HomeMy WebLinkAboutO-13732City of Miami Ordinance 13732 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 3145 Final Action Date: 1/11/2018 AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING THE ZONING ATLAS OF ORDINANCE NO. 13114, AS AMENDED, BY CHANGING THE ZONING CLASSIFICATION FROM "T5-O," URBAN CENTER -OPEN, TO "T6-8-O," URBAN CORE —OPEN, FOR THE PROPERTIES LOCATED AT APPROXIMATELY 704 SOUTHWEST 7 AVENUE AND 712, 716, 720, AND 734 SOUTHWEST 7 STREET, MIAMI, FLORIDA, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A"; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") at its meeting on October 16, 2017, following an advertised public hearing, adopted Resolution No. PZAB-R-17-069 by a vote of eleven to zero (11-0), Item No. PZAB.9, recommending approval of the proposed zoning change as stated herein; and WHEREAS, 701 Associates, LLC and Miami Automotive Retail, Inc. (collectively, "Applicant") has submitted an application to change the zoning classification from "T5-O," Urban Center —Open, to "T6-8-O," Urban Core —Open, for the properties located at approximately 704 Southwest 7 Avenue and 712, 716, 720, and 734 Southwest 7 Street, Miami, Florida, as more particularly described in Exhibit "A," attached and incorporated; and WHEREAS, the proposed zoning change is in harmony with the established land use pattern and the adjacent and nearby districts; and WHEREAS, the proposed zoning change will not increase the intensity and density of the subject properties, which will be consistent with the current neighborhood context; and WHEREAS, the proposed zoning change is not out of scale with the needs of the neighborhood and the City of Miami ("City"); and WHEREAS, the proposed zoning change will maintain the same or similar population density pattern and thereby does not increase or overtax the load on public facilities such as schools, utilities, and streets; and WHEREAS, the proposed zoning change and potential development is in keeping with the goals, objectives, and policies of the City's Comprehensive Neighborhood Plan; and WHEREAS, the City Commission, after careful consideration of this matter, deems it in the best interest of the general welfare of the City and its inhabitants to approve this proposed zoning change; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 3145 (Revision:) Printed On: 3/28/2025 File ID: 3145 Enactment Number: 13732 Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Zoning Atlas of Ordinance No. 13114, as amended, is further amended by changing the zoning classification from "T5-O," Urban Center —Open, to "T6-8-O," Urban Core —Open, for approximately 0.86 acres (37,500 square feet) of land located at approximately 704 Southwest 7 Avenue and 712, 716, 720, and 734 Southwest 7 Street, Miami, Florida, as more particularly described in Exhibit "A." Section 3. This Ordinance shall become effective thirty-one (31) days after second reading and adoption thereof, pursuant and subject to Section 163.3187(5)(c), Florida Statutes.'
