River Drive, Miami, Florida / Letter of Intent and Applications for Miami Neighborhood Comprehensive Plan Amendment and Rezoning Dear Francisco: On behalf of BL Miami River LLC, JF Miami River LLC, LAG Miami River LLC, CA Miami River LLC, LSG Miami River LLC, DF Miami River LLC and JMG Miami River LLC (collectively, the "Applicant"), owner of the properties located at 2222 and 2260 NW N. River Drive, Miami, Florida (collectively, the "Subject Property"), please accept the enclosed applications for a Miami Comprehensive Neighborhood Plan ("MCNP") amendment and rezoning (the "Applications") of the Subject Property. Please accept this correspondence as the Applicant's letter of intent and analysis pursuant to the requirement of Article 7, Section 7.1.2.8(c)(2)(g) of Miami 21. Specifically, the Applicant is requesting (1) a zoning change of the Subject Property from T3-O to T4-R pursuant to the successional zoning requirements of Article 7, Section 7.1.2.8 of Miami 21 and (2) and an amendment to the MCNP's Future Land Use Map ("FLUM") designation for the Subject Property from Duplex Residential ("DR") to Low Density Multifamily Residential ("LDMR") pursuant to the small scale amendment procedures of Florida Statutes, Section 163.3187. I. PROPERTY INFORMATION The Subject Property is located on the north bank of the Miami River, fronting NW North River Drive to the north, NW 22nd Avenue to the east and Curtis Park to the west. The Subject Property is located in the Allapatah neighborhood, adjacent to the Health District, areas which continue to experience rapid population growth and business expansion. The Subject Property has unparalleled access to varied transportation options, including the Miami River and the 836 Expressway to the south, NW 27th Avenue to the west, and the NW 22nd Avenue Bridge to the east. The Subject Property consists of platted lots E and F of the Washburn's Subdivision Plat, and lot A of Washburn's 2nd Addition Plat, as recorded in Plat Book 4, Page 112, and Plat Book 6, Page 1, respectively, of the Public Records of Miami -Dade County, Florida. Below is an aerial image depicting the location of the Subject Property and the surrounding area. According to the enclosed survey of the Subject Property prepared by Schwebke-Shiskin & Associates., dated May 17, 2017 (the "Survey"), the Subject Property's lot area is approximately 47,728 square feet or 1.096 acres. The Subject Property currently contains three (3) apartment buildings each consisting of two (2) stories. The existing multifamily structures located on the Subject Property are nonconforming. The Subject Property also has over 700 feet of frontage along the Miami River due to its unique peninsula shape with three waterfront frontages, and is currently improved with nearly 300 linear feet of wood docks and active boat slips. The Applicant seeks to redevelop the Subject Property into a pedestrian oriented residential community that enhances the public realm in conformance with the intent and goals of Miami 21. The proposed T4-R designation will bring the nonconforming uses on the Subject Property into compliance with Miami 21, as well as facilitate the creation of a compact, low density residential community along the Miami River in close proximity to some of the City's most important employment and entertainment centers which respects the area's residential character. Both Allapatah and the Health District are in great need of additional housing options to serve the thousands of individuals who work in the area. In addition, although not required by Miami 21, the Applicant intends to develop the Subject Property with a Riverwalk along the Subject Property's three waterfront frontages to further enhance accessibility to the Miami River and promote pedestrian connectivity. Flood Hazard Area Due to the Subject Property's location within the Coastal High Hazard Area, as depicted on the FLUM, the Applicant will comply with all applicable flood hazard regulations contained in Chapter 20, Flood Prevention, of the City's Code of Ordinances, including but not limited to compliance with 100-year flood elevation requirements. B. Waterfront Standards Based on Section 3.11 of Miami 21, waterfront properties are required to comply with enumerated Waterfront Standards. The Applicant will comply with the Waterfront Setback requirements contained in Section 3.11(a) for parcels within the T4-R transect. Further, although developments in the T4-R transect are exempt from the requirement to provide a Waterfront Walkway, the Applicant intends to provide a Riverwalk along the three (3) waterfront frontages of the Subject Property. C. Docks As detailed above, the Subject Property is currently improved with several docks and boat slips along the three (3) waterfront frontages. A copy of the active Marina Operating Permit ("MOP") issued by Miami -Dade County is attached as Exhibit "A". III. ANALYSIS FOR REZONING Under Miami 21, the current zoning designation of the Subject Property is T3-O. The Applicant requests to rezone the Property to the next intensity Transect Zone (T4-R) pursuant to the successional zoning requirements of Article 7, Section 7.1.2.8 of Miami 21. For the reasons outlined below, the proposed rezoning is appropriate for the Subject Property, meets the criteria established in Article 7, Section 7.1.2.8 of Miami 21 and, therefore, should be approved. 