RECREATION/IN GENERAL," BY CREATING SECTION 38-38, TITLED "NAMING OF
RUBEN DARIO PARK"; FURTHER REPEALING CHAPTER 38/ARTICLE I/ SECTION
38-29 OF THE CITY CODE, TITLED "NAMING OF RUBEN DARIO PARK" TO
REMOVE DUPLICATIVE PARK NAMINGS; FURTHER DIRECTING THE CITY
MANAGER TO TAKE ANY AND ALL ACTIONS NECESSARY TO EFFECTUATE THE

WHEREAS, the City of Miami ("City") owns land consisting of approximately 155,700
square feet located at 971 Northwest 2 Street, Miami, Florida, Folio No. 01-4138-003-0690
("Park"); and
WHEREAS, the Park was formerly known as "Henderson Park"; and
WHEREAS, Felix Ruben Garcia Sarmiento, widely known as Ruben Dario ("Dario"), was
a Nicaraguan poet, journalist, and diplomat who initiated the 19th century Spanish-American
literary movement known as modernismo, which gained significant cultural momentum
throughout the literary worlds of Latin America and Europe; and
WHEREAS, Dario is considered by many to be one of the greatest poets who ever wrote
in Spanish, experimenting with many forms of verse and introducing more metrical innovations
than any other Spanish -language poet; and
WHEREAS, the City Commission wishes to honor Dario because he led one of the most
profound poetic revolutions in the history of Spanish literature; and
WHEREAS, the City Commission has determined that it is appropriate for the Park to be
named "Ruben Dario Park" and for other duplicative park namings to be repealed;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
hereby adopted by reference and incorporated as if fully set forth in this Section.

Section 2. Chapter 38/Article I of the Code of the City of Miami, Florida, as amended, is
further amended in the following particulars:1
"CHAPTER 38
PARKS AND RECREATION
ARTICLE I. IN GENERAL
Sec. 38-38. Naming of Ruben Dario Park.
The parcel of land consisting of approximately 155,700 square feet located at 971
Northwest 2 Street, Miami, Florida shall be named "Ruben Dario Park."

Section 3. Chapter 38/Article I/Section 38-29 of the Code of the City of Miami, Florida, as
amended, is hereby repealed:1
"CHAPTER 38
PARKS AND RECREATION
ARTICLE I. IN GENERAL
Sec. 38-29. - ReservedNaming of Rub n Darin Part
The assemblage of land consisting of approximately three to five acres located at 1680
Northwest 5 Street, 1610 Northwest 6 Street, 1651 Northwest 5 Street, 1649 Northwest 5

Section 4. The City Manager is directed to take any and all administrative actions
necessary to effectuate the renaming of the Park.
Section 5. If any section, part of a section, paragraph, clause, phrase or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective immediately after final reading and
adoption thereof.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)

become effective immediately upon override of the veto by the City Commission or upon the effective
date stated herein. whichever is later.
