Please allow this letter to serve as the required letter of intent in connection with requests for a land use plan amendment change and rezoning of the Property. Description of Property. The Property is located on the south side of SW 7 Street between SW 7 Avenue and SW 8 Avenue. Miami -Dade County's Office of the Property Appraiser identifies the Property through the following five (5) Miami -Dade Tax Folio Nos. 01-0204-060-1010, 01-0204-060-1020, 01-0204-060-1030, 01-0204-060-1040, 01-0204-060-1050. The Property is approximately 37,500 square feet (0.86 acres) in size, with approximately two hundred fifty feet (250') of frontage on SW 7 Street. The Property consists of two (2) vacant lots and three (3) lots with two-story multi -family structures in various states of disrepair. The Property is designated as "Medium Density Multifamily Residential" by the City's Miami Neighborhood Comprehensive Plan ("MNCP"). See Figure 1. Future Land Use Map Excerpt. The Applicant seeks to amend the MCNP designation of the Property from "Medium Density Restricted Commercial" to "Restricted Commercial." Additionally, the Applicant seeks to implement the proper land use by rezoning the Property from "T5-O, Urban Center Zone" to "T6-8-O, Urban Core Zone." Criteria. Section 7.1.2.8(c) of Miami 21 states that a rezoning of land will only be considered where the proposal involves an extension of an existing transect boundary, unless the rezoning involves at least 40,000 square feet of land area or 200 feet of street frontage. Here, the Property meets and exceeds the street frontage requirement along SW 7 Street. Further, Section 7.1.2.8(f) of Miami 21 provides the criteria for amendments to Miami 21. The provision provides as follows "[f]or all amendments: The provision provides as follows "[f] or all amendments: (a) The relationship of the proposed amendment to the goals, objectives and policies of the Comprehensive Plan, with appropriate consideration as to whether the proposed change will further the goals, objectives and policies of the Comprehensive Plan; the Miami 21 Code; and other city regulations. (b) The need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary. The proposed amendment is consistent with the goals, objectives and policies of the MNCP. For instance, Objective LU-1.3 states as follows: The City will continue to encourage commercial, office and industrial development within existing commercial, office and industrial areas; increase the utilization and enhance the physical character and appearance of existing buildings; encourage the development of well -designed, mixed -use neighborhoods that provide for a variety of uses within a walkable area in accordance with neighborhood design and development standards adopted as a result of the amendments to the City's land development regulations and other initiatives; and concentrate new commercial and industrial activity in areas where the capacity of existing public facilities can meet or exceed the minimum standards for Level of Service (LOS) adopted in the Capital Improvement Element (CIE). The Restricted Commercial future land use designation and the T-6-O zoning designation are compatible with the existing development and land use and zoning patterns within this area. As Figure 1. and Figure 2. illustrate, within a half -mile radius of the Property between SW 8 Street north to SW 7 Street, properties abutting and adjacent to the Property are designated Restricted Commercial and zoned T6-8-O. Further, Policy LU-1.1.7 states: "Land development regulations and policies will allow for the development and redevelopment of well -designed mixed -use neighborhoods that provide for the full range of residential, office, live/work spaces, neighborhood retail, and community facilities in a walkable area and that are amenable to a variety of transportation modes, including pedestrianism, bicycles, automobiles, and mass transit;" and Policy LU-1.3.15 states: "The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other." Approval of this application will encourage commercial development in a mixed use, walkable area where existing public facilities, including high frequency bus routes, meet or exceed the minimum standards. It's important to note that the Property is located within an officially recognized Transit Corridor, pursuant to the City's Transit Oriented Development and Transit Corridor Map. Further, approval of this application would encourage a development pattern, in line with the existing context, that would enhance the existing neighborhood by continuing to develop a balanced mix of uses and employment opportunities. Finally, approval of the Applicant's request will allow for enhanced utilization of the Property and a more appropriate transition from SW 7 Street to SW 8 Street. Therefore, the Applicant's request maintains the goals of Miami 21 to preserve neighborhoods and continue providing for transitions in intensity. PLANNING AND ZONING DEPARTMENT PROJECTS REVIEW MEETING Rezoning 701 Associates, LLC 704 SW 7 Avenue and 712, 716, 720, and 734 SW 7 Street PR-17-107 ZONING DESIGNATION: T5-O NET DISTRICT: LITTLE HAVANA JUNE 14, 2017 The rezoning request is subject for compliance with the requirements of the Miami Comprehensive Neighborhood Plan (MCNP), the City of Miami Code of Ordinances, and Miami 21 Code, as well as other applicable county and state regulations. The following comments were generated based on the pre -application conference held with the applicant and representatives of the City of Miami Planning and Zoning Department's Land Development Division and the Office of Zoning on June 8, 2017. GENERAL INFORMATION: This request, as proposed, is seeking to secure a hearing in the September 2017 rezoning and FLUM cycle, which last date for pre -application meeting was Monday June 12, 2017 to meet one of the requirement for application submittal. The subject potential rezoning application consist of five (5) parcels of approximately 37,366 square feet (0.86 acres). The five parcels are zoned T5-O (Urban Center Transect — Limited) with a Land Use designation of Medium Density Restricted Commercial. Purpose/Request: The applicant proposes a rezoning from T5-O to T6-8-O (Urban Core Transect - Open), which will also require a Miami Neighborhood Comprehensive Plan (MNCP) amendment to Restricted Commercial or General Commercial. Criteria Pursuant to Article 7, Section 7.1.2.8.a.3. and Section 7.1.2.8.c.1, the requested parcels for rezoning does meet the minimum 200 feet of street Frontage on one (1) street to allow submittal for a zoning change, and the requested rezoning is also successional with the change of zoning request from T5- 0 to T6-8-0. The Division of Land Development of the Planning and Zoning Department confirms the applicant may submit an application of rezoning with the following conditions: 1. The rezoning and MNCP application must be submitted to the Office of Hearing Boards on or before July 21, 2017 deadline.