1. The proposed rezoning maintains the residential character of the area and creates a transition in density and intensity which is consistent with the goals of Miami 21. Article 7, Section 7,1.2.8(f}(2) of Miami 21 requires zoning changes to maintain the goals of Miami 21 and provide transitions in intensity and Building Height. The proposed rezoning of the Subject Property to T4-R will create the required transition between the T3 properties located north of the Subject Property, and the T5 properties located to the northeast, and the T6 parcels located directly to the east. The proposed successional rezoning from T3-O to T4-R provides an appropriate transition in height, density and intensity between the T5 and T6 zoning to the north and east, and the T3 Transect Zones as intended by Miami 21. The proposed rezoning of the Subject Property is compatible with the residential uses in the surrounding area. The residential areas directly surrounding the property consist primarily of single-family, duplex, triplex, and multifamily residential structures. The rezoning to T4-R maintains the residential character of the area as the T4-R Transect Zone consists primarily of MIA 185880855v2 GREENBERG TRAURIG, P.A. ■ ATTORNEYS AT LAW • WWW.GTLAW.COM residential uses. The T4-R Transect Zone permits only residential uses by right; it prohibits all commercial uses and requires special approvals (Warrants or Exceptions) for other uses such as Civic and Educational. Therefore, the proposed rezoning to T4-R will enhance the area's primarily residential urban fabric by allowing residential uses (which are permitted and dominate the area immediately surrounding the Subject Property). Additionally, rezoning to T4-R contemplates only slight potential increases in height and density which will not adversely impact the surrounding area. The T4-R zoning designation will only permit a minor increase in density (from a maximum of 9 units per acre to 36 units per acre) and height (from a maximum of two (2) Stories and 25 feet to three (3) Stories and 40 feet). Any potential impact development of the Subject Property may have will be alleviated by the Subject Property's unique location. As noted above, the Subject Property has three waterfront frontages, and is therefore not located adjacent to any other structures. Further, the frontage setbacks required by Miami 21 will ensure that the proposed slight increase in height and density will not. adversely impact the neighborhood. It is also important to note that the Subject Property is currently developed with twenty one (21) nonconforming multifamily units; the proposed rezoning will allow only a minimal increase from the already existing uses on the Subject Property. This rezoning will bring the Subject Property into compliance with Miami 21, while also contributing to the housing stock in this rapidly developing neighborhood. The proposed height and use limitations provided by the T4-R Transect Zone make the proposed rezoning compatible with neighboring uses and existing development patterns in the area. The proposed rezoning will only permit a slight increase in height and density over and above the already existing structures on the Subject Property. The size and scale of the neighboring uses, structures and circulation within the area support this slight increase in density and height. 2. An analysis of the development and use patterns for the vicinity of the Subject Property supports the proposed rezoning to T4-R. The Subject Property is located near the City's booming Health District; an area which continues to undergo a rapid increase in population and employment opportunities. The Health District is home to the City's principal health care, research, non-profit, educational and judicial institutions. The Subject Property is located within the section of the Miami River known as Allapatah, an area which, according to the Miami River Urban Infill Plan, consists of waterfront industrial, single-family, and high -density multifamily residential uses. The Subject Property is also located within walking