Escarra Tel (305) 579-0737 escarrai@gtlaw.com RE: 2701 Bayshore Commercial, LLC and 2850 Tigertail Investments, LLC/ Letter of Intent and Application for Rezoning for properties located at 2765 South Bayshore Drive and 2850 Tigertail Avenue, Miami, Florida Dear Francisco: On behalf of 2701 Bayshore Commercial, LLC and 2850 Tigertail Investments, LLC, (collectively, the "Applicant"), we respectfully submit the enclosed Application for Rezoning of the properties located at 765 South Bayshore Drive and 2850 Tigertail Avenue, Miami, Florida, (collectively, the "Subject Property"). Please consider this correspondence as the Applicant's Letter of Intent and analysis pursuant to Article 7.1.2.8(c)(2)(g) of Miami 21 for a rezoning of the Subject Property. The Applicant seeks to develop a portion of the Subject Property as a mixed use development with office use, ground floor retail, and requisite parking. PROPERTY INFORMATION According to the survey as prepared by Fortin, Leavy, Skiles, Inc., dated May 3, 2017 (the "Survey"), the Subject Property is approximately 43,494 square feet or 0.998 acres in area and currently consists of a one -Story commercial structures with surface parking. As further indicated on the Survey, the Subject Property meets the 200 feet of frontage requirement under Article 7.1.2.8(c)(1) with 235 feet of frontage on Tigertail Avenue. FL 33131-3238 • Tel 305.579.0500 • Fax 305.579.0717 Letter of Intent for Submittal of Application for Rezoning 2850 Tigertail Avenue FUTURE LAND USE The City's Future Land Use Map (the "FLUM") of the City's Comprehensive Neighborhood Plan (the "Comprehensive Plan") designates the Subject Property as Restricted Commercial. Under the City's Comprehensive Plan, the Subject Property's Restricted Commercial designation permits residential uses to a maximum density equivalent to High Density Multifamily Residential (i.e., 150 residential dwelling units per acre). The Restricted Commercial designation also permits hotel, office, retail, restaurants, and "general entertainment facility" uses. Accordingly, the Applicant's proposed office and commercial uses for the Subject Property are permitted under the Restricted Commercial designation of the City's Comprehensive Neighborhood Plan and is in keeping its specific goals, objectives and policies as included in this correspondence. ANALYSIS OF REQUEST FOR REZONING Per Miami 21, the current zoning for the Subject Property is T6-12-0 and T5-O, all with a Coconut Grove Neighborhood Conservation District ("NCD-3") overlay. Image 2 2 GREENBERG TRAURIG, PA. • ATTORNEYS AT LAW WWW.GTLAW.COM Letter of Intent for Submittal of Application for Rezoning 2850 Tigertail Avenue The Applicant now proposes and hereby submits the enclosed application for approval of a zoning change for a portion of the Subject Property from T5-O to T6-8-O and for a rezoning of a portion of the Subject Property from T6-12-0 to T6-8-O, as depicted in Image 3 below and pursuant to the successional zoning requirements of Article 7.1.2.8 of Miami 21. Image 3 For the reasons outlined below, the proposed rezoning is consistent and appropriate for the Subject Property and should be approved. 1. The proposed rezoning the Subject Property will create an appropriate transition between the T6-12-0 Transect Zone on the east to the T5-O Transect Zone on the west. Section 2.1.3 of Miami states "Successional change emerges from a vision of the larger urban context and appropriate transitions across Transect Zones." The proposed rezoning is successional and follows the table featured in Section 7.1.2.8(3). The T5-O Transect Zone allows up to 5 Stories and does not provide an FLR multiplier, instead regulating intensity through lot coverage, setbacks, and height. The T6-12-0 Transect Zone permits an • FLR multiplier of 8 and permitted height of 12 Stories. Through the use of bonuses, the T6-12-0 Transect Zone can be drastically out of scale with an abutting T5-O Transect Zone. With the utilization of bonuses, a T6-12-0 zoned property can achieve a height of 20 Stories and bonus FLR of 30% of what is permitted by right. The proposed rezoning creates an appropriate transition between the possible twenty (20) Story towers of the T6-12-0 Transect Zone to the east and the T5-O Transect Zone to the west, which is limited to five (5) Stories. The T6-8-O Transect Zone's by right limitations at eight (8) Stories and an FLR multiplier of 5 allows development to stay within the scale of both the more intense uses to the east, and the more modest development to the west. 2. An analysis of the development and use pattern for the immediate vicinity of the Subject Property supports the proposed rezoning. The Subject Property does not adjoin or abut any single-family residential neighborhoods. Most of the neighboring properties are currently vacant. Below is an analysis of existing structures in the neighborhood which support the rezoning. • Abutting the Subject Property to the west at 3310 Mary Street is a mixed use commercial, office, and public parking structure. This property, located in the Village Center of Coconut Grove, is to be redeveloped to increase the office space and provide an expanded retail use. This redevelopment of the existing structure to indicative of the revitalization of the Village Center of Coconut Grove, and shows that the Subject Property is an ideal location for the proposed office and retail use. The rezoning of the Subject Property would provide the appropriate transition between the more intense height of the residential areas on South Bayshore and the commercial Village Center. Image 5 • The Tower Residences built in 2001, abutting the Subject Property to the northeast, consists of two (2) 20-story multi -family residential towers. The existing and developing projects in the See Image 6 below. Image 6 3. The changing conditions and recent redevelopment in the immediate vicinity of the Subject Property warrant the proposed rezoning. 