A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN OFF -SYSTEM
CONSTRUCTION AND MAINTENANCE AGREEMENT, IN SUBSTANTIALLY
THE ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION ("FDOT"), FOR IMPROVEMENTS ON STATE ROAD
968/SOUTHWEST 1 STREET FROM WEST OF SOUTHWEST 5TH AVENUE
TO SOUTHWEST 2ND AVENUE, MIAMI, FLORIDA, FOR RECONSTRUCTION
OF THE SOUTHWEST 1ST STREET BRIDGE, INCLUDING IMPROVEMENTS
ON ROADS NOT ON THE STATE HIGHWAY SYSTEM.
WHEREAS, the Florida Department of Transportation ("FDOT") has developed design
plans Financial Management ("FM") Project No. 424407-1 for State Road ("SR") 968/Southwest
1 Street from west of Southwest 5th Avenue to Southwest 2nd Avenue for the reconstruction of
the Southwest 1st Street Bridge ("Project") in the City of Miami ("City"); and
WHEREAS, FDOT intends to undertake and complete the Project, which includes work
on Southwest 5th Avenue, Southwest South River Drive and Southwest North River Drive, roads
not on the State Highway System, and entails the following improvements within the Project
Limits, hereinafter referred to as the "Local Roadway Improvements"; and
WHEREAS, the Project improvements on Southwest 5th Avenue include work along a
two hundred fifty foot (250') section of Southwest 5th Avenue, including the intersection of SR
968/Southwest 1st Street and Southwest 5th Avenue, Miami, Florida, the reconstruction of the
intersection ramp approach(es) along SW 5th Avenue coming up to SW 1st Street to the higher
roadway elevations along SW 1st Street East, as well as construction of new sidewalk, gravity
walls, handrail, drainage structures and storm sewer pipes; and
WHEREAS, the Project improvements on Southwest South River Drive include work
along a one hundred ninety foot (190') section of Southwest South River Drive that will be milled
and resurfaced to restore the asphalt surface to new condition after the bridge construction is
completed and construction of drainage structures and storm sewer pipes; and
WHEREAS, the Project improvements on Southwest North River Drive include a two
hundred foot (200') section of Southwest North River Drive that will be milled and resurfaced to
restore the asphalt surface to new condition after the bridge construction is completed and will
include construction of drainage structures and storm sewer pipes; and
WHEREAS, the Project improvements shall further include all activities associated with,
or arising out of the construction of the Local Roadway Improvements, further identified in
Exhibit 1, attached and incorporated; and

WHEREAS, the Off -System Construction and Maintenance Agreement establishes the
terms, conditions and responsibilities of the Department and the City to accomplish the
improvements on the City's streets; and
WHEREAS, the City agrees with the terms and conditions in the Off -System
Construction and Maintenance Agreement, attached and incorporated;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the Off -System Construction and
Maintenance Agreement, in substantially the attached form, with FDOT, for improvements on
SR 968/Southwest 1 Street from west of Southwest 5th Avenue to Southwest 2nd Avenue,
Miami, Florida, for reconstruction of the Southwest 1st Street bridge, that includes
improvements on roads not on the state highway system.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