distance of NW 27th Avenue, NW 22nd Avenue, NW 17th Avenue, and NW 20th Street (four major commercial thoroughfares). The requested zoning will allow the Subject Property and structures located on the site to come into conformity with Miami 21. Further, the rezoning will allow the Subject Property to match the character of riverfront properties in the area and better accommodate the needs of existing and future residents while contributing to the continued success and viability of Allapatah and the Health District. The property directly east of the Subject Property has a zoning designation of T6. The area surrounding the Subject Property is pruned for low and medium intensity redevelopment. The proposed T4-R zoning designation is a low density transect zone with development thresholds that are well below the permitted density, intensity MIA 185880855v2 GREENBERG TRAURIG, P.A. • ATTORNEYS AT LAW • WWW.GTLAW.COM and height of the T6 transect zone found in the immediate vicinity of the Subject Property and will serve as a transition between the Subject Property and the surrounding areas. The analysis below considers related properties located within a one half (1/2) mile radius of the Subject Property pursuant to Article 7, Section 7.1.2.8(2)(g) of Miami 21, including those properties that, as the Subject Property, front the Miami River. For example, please see the following sites as located within the surrounding area of the Subject Property: • The property located at 2290 NW North River Drive (zoned T3), adjacent to the Subject Property on the west along the north bank of the Miami River, consists of a two (2) story multi -family residential building containing twenty (20) units. See Image 1 below. • The property located at 2210 NW North River Drive (zoned T6-8-0), adjacent to the Subject Property on the east on the north bank of the Miami River, contains a two story multi -family residential building. See Image 2 below. • The Isla del Mar Condominiums (zoned T5-R) is located at 1800 NW 24th Avenue, less than .2 mile east of the Subject Property on the north bank of the Miami River. The Isla del Mar Condominium contains over 200 multi -family units situated in a ten story building. See Image 3 below. MIA 185880855v2 GREENBERG TRAURIG, PA. ATTORNEYS AT LAW WWW.GTLAW.COM • The Callahan Plaza Apartments community located at 1510 NW 19th Avenue (zoned T5-L), .2 miles away from the Subject Property on the east, contains seven multi -family residential buildings each consisting of three stories. See Images 4 and 5 below. • The property located at 1861 NW South River Drive (zoned T6-12-R), approximately .4 miles east of the Subject Property along the south bank of the Miami River, consists of a twenty one (21) and a twenty eight (28) story multi -family residential towers known as Terrazas River Park Village Apartments. See Images 6 and 7 below. Buildings in the surrounding area contain up to twenty eight (28) stories and permitted density ranges from 9 to 150 dwelling units per acre. As discussed above, the proposed rezoning to T4-R contemplates a minimal increase in density (from a maximum of 9 units per acre to 36 units per acre) and height (from a maximum of two (2) stories and 25 feet to three (3) stories and 40 feet) and is consistent with the development and land use patterns of the surrounding area. 3. The changing conditions and recent redevelopment in the vicinity of the Subject Property warrant the proposed rezoning to T4-R. The City's growth and evolution over time inevitably require changes to the existing zoning. With the rapid expansion and development of the Allapatah neighborhood and Health District, 22nd Avenue, 17th Avenue, and 201h Street have become gateways to these areas and vital neighborhood oriented commercial thoroughfares. Allapatah is also home to a thriving wholesale and retail clothing district, along with numerous produce and flower markets. The Health District is home to a vibrant commercial, educational, civic, and scientific community. Many of the major health care, educational, social services and judicial institutions within the Health District have expanded, increasing employment opportunities for the region and creating a demand for additional residential development. The rapid growth of the surrounding area supports and demands the zoning change to the next higher transect zone designation. The character of the 27`h, 22nd, and 17th Avenue corridors has evolved to consist of more dense residential uses necessary to serve the area's recent influx of skilled workers, particularly in the health, science and technology fields. The Subject Property, with its convenient access to public transit options and proximity to major educational, employment and entertainment centers, is uniquely positioned to provide the additional, denser housing options the area needs to continue its remarkable growth. 