Background of Item: The Florida Department of Transportation ("FDOT") is the owner of certain submerged land located north of Interstate 395 ("MacArthur Causeway"), as described in Exhibit "A" ("Property). The FDOT originally obtained the Property from the City of Miami ("City") by deed recorded as Official Records Book 1697 Page 380 in order to build the MacArthur Causeway. The FDOT has determined the Property is no longer needed for the continued maintenance of the MacArthur Causeway and has agreed to convey the Property to the City. The City anticipates including a portion of the Property in a Submerged Lands Lease and is currently negotiating such lease with the adjacent riparian upland owner, Resorts World Miami, LLC ("Resorts World"), as authorized under Section 29-B of the Charter and Chapter 18, Article XI of the City of Miami Code of Ordinances. Resorts World intends to develop and operate a marina which shall be located partly on submerged land currently owned by the City and partly on the Property. WHEREAS, the Florida Department of Transportation ("FDOT") is the owner of certain submerged land located north of Interstate 395 ("MacArthur Causeway"), as more particularly described in Exhibit "A" of the FDOT Quitclaim Deed ("Deed") to the City of Miami ("City"); and WHEREAS, FDOT originally obtained the submerged land from the City by deed as recorded in the Official Records Book 1697, Page 380 for the construction of the MacArthur Causeway; and WHEREAS, FDOT has determined the submerged land is no longer needed for the continued maintenance of the MacArthur Causeway and has agreed to convey the submerged land back to the City; and WHEREAS, the City anticipates including a portion of the submerged land in a Submerged Lands Lease and is currently negotiating the same with the adjacent riparian upland owner, Resorts World Miami, LLC ("Resorts World"), as authorized pursuant to Section 29-B of the Charter of the City of Miami, Florida and Chapter 18, Article XI of the Code of the City of Miami, Florida, as amended; and WHEREAS, Resorts World intends to develop and operate a marina which will be located partly on submerged land currently owned by the City and partly on the submerged land covered by the Deed; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to accept and execute the Deed, in substantially the attached form, for the donation and conveyance of the submerged land from FDOT to the City. Section 3. The City Manager is further authorized to negotiate and execute all other documents, in a form acceptable to the City Attorney, for said purpose. Section 4. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
