HomeMy WebLinkAboutR-18-0006City of Miami Resolution R-18-0006 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 3338 Final Action Date: 1/11/2018 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5) AFFIRMATIVE VOTE, RATIFYING, CONFIRMING, AND APPROVING THE CITY MANAGER'S WRITTEN FINDING OF AN EMERGENCY, ATTACHED AND INCORPORATED AS ATTACHMENT "A," WAIVING COMPETITIVE SEALED BIDDING PROCEDURES, AND RETROACTIVELY APPROVING THE SELECTION OF GLOBAL RENTAL CO., INC. FOR THE RENTAL OF TWO (2) BUCKET TRUCKS FOR THE DEPARTMENT OF PUBLIC WORKS; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL SUBSEQUENT DOCUMENTS, INCLUDING ANY EXTENSIONS AND MODIFICATIONS TO THE EXISTING AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY FOR SAID PURPOSE. WHEREAS, the City of Miami ("City") Department of Public Works ("Public Works") owns various bucket trucks, two (2) of which were rendered inoperable, thereby requiring the temporary rental of two (2) bucket trucks in order to provide timely service and keep up with demand; and WHEREAS, prior to the expiration of the three (3) month rental agreement, the City was struck by Hurricane Irma and because of the accumulating storm debris, Public Works requested to extend the rental agreement for an additional three (3) months; and WHEREAS, the initial three (3) month rental agreement, after consulting numerous heavy equipment rental vendors, with Global Rental Co., Inc. ("Global"), in the amount of $17,082.00, was approved pursuant to the Chief Procurement Officer's authorization under Section 18-77 of the Code of the City of Miami, Florida ("City Code"), entitled "Authority of the Chief Procurement Officer"; and WHEREAS, an additional three (3) months in an additional amount of $15,882.00 for an estimated aggregate amount of $32,964.00, surpassed the Chief Procurement Officer's authority as it exceeded $25,000.00 and required the City Manager's approval pursuant to Section 18-90 of the City Code on an emergency basis; and WHEREAS, the City Manager, pursuant to Section 18-90 of the City Code, approved an emergency bid waiver to provide for the rental of two (2) bucket trucks and is requesting ratification by the City Commission; and WHEREAS, the City Manager, pursuant to Section 18-90 of the City Code, made an emergency finding and approved an emergency bid waiver selecting Global for the provision of two (2) bucket trucks for a rental amount in aggregate of $32,964.00 as an emergency procurement; City of Miami Page 1 of 2 File ID: 3338 (Revision:) Printed On: 3/28/2025 File ID: 3338 Enactment Number: R-18-0006 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, pursuant to Section 18-90 of the City Code, the City Manager's emergency finding, attached and incorporated as Attachment "A," is ratified, retroactively approved, and confirmed; the requirements for competitive sealed bidding procedures are waived; and the emergency procurement of the rental of the two (2) bucket trucks from Global for Public Works is approved. Section 3. The City Manager to authorized' to negotiate and execute any and all subsequent documents, including any extensions and modifications to the existing agreement, in a form acceptable to the City Attorney, as may be necessary for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' APPROVED AS TO FORM AND CORRECTNESS: -- end" ez, City ttor 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