4. The proposed rezoning will permit a cohesive development of the Subject Property in accordance with the guiding principles and goals of Miami 21. The Subject Property's location along the Miami River, near the Allapatah commercial center and Health District, provides an ideal opportunity for a pedestrian oriented residential development that meets the needs of current and future residents. The proposed rezoning of the Subject Property to T4-R will maximize the residential development opportunity afforded by the Subject Property's location on the Miami River, adjacent to the City's major employment hubs and near key public transit facilities and transportation corridors. The extensive network of major public transit facilities and transportation corridors surrounding the Subject Property can accommodate the slight increase in density contemplated by the proposed rezoning to T4-R. The Subject Property has convenient access to mass transit, is located near major commercial thoroughfares and is in close proximity to the Miami Trolley Allapatah route. Additionally, the Subject Property will benefit from the proposed water transit solutions currently being studied by the City and Miami -Dade County which include the operation of a water taxi route on the Miami River to facilitate east -west travel. MIA 185880855v2 GREENBERG TRAURIG, P.A. • ATTORNEYS AT LAW • WWW.GTLAW.COM The proposed rezoning to T4-R will permit an ideal low density, small scale residential neighborhood that will promote walkability and be in context with the surrounding area. Residents of this compact, pedestrian oriented neighborhood will live in an urban community, near major employment centers, grocery stores, recreational/entertainment destinations and numerous retail options, where the ordinary activities of daily life can be performed without owning a car. As detailed above, the Subject Property currently contains nonconforming multi -family buildings. The proposed rezoning will bring the Subject Property into compliance with Miami 21 without increasing the impact from what currently exists. Further, the Applicant intends to provide a Riverwalk where one is not required by Miami 21. This will provide additional access to the Miami River and increase pedestrian connectivity in the neighborhood. IV. ANALYSIS FOR COMPREHENSIVE PLAN AMENDMENT The City's FLUM designates the Subject Property as SFR. The Applicant proposes an amendment to the Subject Property's FLUM designation from Duplex Residential to Low Density Multifamily Residential ("LDMR"). The LDMR designation permits residential uses to a maximum density of 36 units per acre which is consistent with the permitted uses under the T4- R Transect Zone. Attached hereto as Exhibit "B," please find an analysis of the general planning principles and goals and objectives of the MCNP demonstrating that the proposed FLUM amendment is in conformity with the MCNP. V. CONCLUSION In light of the foregoing, the proposed rezoning of the Subject Property to T4-R and the FLUM amendment to LDMR are consistent with the scale and residential character of the structures and uses located in the vicinity of the Subject Property, compatible with the established land use pattern in the area and complement the surrounding uses and structures. The proposed FLUM amendment and rezoning will allow the Subject Property to be redeveloped into a pedestrian oriented residential project that meets the intent and goals of Miami 21 and maintains the residential character of the area. The Subject Property is ideally suited for the envisioned pedestrian oriented development given its location on the Miami River and proximity to Allapatah and the Health District, and convenient access to public transit and major highways. Further, the proposed rezoning will permit only a minimal increase from what currently exists on the Subject Property, while also bringing the site into compliance with Miami 21. Enclosed please find the Applications, a check payable to the City for the associated filing fees, and the Survey of the Subject Property in connection with this submittal. The above named permittee, is hereby authorized to operate the marine facility at the above location which consists of the following: Recreational Boat Docking Facility. Total wet slips: 15 Total dry slips: 0 Total dry storage spaces: 0 Total commercial vessels: 0 Total recreational vessels: 15 Number of liveaboards: 0 Days of week in operation: 7 This facility is subject to conditions listed below and in the following pages (if any) of this permit. SPECIFIC CONDITIONS 1. This facility spans 2216, 2222, and 2260 NW North River Drive (Folios 01-3134-027-0010 and 01-3134-028-0241). This permit shall extend to the two adjacent parcels as one facility. 