provide an analysis of

general planning principles and the goals and objectives of the City's Comprehensive Plan
finding that the proposed Comprehensive Plan Amendment and Rezoning of the Property are in
conformity with the Comprehensive Plan, the established land use pattern for the adjacent
properties in the area, and in scale with the needs of the neighborhood. Specifically, the attached
analysis supports the Applicant's proposed Comprehensive Plan amendment and Rezoning as
consistent with Miami 21's intent and the zoning and comprehensive plan designations for the
adjoining properties and neighborhood.

Supporting Land Use Policies for Rezoning and Comprehensive Plan
Amendment for 2900 S. Miami Ave and 2890, 2900, 2920, 2940 & 2960 S.
Federal Highway, Miami, Florida
The rezoning and comprehensive plan amendments are consistent with the
following:
Goal LU-1: Maintain a land use pattern that (1) protects and enhances the
quality of life in the City's neighborhoods; (2) fosters redevelopment and
revitalization of blighted or declining areas; (3) promotes and facilitates
economic development and the growth of job opportunities in the city; (4)
fosters the growth and development of downtown as a regional center of
domestic and international commerce, culture and entertainment; (5) promotes
the efficient use of land and minimizes land use conflicts while protecting and
preserving residential sections within neighborhoods; (6) protects and conserves
the city's significant natural and coastal resources; and (7) protects the integrity
and quality of the City's existing neighborhoods by insuring public notice, input
and appellant rights regarding changes in existing zoning and land use
regulations.
• The proposed FLUM Amendment will protect and enhance the
neighborhood while fostering revitalization in the area. The proposed
redevelopment will obviate the unsafe condition caused by the current
configuration. This promotes the efficient use of land while minimizing
conflicts.
Policy LU-1.1.7: Land development regulations and policies will allow for the
development and redevelopment of well -designed mixed -use neighborhoods
that provide for the full range of residential, office, live/work spaces,
neighborhood retail, and community facilities in a walkable area and that are
amenable to a variety of transportation modes, including pedestrianism,
bicycles, automobiles, and mass transit.
• The current configuration causes an incompatible pedestrian/vehicular
interchange, and the proposed FLUM amendment and site plan will
create a more walkable area by eliminating the pedestrian conflict and
providing additional landscaping to enhance the pedestrian realm.
Policy LU-1.1.11: The City hereby adopts designation of the City, excluding
Virginia Key, Watson Island and the uninhabited islands of Biscayne Bay, that
have a land use and zoning classification of Conservation, as an Urban Infill
Area pursuant to Miami -Dade County's designation of an Urban InfiII Area lying

generally east of the Palmetto Expressway and including all of the City of Miami.
Within this area, the concentration and intensification of development around
centers of activity shall be emphasized with the goals of enhancing the livability
of residential neighborhoods and the viability of commercial areas. Priority will
be given to infill development on vacant parcels, adaptive reuse of
underutilized land and structures, the redevelopment of substandard sites,
downtown revitalization and the development of projects that promote public
transportation. Maintenance of transportation levels of service within this
designated Urban IntlII Transportation Concurrency Exception Area shall be in
accordance with the adopted Transportation Corridors level of service
standards and the City of Miami Person Trip Methodology as set forth in Policies
TR-1.1.2 and 1.1.3 of the Transportation Element of the MCNP.
• The proposed FLUM amendment will emphasize the livability of the
residential neighborhood by enhancing the current configuration to
alleviate an unsafe condition, redevelop a vacant parcel which fronts
two major thoroughfares leading into downtown, and creates an
appropriate redevelopment of a site at the entryway to the Brickell
Neighborhood.
Policy LU-1.3.15: The City will continue to encourage a development pattern
that enhances existing neighborhoods by developing a balanced mix of uses
including areas for employment, shopping, housing, and recreation in close
proximity to each other.
• The proposed residential project and FLUM amendment are located
between the Brickell Neighborhood and Coconut Grove, with
employment, shopping, and recreation easily accessible.
Policy LU-1.6.9: The City's land development regulations will establish
mechanisms to mitigate the potentially adverse impacts of new development
on existing neighborhoods through the development of appropriate transition
standards and buffering requirements.
• The proposed development provides an appropriate buffer between
dissimilar uses.
Objective LU-1.7: Ensure that the Miami Comprehensive Neighborhood Plan is
updated as needed to meet changing conditions and, improve its effectiveness
and success.
• The proposed FLUM amendment updates the Future Land Use Map to
reflect the changing conditions and alleviate an unsafe situation currently
existing.

