HomeMy WebLinkAboutR-17-0609City of Miami Resolution R-17-0609 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 3359 Final Action Date: 12/14/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING THE PLAT ENTITLED "BATTERSEA WOODS," A REPLAT AND A SUBDIVISION IN THE CITY OF MIAMI OF THE PROPERTY DESCRIBED IN "ATTACHMENT 1," SUBJECT TO SATISFACTION OF ALL CONDITIONS REQUIRED BY THE PLAT AND STREET COMMITTEE AS SET FORTH IN EXHIBIT "A," ATTACHED AND INCORPORATED, AND THE PROVISIONS CONTAINED IN SECTION 55-8 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; ACCEPTING THE DEDICATIONS SHOWN ON THE PLAT; AND AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT AND CAUSE THE RECORDATION OF THE PLAT IN THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA. WHEREAS, the Plat and Street Committee ("PSC"), established pursuant to Chapter 55 of the Code of the City of Miami, Florida, as amended ("City Code"), at its meeting of September 3, 2015, reviewed the proposed plat entitled "BATTERSEA WOODS" and determined that all technical requirements have been met; and WHEREAS, the PSC recommends the acceptance of the aforesaid plat; and WHEREAS, the Circuit Court of the 11 th Judicial Circuit in and for Miami -Dade County, Florida, Appellate Division Case No. 16-402 AP (Exhibit "D"), has granted a Joint Motion to Relinquish Jurisdiction, remanding the matter of the aforesaid plat to the Miami City Commission for further consideration and approval; and WHEREAS, the applicant for the proposed plat entitled "BATTERSEA WOODS" proffered that, upon approval of said plat, the applicant will execute and record a Unity of Title, which shall be deemed a covenant running with the land, providing that Lots 3 and 4 of said plat shall be considered one plot and parcel of land and that no portion of such plot and parcel of land shall be sold, transferred, devised, or assigned separately, except in its entirety as one plot or parcel of land; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The plat entitled "BATTERSEA WOODS," a replat and a subdivision of the property described in "Attachment 1," which plat by reference, in substantially the attached form and subject to satisfaction of all conditions required by the PSC as set forth as Exhibit "A," attached and incorporated, and the provisions contained in Section 55-8 of the City Code, is accepted. The dedications shown on the aforesaid plat together with the dedications to the perpetual use of the public of all existing and future planting, trees and shrubbery on said dedications are hereby accepted and confirmed by the City of Miami, Florida. Section 4. The City Manager and City Clerk are authorized' and directed to execute the aforesaid plat and cause the same to be recorded in the Public Records of Miami -Dade County, Florida. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: Barnaby I_. Min, Deputy City Attorney 1/11/2018 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
