HomeMy WebLinkAboutStaff Report and Business Impact Statement■ E CO 0 >N • o Planning Department Staff Report and Business Impact Statement Non- Conforming Uses - Structures 50 years old or older Purpose: The purpose of the this amendment is to allow for structures 50 years old or older to apply for a non- conforming use Exception to be able to utlize the Use for which the building was originally designed and allows for National, State and Local designated structures to apply via a Warrant with a recommendation from Historic and Enviromental Preservation Board to ultilize the Use was originally designed. Estimated Direct Economic Impact: • There are no direct compliance costs that will be incurred by the ordinance amendment. • There are no new charges or fees that businesses will be subject to or financially responsible for based on the ordinance amendment. • This will have a positive impact on City revenues as it creates an opportunity for businesses to apply for additional Uses, otherwise not allowed. Estimated Number of Businesses to be Impacted: The estimated number of businesses to be impacted by this amendment cannot be determined due to the ambiguities created by the voluntary nature of the amendment. Additional Information: This amendment furthers Goal LU-2, 2.3 and 2.4 of the Miami Neighborhood Comprehensive Plan that states that the City will preserve and protect the heritage of the City of Miami through the identification, evaluation, rehabilitation, adaptive reuse, restoration, and public awareness of Miami's historic and archeological resources and meets Miami 21's Intent established in Article 2.1.2 by meeting the conservation goal of Preserving Neighborhoods, Historical Resources and the natural environment. Futhermore, 50 years or older conicide with the Secretary of Interior Stanadrds general rule for esblishing historic properties. Addtionally, It is efficient and environmentally sound to allow structures to fulfill their intended function for their intended lifespan so as not to demolish and discard them prematurely and it is necessary to examine any prolongation of a non -conforming use in order to prevent or mitigate against any potential adverse impacts and ensure compatibility with its present context. Recommendation: Approval
