HomeMy WebLinkAboutR-17-0602City of Miami Resolution R-17-0602 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 3386 Final Action Date: 12/14/2017 A RESOLUTION OF THE MIAMI CITY COMMISSION RESCINDING RESOLUTION NO. 17-0545, ADOPTED NOVEMBER 16, 2017, WHICH ALLOCATED $179,000.00 FROM THE DISTRICT 3 DISCRETIONARY SPECIAL REVENUE ACCOUNT TO A HUMAN RESOURCE SPECIAL REVENUE ACCOUNT TO BE USED FOR THE TRANSITION OF DISTRICT 3 PERSONNEL PURSUANT TO ADMINISTRATIVE POLICY MANUAL ("APM") 1- 02 DATED FEBRUARY 5, 2002 FOR UP TO ONE (1) YEAR; ENACTING THIS NEW RESOLUTION RETURNING FUNDS IN THE AMOUNT OF $171,800.00 FROM THE HUMAN RESOURCE SPECIAL REVENUE ACCOUNT BACK TO THE DISTRICT 3 DISCRETIONARY SPECIAL REVENUE ACCOUNT IN ORDER TO REIMBURSE THE DISTRICT 3 ACCOUNT SINCE SAID ALLOCATION EXCEEDED THE THREE (3) MONTH TRANSITION PERIOD PERMITTED IN APM 1-02; RECOMMENDING THE CITY MANAGER TAKE ALL STEPS NECESSARY TO ENSURE THAT THE POLICIES OF APM 1-02 AND THIS RESOLUTION ARE COMPLIED WITH. SPONSOR(S): Commissioner Joe Carollo WHEREAS, the purpose of Administrative Policy Manual ("APM") 1-02, dated February 5, 2002, is to provide an official policy relating to the transition of personnel upon the end of the term of an elected official; and WHERAS, APM 1-02 states that the affected employees will be appointed to a temporary position for a period of up to three (3) months; and WHERAS, the City Commission adopted Resolution No. 17-0545 on November 16, 2017, which permitted the affected employees to be appointed to a temporary position for up to one (1) year, provided that funds are available; and WHEREAS, APM 1-02 only permits for a transition period of up to three (3) months, provided that funds are available; and WHEREAS, it is the City Commission's will to follow the language in APM 1-02; and WHEREAS, reducing the transition time from one (1) year to three (3) months will result in the return of $171,800.00 in funds back to the District 3 Discretionary Special Revenue Account, pursuant to APM 1-02; and WHEREAS, during the transition period, City of Miami ("City") administrators will make every effort to assist the affected employees in identifying suitable vacant position(s); however, it will be the responsibility of the employees to apply and compete for said positions in accordance with City policies and procedures; City of Miami Page 1 of 2 File ID: 3386 (Revision:) Printed On: 3/27/2025 File ID: 3386 Enactment Number: R-17-0602 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Resolution No. 17-0545, adopted November 16, 2017, is rescinded, which allocated $179,000.00 from the District 3 Discretionary Special Revenue Account to a Human Resource Special Revenue Account to be used for the transition of District 3 personnel pursuant to APM 1-02 dated February 5, 2002 for up to one (1) year. Section 3. $171,800.00 of the funds that were allocated to the Human Resource Special Revenue Account in Resolution No. 17-0545 will be returned to the District 3 Discretionary Special Revenue Account. Section 4. The City Commission recommends that the City Manager take all steps necessary to ensure that the policies of APM 1-02, and this Resolution are complied with. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'