2. Due to shallow water depths, vessels shall be restricted to mooring "bow -in" (i.e. bow facing north) at all times within the slip areas near the north ends of the boat notches on either side of the facility. 3. No live -aboard vessels, permanent or transient, shall be permitted to dock at this facility at any time. 4. Unless otherwise authorized by this Department, repairs, maintenance, fueling, or other industrial activities of any type are not to be performed at this facility. 5. The maximum number of vessels that may be stored, docked, or moored at this facility may not exceed the number of slips and/or dry storage spaces as referenced above in this Operating Permit. Unless otherwise authorized by DERM, a maximum of one (1) vessel shall be moored in each designated slip. This condition shall not apply to appurtenant vessels such as dinghies and tenders that are associated by ownership, design, and common usage with a primary vessel docked, moored, or stored at the facility, and therefore, are affixed to/carried by and stored on the primary vessel. Adequate clearance shall be maintained at all times between the submerged bottom, and any existing benthic resources, and any vessels moored at the property, such that there are no impacts to either benthic resources or the submerged bottom, including but not limited to bottom scouring or prop dredging. 7. This facility must be operated in accordance with the "Marine Facilities Best Management Practices' (BMPs), which are incorporated by reference as part of this permit. Copies of the BMPs are available upon request. 8. All applicable conditions from previously executed local, state, and federal permits issued for the above -referenced marine facility shall be enforced. 9. All fixed or floating non -water dependent structures in, on, over, or upon tidal waters, unless previously approved by a Class I permit, are prohibited. 10. All permanent sewage pumpout systems and portable pumpout systems required at this facility pursuant to DERM, state, or federal permits shall be maintained on site and in fully operable condition at all times in order to convey sewage to the sanitary sewer system. Designated slips for pumpout stations shall be kept open at all times except while a vessel is discharging sewage to the pumpout system. There shall be no overboard discharge of sewage to tidal waters from vessels at this facility. This prohibition also includes discharges from approved Coast Guard Type 1 or 2 flow -through marine sanitation devices. All vessel occupants shall use shoreside facilities unless the vessel is equipped with a Coast Guard approved holding tank system or is directly connected to the facility's sewage pumpout system. 11. The facility owner/operator is required to maintain a submerged land lease from the State of Florida if any vessels or structures are located over state-owned submerged lands. Use of state-owned submerged lands without a lease or other form of consent from the State of Florida is prohibited 12. Unless otherwise approved by DERM, fueling of vessels at this facility shall be prohibited. Facilities approved for fueling operations shall maintain on -site spill prevention, containment, and recovery equipment and materials including, but not limited to, absorbent pads, booms, and sweeps and shall maintain staff trained in the deployment and operation of said equipment at all times. Fueling at approved facilities shall be conducted only at the designated fueling location in order to contain any spills that may occur. A floating containment boom large enough to enclose the area of the vessel being fueled, but with a minimum length of fifty (50) feet, shall be available at all times during fueling operations. Said equipment shall be deployed and operated in the most effective manner possible when spills occur. 13. Any vessel meeting the definition of a derelict vessel as defined in Section 823.11(b) Florida Statutes shall not be left, stored, or abandoned in, on, over, or upon tidal waters and submerged bottom within the facility. This includes any vessel in a wrecked, junked, or substantially dismantled condition, including any sunken vessel. For any derelict vessel that is docked, grounded, or beached upon private property within the facility, the property owner shall remove the vessel after complying with the notice requirements specified in Section 328.17(5) Florida Statutes. As the custodian of any such derelict vessel, the facility shall be responsible for the removal and proper disposition of the vessel if the owner of the vessel fails to do so. 14, Harassment of manatees is prohibited. Harassment includes, but is not limited to, feeding, watering, physical contact, and/or any interference in their normal behavior or movements. 