HomeMy WebLinkAboutR-18-0012City of Miami Resolution R-18-0012 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 3332 Final Action Date: 1/11/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A COMBINED VOLUNTARY COOPERATION AND OPERATIONAL ASSISTANCE MUTUAL AID AGREEMENT ("MUTUAL AID AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI ("CITY") AND FLORIDA INTERNATIONAL UNIVERSITY ("FIU") TO RECEIVE AND EXTEND MUTUAL AID IN THE FORM OF LAW ENFORCEMENT SERVICES AND RESOURCES TO THE FIU POLICE DEPARTMENT TO ENSURE PUBLIC SAFETY AND ADEQUATELY RESPOND TO INTENSIVE SITUATIONS, INCLUDING BUT NOT LIMITED TO, NATURAL AND MAN-MADE DISASTERS AND EMERGENCIES AS DEFINED IN PART 1, CHAPTER 23, FLORIDA STATUTES; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, AND MODIFICATIONS TO THE MUTUAL AID AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY FOR SAID PURPOSE. WHEREAS, there are natural and man-made challenges faced by the Florida International University's Police Department ("FIUPD") and other police departments that are, or are likely to be, beyond the control of the services, personnel, equipment, or facilities of the Florida International University ("FIU"); and WHEREAS, the City of Miami ("City") and FIU wish to enter into a Combined Voluntary Cooperation and Operational Assistance Mutual Aid Agreement ("Mutual Aid Agreement") to ensure that preparation and resources from their respective law enforcement agencies will be adequate to address natural and man-made challenges, to protect the public peace and safety, and to preserve the lives and property of City residents as well as the patrons and students of FIU; and WHEREAS, the City and FIU have the authority under the Florida Mutual Aid Act, Chapter 23, Part 1, Sections 23.12-23.127, Florida Statutes, to enter into mutual aid agreements; and WHEREAS, the City and FIU have the authority under the Florida Interlocal Cooperation Act of 1969, promulgated under Section 163.01, Florida Statutes, to enter into interlocal agreements for purposes of permitting local governmental units to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and thereby provide services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geographic, economic, population, and other factors influencing the needs of the local communities; City of Miami Page 1 of 2 File ID: 3332 (Revision:) Printed On: 3/28/2025 File ID: 3332 Enactment Number: R-18-0012 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute a Mutual Aid Agreement, in substantially the attached form, between the City and FIU to receive and extend mutual aid in the form of law enforcement services and resources to FIUPD to ensure public safety and adequately respond to intensive situations, including, but not limited to, natural or man-made disasters or emergencies as defined under the Florida Mutual Aid Act of Chapter 23, Part I of the Florida Statutes. Section 3. The City Manager is further authorized to negotiate and execute any and all other documents including any amendments, renewals, and modifications to the Mutual Aid Agreement, in a form acceptable to the City Attorney, as may be necessary for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndezCiity Httor 1/2/2018 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