5 GREENBERG TRAURIG, P.A + ATTORNEYS AT LAW w WWW GTLAW COM Letter of Intent for Submittal of Application for Rezoning 2850 Tigertail Avenue As previously mentioned, the Subject Property is located in an area of the City that has seen a renewed enthusiasm in recent years. The demand for office use in Coconut Grove has grown exponentially in the last few years as evidenced by the redevelopment of the Coconut Grove Bank building and the expansion of the office uses at the Mary Street parking garage. The proposed use at the Subject Property, an office structure with ground floor retail fits the growth trend in Coconut Grove and the rezoning allows the Applicant to fulfill a need. The rezoning will allow a structure which provides a larger office structure while still serving as an appropriate transition between the T6-12-0 Transect Zone to the east. A portion of the Subject Property is being down zoned from T6-12-0 to T6- 8-0 which permits less height and less intensity. This will maintain the appropriate transition from T6- 12-0 on the east to the T5-0 on the west. The Subject Property is located on a portion of the Tigertail corridor that is within the heart of the Coconut Grove Village Center and is an appropriate location for the T6-8-0 Transect Zone. The proposed rezoning fulfills Comprehensive Plan Policy LU-1.1.7: • Land development regulations and policies will allow for the development and redevelopment of well -designed mixed -use neighborhoods that provide for the full range of residential, office, live/work spaces, neighborhood retail, and community facilities in a walkable area and that are amenable to a variety of transportation modes, including pedestrianism, bicycles, automobiles, and mass transit. With the residential influx of new residential projects along South Bayshore Drive, increasing office space is a necessity, and the proposed rezoning allows the Applicant to satisfy this need. The rezoning, with the proposed office and ground floor retail space, will create a true live -work -play environment within this rapidly sector of the Coconut Grove Village Center. The rezoning will also create a pedestrian friendly realm, allowing local residents to opt out of using their vehicles and walk to the office and the provided retail spaces, which shall alleviate the traffic congestion and furthering the work -live -play concept that Miami 21 espouses. CONCLUSION In light of the foregoing, the proposed rezoning of the Subject Property, pursuant to the Rezoning Application is appropriate due to the proximity of the site to a rapidly developing commercial and residential area, is consistent with the scale, character and uses located in the immediate vicinity, and is compatible with the established land use pattern in the area. The Applicant's proposed rezoning creates an appropriate transition between the higher intensity and taller uses to the east and the shorter, less intense uses to the west. Please note that pursuant to Article 7.1.2.8(c)(2)(g) of Miami 21, the proposed Rezoning of the Subject Property is in conformance with the Comprehensive Plan, the established land use pattern for the adjacent properties and the immediate area, and in scale with the needs of the neighborhood. ATTORNEYS AT LAW u WWW.GTLAW.COM Letter of Intent for Submittal of Application for Rezoning 2850 Tigertail Avenue Comprehensive Plan Objectives and Policies Furthered by Rezoning • Policy LU-1.1.1: Development orders authorizing new development or redevelopment that results in an increase in the density or intensity of land use shall be contingent upon the availability of public facilities that meet or exceed the minimum LOS standards adopted in the CIE, specifically sanitary sewer, solid waste, stormwater, potable water, parks and recreation, and transportation facilities. The public services and facilities provided to meet concurrency requirements shall be consistent with the Capital Improvements Element, or guaranteed in an enforceable agreement. The public services and facilities will include public schools when the Miami -Dade County School Board and local governments in the county implement school concurrency pursuant to paragraph 163.3177(12)(i), F.S. • Policy LU-1.1.7: Land development regulations and policies will allow for the development and redevelopment of well -designed mixed -use neighborhoods that provide for the full range of residential, office, live/work spaces, neighborhood retail, and community facilities in a walkable area and that are amenable to a variety of transportation modes, including pedestrianism, bicycles, automobiles, and mass transit. • Objective LU-1.2: Promote, facilitate, and catalyze the redevelopment and revitalization of blighted, declining or threatened residential, commercial and industrial areas through a variety of public, private, and public -private redevelopment initiatives and revitalization programs including, where appropriate, historic designations. • Objective LU-1.3: The City will continue to encourage commercial, office and industrial development within existing commercial, office and industrial areas; increase the utilization and enhance the physical character and appearance of existing buildings; encourage the development of well -designed, mixed -use neighborhoods that provide for a variety of uses within a walkable area in accordance with neighborhood design and development standards adopted as a result of the amendments to the City's land development regulations and other initiatives; and concentrate new commercial and industrial activity in areas where the capacity of existing public facilities can meet or exceed the minimum standards for Level of Service (LOS) adopted in the Capital Improvement Element (CIE). • Policy LU-1.3.15: The City will continue to encourage a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other. • Objective LU-1.6: Regulate the development or redevelopment of real property within the city to insure consistency with the goals, objectives and policies of the Comprehensive Plan. • Policy LU-1.6.3: The City's Planning Department shall review all proposals to amend the City's Zoning Ordinance and any other land development regulations, and shall report as to the consistency between any proposed amendment and the MCNP, to the Planning Advisory 8 GREENBERG TRAURIG, P.A. ■ ATTORNEYS AT LAW • WWW.GTLAW.COM Letter of Intent for Submittal of Application for Rezoning 2850 Tigertail Avenue Board, the City's "local planning agency," which will then forward its recommendation to the City Commission for approval and adoption.
