A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
PURSUANT TO SECTION 18-82(A) OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, CLASSIFYING ARTWORK PURCHASED WITH
CITY OF MIAMI FUNDS BY THE DISTRICT 2 OFFICE, AS MORE
PARTICULARLY DESCRIBED IN EXHIBIT "A," ATTACHED AND
INCORPORATED, AS CATEGORY "A" SURPLUS STOCK; FURTHER
DONATING SAID ARTWORK TO KROMA ART SPACE & STUDIOS, A
COMMUNITY ARTS NONPROFIT TO SUPPORT ITS MISSION; AUTHORIZING
THE CITY MANAGER TO EXECUTE ANY AND ALL NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO
EFFECTUATE SAID DONATION.

WHEREAS, Kroma Art Space & Studios ("KROMA") is a community arts nonprofit and
collective art space located on Grand Avenue in the heart of Coconut Grove consisting of
eighteen (18) artists' studios and a communal gallery space whose mission is to serve as an
affordable, contemporary space for artists who create works of art which commemorate
Coconut Grove's rich past, present, and future; and
WHEREAS, the District 2 Commission Office purchased photography by artist Robert
Sullivan of Miami ("Artwork") for the District 2 Office with City of Miami ("City") funds and would
now like to donate said Artwork as surplus stock to KROMA for its upcoming exhibit entitled
"Pursuing Magic;" and
WHEREAS, to support KROMA's mission, the City wishes to donate the Artwork; and
WHEREAS, once this donation is approved, the Artwork will be auctioned off in January
2018 by KROMA; and
WHEREAS, this donation will serve a public purpose of supporting and enhancing the
community programs related to the arts in the City; and
WHEREAS, Section 18-82(a) of the Code of the City of Miami, Florida as amended
("City Code"), entitled "Disposal of Surplus City -Owned Personal Property," provides that
surplus property declared as Category "A" surplus stock shall be available for disposition as the
City's contribution or the City's commitment in support of a public purpose, which may include
community, civic, or social service programs as may be authorized by the City Commission; and
WHEREAS, the City's Chief Procurement Officer has declared the Artwork as Category
"A" surplus stock pursuant to Section 18-82(a) of the City Code;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Pursuant to Section 18-82(a) of the City Code, the Artwork purchased with
City funds by the District 2 Office, as more particularly described in Exhibit "A," attached and
incorporated, is classified as Category "A" surplus stock.
Section 3. The Artwork is hereby donated to KROMA, a nonprofit organization, to
support the organization's community mission.
Section 4. The City Manager is authorized' to execute any and all necessary
documents, in a form acceptable to the City Attorney, to effectuate said donation.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by City Commission.