15. All permitted docking facilities shall post a minimum of two (2) manatee awareness (i.e. caution) signs. Facilities with fifty (50) or more boat slips are also required to post a manatee educational display. All signs shall be posted in prominent locations, in areas clearly visible to users, staff, and guests of the facility. All signs shall conform to Florida Fish and Wildlife Conservation Commission (FWC) guidelines (http://www.myfwc.com) and be maintained for the life of the docking facility in a manner acceptable to FWC and DERM. Additional signs may be requested to be posted depending on the size and layout of the facility. GENERAL CONDITIONS 16. The applicant, by acceptance of this document, agrees to operate and maintain the subject operation so as to comply with the requirements of Chapter 24 of the Code of Miami -Dade County. 17. If for any reason, the applicant does not comply with or will be unable to comply with any condition or limitation specified on this document the applicant shall immediately notify and provide the department with the following information: (a) a description of and cause of non-compliance; and (b) the period of non-compliance including exact dates and times; or, if not corrected, the anticipated time the non-compliance is expected to continue, and steps taken to reduce, eliminate, and prevent recurrence of the non-compliance. As provided in Section 24-15 of the Code of Miami -Dade County, the prior written approval of the Department shall be obtained for any alteration to this facility. 19. The issuance of this document does not convey any vested rights or any exclusive privileges. Nor does it authorize any injury to public or private property or any invasion of personal rights, nor any infringement of federal, state or local laws or regulations. Nor does it relieve the applicant from liability for harm or injury to human health or welfare or property. 20, This document is required to be posted in a conspicuous location at the facility site during the entire period of operation. 21. This document is not transferable. Upon sale or legal transfer of the property or facility covered by this document, the applicant shall notify the department within thirty(30) days. The new owner must apply for a permit within thirty (30) days. The applicant shall be liable for any non-compliance of the source until the transferee applies for and receives a transfer of this document 22. The applicant, by acceptance of this document, specifically agrees to allow access to the named source at reasonable times by department personnel presenting credentials for the purposes of inspection and testing to determine compliance with this document and department rules. 23. This document does not indicate a waiver of or approval of any other department permit that may be required for other aspects of this facility. 24. This document does not constitute an approval by the Department or certification that the applicant is in compliance with applicable laws, ordinances, rules or regulations. The applicant acknowledges that separate enforcement actions may be initiated by the Department and that this document does not constitute compliance with orders issued in conjunction with enforcement actions for correction of violations. 25. Failure to comply with any condition of this document, or the requirements of Chapter 24, Code of Miami -Dade County may subject the applicant to the penalty provisions of said Chapter including civil penalties up to $25,000 per day per offense and/or criminal penalties of $500 per day or not less than $1000 per day for violations of Section 24-42.4, Sanitary Sewer Discharge Limitations and Pretreatment Standards and/or sixty (60) days in jail. Criteria Pursuant to Article 7, Section 7.1.2.8.a.3. and Section 7.1.2.8.c.1, the requested parcels for rezoning does meet the minimum land area of at least 40,000 square feet or 200 feet of street Frontage on one (1) street to allow submittal for a zoning change, and the requested rezoning is also successional with the change of zoning request from T3-O to T4-R. The Division of Land Development of the Planning and Zoning Department confirms the applicant may submit an application of rezoning with the following conditions: 1. Pursuant to Article 7, Section 7.1.2.8.c.2.g, provide an analysis of the properties within a one- half mile radius of the subject property regarding the existing condition of the radius properties and the current zoning and Future Land Use designations of the radius properties.