Policy HO-2.1.2: The City will continue to revise residential zoning district
regulations to provide greater flexibility for the design and development of a
variety of contemporary housing types and mixed -use developments with the
application of new higher density zoning in accordance with neighborhood
specific design and development standards that might be adopted as a result
of amendments to the City's land development regulations and other
neighborhood planning initiatives.
• The proposed FLUM amendment and site plan provide greater flexibility
for the design and development, and provide contemporary housing at
the Property, while seeking to create a safer environment for the residents,
pedestrians, and drivers.

The rezoning request, as referred by the Office of Zoning, is subject to review for compliance with the
requirements of the Miami Comprehensive Neighborhood Plan (MCNP), the City of Miami Code of
Ordinances, and Miami 21 Code, as well as other applicable county and state regulations.
The following comments were generated based on the Pre -Application meeting held with the applicant
and representatives of Div. of Land Development and the Office of Zoning on Monday, December 05,
2016, to discuss the request.
GENERAL INFORMATION / ALTERNATE REQUESTS:
This request, as proposed, is looking to secure a hearing in the next rezoning cycle, which last date
for Pre -application meeting is Monday, December 05, 2016.
The subject property consist of seven parcels owned by 3 different owners comprising

Request purpose:
The owners collectively referred as "The Applicant" proposes to rezone the subject parcels, or
portion of them, currently designated with T3-R (Sub -Urban Transect Zone- Restricted) to T4-O
(General Urban Transect Zone - Open), however, the letter of intent does not make reference to the
overlay.
Criteria
A Rezoning, pursuant to Miami 21, Article 7, Section 7.1.2.8 (c), seeks to allow an amendment to
the Zoning Atlas of Ordinance No. 13114, as amended, by changing the zoning classification as
requested above. Clarification on the intent to modify the overlay need to be provided.
It is found that the requested rezoning requires for a land use amendment, hence a separate
application for a Land Use amendment as a companion item need to be submitted as companion
item, as follow:

The Division of Land Development of the Planning and Zoning Department confirms the
applicant may submit an application of rezoning with the following conditions:
1. During the meeting, staff requested the applicant to provide all the documentation required for
rezoning including appropriate surveys for each request as provided for the application to
submit, drafted covenant in lieu of unity of title, as well as the restrictive covenant, in Word
version to be reviewed for correctness by City Attorney, and a narrative containing the purpose
of the rezoning of the properties involved.
2. The required surveys must provide Lot size and dimensions, including: Frontages, deep, and
widths.
3. The rezoning deadline to submit a complete application is January 13, 2017.

Welcome to the City of Miami! This application is intended to serve as a guide in assisting you
with our public hearing process. Please feel free to contact us, should you have any questions.
There is no deadline to submit this application as it is presented semi-annually to the Planning,
Zoning and Appeals Board and the City Commission. The application submittal date is the
date stamped by Hearing Boards' staff on this page. The responses to this application must
be typed and signed in black ink. All pertinent and accurate information/documentation; i.e.,
the plans, reports, exhibits, shall be presented at the time of filing, in addition to the paid receipt.
The applicant is responsible for the accuracy of the information contained in the application and
all supporting materials. Should you wish, you could bring the materials to our office for review
prior to submittal to ensure completeness.
You will be responsible, if needed, to bring an interpreter for the English language to any
presentation before city boards, committees and the city commission. A valid power of attorney
will be required if neither applicant or legal counsel representing the applicant execute the
application or desire to make a presentation before city boards, committees and the city
commission. All documents, reports, studies, exhibits (8%x11") or other materials submitted
during this process will be kept as part of the record. Any documents offered to the Planning,
Zoning and Appeals Board and the City Commission, which have not been provided fifteen (15)
days before the meeting as part of the agenda materials will be entered into the record at the
discretion of the aforementioned Board and Commission.
