Purpose of Item:
A Resolution of the Miami City Commission, with attachments, authorizing the City
Manager to execute a Memorandum of Understanding (MOU) from the United States
Secret Service (USSS) for the Police Department's participation in assisting the U.S.
Secret Service's Miami Electronic Crimes Task Force in conducting official
investigations; authorizing the City Manager to execute the necessary documents, in
substantially the attached form, and further authorizing the City Manager to designate
the Chief of Police to execute any other necessary documents in order to implement the
acceptance of said reimbursement funds. No matching funds are required from the
City of Miami.
Background of Item:
The USSS has requested our Department to enter into a Memorandum of
Understanding for the reimbursement of funds directly related to work performed by
officer(s) assigned to assist the U.S. Secret Service's Miami Electronic Crimes Task
Force. This MOU establishes the procedures and responsibilities of both the City of
Miami Police Department and the USSS for the reimbursement of certain overtime costs
and other expenses pursuant to 31 USC 9703. The execution of this MOU will authorize
the payment of certain overtime expenditures, travel, fuel, training, equipment and other
similar costs of State and Local law enforcement officers, that are involved in joint
operations.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF
UNDERSTANDING WITH THE UNITED STATES SECRET SERVICE ("USSS")
ALLOWING THE CITY OF MIAMI POLICE DEPARTMENT TO PARTICIPATE IN THE
USSS' "MIAMI ELECTRONIC CRIMES TASK FORCE" TO ASSIST IN CONDUCTING
OFFICIAL DIGITAL FORENSICS INVESTIGATIONS; FURTHER AUTHORIZING THE
CITY MANAGER TO DESIGNATE THE CHIEF OF POLICE TO EXECUTE ANY
OTHER NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR THE ACCEPTANCE OF REIMBURSEMENT FUNDS.
WHEREAS, the United States Secret Service ("USSS") Miami Electronic Crimes Task
Force ("MECTF") is comprised of federal, state, and local officers who have been trained to
conduct forensic examinations of all digital media to investigate and combat electronic and
financial crimes; and
WHEREAS, the MECTF receives requests to examine electronic media for numerous
law enforcement agencies throughout South Florida, including the Miami Police Department
("MPD"); and
WHEREAS, participating member agencies in the MECTF have access to resources and
capabilities which allows investigators of participating member agencies to conduct their digital
examinations and combat electronic and financial crimes more expeditiously; and
WHEREAS, the USSS Miami Field Office has invited MPD to enter into a Memorandum
of Understanding ("MOU") to become a participating member agency of the MECTF; and
WHEREAS, this MOU allows MPD to request reimbursement of funds for payment of
overtime and operational expenses directly related to the work performed by MPD officers
assigned to assist the MECTF in conducting official investigations;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the MOU between the USSS and
the City of Miami to allow the MPD to participate in the USSS' MECTF in conducting official digital
forensic investigations.
1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
Section 3. The City Manager is further authorized' to designate the Chief of Police to
execute any other necessary documents, in a form acceptable to the City Attorney, to accept
reimbursement of funds for payment of overtime and operational expenses.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
